amending Law No. (36) of 2012
on the asset and property management of certain persons
The Interim National Transitional Council
Upon review of:
- The Victory Statement of the 17 February Revolution issued on 22 February 2011;
- The Interim Constitutional Declaration issued on 3 August 2011, and the amendments thereof;
- The Code of Civil and Commercial Procedure, the Commercial Code, the Civil Code, and the supplementary laws thereto;
- The internal regulation of the National Transitional Council;
- Law No. (36) of 2012 on asset and property management of certain persons;
- The deliberations of the National Transitional Council session held on Monday 28/05/2012;
- Considerations of the public interest;
issued the following law:
Article (1)
Article (1) of aforementioned Law No. (36) of 2012 shall be amended to the following text:
“The assets and properties of the persons listed in the table attached herein, as well as the assets and properties of the spouses and children of the natural persons thereof, shall be placed under the control of a public receiver.”
Other names, assets, or properties may be included in the abovementioned table by a Cabinet decree if it is deemed necessary to place them in receivership, based on the following conditions:
- If the person commits an act detrimental to the safety and security of the State, whether inside or outside the country, or to its higher national interests, or endangers national unity.
- If strong suspicions of corruption exist. Suspected corruption involves any commercial business undertaken with Gaddafi or his children, any gifts or money unrightfully therefrom, any increase in wealth due to abuse of function or position, conspiracy or bribery related to the execution of contracting, supply, or public works contracts or any administrative contract concluded with the government, public entities or institutions, their affiliated units, or any public legal entity, whether through smuggling, the illegal drug trade, the black market, manipulation of people’s food or medicine, misappropriation of public funds or State-owned private funds, or misappropriation of the assets and properties of citizens or private legal entities.
- If a final judicial ruling is pronounced on any crime of squandering or misappropriation of public funds or illicit gain.
- The person must not be the owner of a legal economic activity through which he achieved constant economic efficiency from the tax file, customs declarations, bank accounts, or others.
- If the person is a wanted fugitive, and there are indications of his probable involvement in illicit gains.
In any case, the Cabinet may reject the need for receivership for any person in the absence of grounds for the imposition thereof.
Article (2)
Article (8) of aforementioned Law No. (36) of 2012 shall be amended to the following text:
“Only the judicial receiver shall initiate and proceed with a civil or commercial action whenever such action concerns assets in receivership”
Concerned persons may appeal the placement of their assets and properties in receivership before the competent court in accordance with the general rules stipulated by law.
Article (3)
The table attached to Law No. (36) of 2012 on asset and property management of certain persons shall be repealed and replaced with the table attached herein.
Article (4)
This law shall enter into force from its date of issuance, repealing any contrary provision. It shall be implemented by the concerned entities, each within their mandate, and it shall be published in the Official Gazette.
