on amending the jurisdiction of two first instance courts and prosecutions

The Supreme Council of Judicial Bodies

Upon review of:

  • Law No. (6) of 1374 FDP on the justice system;
  • Supreme Council of Judicial Bodies Decision No. (9) of 1428 FBP on establishing two public prosecutions and the amendments thereof;
  • Supreme Council of Judicial Bodies Decision No. (7) of 1373 FDP on establishing two first instance courts and the amendments thereof;
  • Supreme Council of Judicial Bodies Decision No. (18) of 1375 FDP on establishing a first instance court and prosecution;
  • Supreme Council of Judicial Bodies Decision No. (19) of 1375 FDP on establishing summary courts and prosecutions;
  • The minutes of the 5th session of the Supreme Council of Judicial Bodies of 1375 FDP held on 04/06/2007;

has decided:

Article (1)

The jurisdiction of the First Instance Courts of South and North Benghazi shall be amended as follows:

First: The jurisdiction of the First Instance Court of South Benghazi shall comprise the jurisdiction of the following summary courts:

  1. Summary Court of Al-Berka.
  2. Summary Court of Al Fuwayha.
  3. Summary Court of South Benghazi for Facilities.
  4. Summary Court of South Benghazi for Traffic.
  5. Summary Court of South Benghazi for Agricultural Crimes.
  6. Summary Court of South Benghazi for Economic Crimes and Smuggling.
  7. Summary Court of South Benghazi to Combat Illegal Migration.

Second: The jurisdiction of the First Instance Court of North Benghazi shall comprise the jurisdiction of the following summary courts:

  1. Summary Court of Al-Madina.
  2. Summary Court of Al-Sabri.
  3. Summary Court of Al Urouba.
  4. Summary Court of North Benghazi for Facilities.
  5. Summary Court of North Benghazi for Traffic.
  6. Summary Court of North Benghazi for Agricultural Crimes.
  7. Summary Court of North Benghazi for Economic Crimes and Smuggling.
  8. Summary Court of North Benghazi to Combat Illegal Migration.

Article (2)

The jurisdiction of the First Instance Prosecutions of South and North Benghazi shall include the following summary prosecutions, which shall be subordinate thereto:

First: The following summary prosecutions shall be subordinate to the First Instance Prosecution of South Benghazi:

  1. Summary Prosecution of Al-Berka.
  2. Summary Prosecution of Al Fuwayha.
  3. Summary Prosecution of South Benghazi for Facilities.
  4. Summary Prosecution of South Benghazi for Traffic.
  5. Summary Prosecution of South Benghazi for Agricultural Crimes.
  6. Summary Prosecution of South Benghazi for Economic Crimes and Smuggling.
  7. Summary Prosecution of South Benghazi to Combat Illegal Migration.
  8. Summary Prosecution of South Benghazi to Combat Drugs and Psychotropic Substances.

Second: The following summary prosecutions shall be subordinate to the First Instance Prosecution of North Benghazi:

  1. Summary Prosecution of Al-Madina.
  2. Summary Prosecution of Al-Sabri.
  3. Summary Prosecution of Al Urouba.
  4. Summary Prosecution of North Benghazi for Facilities.
  5. Summary Prosecution of North Benghazi for Traffic.
  6. Summary Prosecution of North Benghazi for Agricultural Crimes.
  7. Summary Prosecution of North Benghazi for Economic Crimes and Smuggling.
  8. Summary Prosecution of North Benghazi to Combat Illegal Migration.
  9. Summary Prosecution of North Benghazi to Combat Drugs and Psychotropic Substances.

Article (3)

Any provision contrary to the provisions of this decision shall be repealed.

Article (4)

The competent authorities shall implement this decision. It shall enter into force from 1 September 1375 FDP 2007 AD and shall be published in the Register of Procedures.
