amending Law No. (13) of 2013

on administrative and political isolation

The General National Congress

Upon review of:

  • The interim Constitutional Declaration issued on 3 August 2011 and the amendments thereof;
  • General National Congress Resolution No. (62) of 2013 on approving the amendment of the General National Congress’ rules of procedure;
  • Law No. (87) of 1971 on the State Lawsuits Authority;
  • Law No. (88) of 1971 on the administrative judiciary and the amendments thereof;
  • Law No. (6) of 1982 on reorganising the Supreme Court and the amendments thereof;
  • Law No. (6) of 2006 on the judiciary and the amendments thereof;
  • Law No. (13) of 2013 on political and administrative isolation;
  • Conclusions of the General National Congress in its 128th ordinary session held on Sunday 22/09/2013;

issued the following law:

Article (1)

A new article numbered Article (12) bis shall be added to the aforementioned Law No. (13) of 2013 on political and administrative isolation. The text thereof shall be as follows:

“Notwithstanding the provisions of Article (12) of this law, the Commission shall examine and review the candidature application for the Constitutional Drafting Assembly elections. It shall take its decision regarding such application within twelve days from its receipt from the High National Elections Commission. Concerned persons may appeal such decision before the president of the competent court of first instance or his delegate within seventy-two hours from the date of publication of the decision in the competent electoral district. This appeal shall be ruled on within three days from its submission. It may be appealed before the competent court of appeal within three days from its issuance. The court of appeal shall rule thereon in a hearing within five days from its submission and render a final, unappealable and binding judgment to all entities and concerned persons.

Article (2)

The provisions of this law shall enter into force from its date of issuance. It shall be published in the Official Gazette.
