on drafting a roadmap for dispute resolution between Libyan cities

The General National Congress

Upon review of:

  • The interim Constitutional Declaration issued on 3 August 2011, and the amendments thereof;
  • General National Congress Resolution No. (62) of 2013 on approving the amendment of the General National Congress’ rules of procedure;
  • The conclusions of the General National Congress in its 147th ordinary session held on Sunday 8 December 2013;

issued the following resolution
:

Article (1)

The Prosecutor General shall form a special committee from the following entities to receive complaints and names of the wanted persons involved in the War of Liberation:

  1. The local council of the city or region.
  2. The military council of the city or region.
  3. City residents.

Complaints shall be filed within thirty days from the date of announcement of the committee’s establishment. The committee shall have offices in Tripoli, Benghazi, and Sabha to receive such complaints.

Article (2)

The committee shall sort and classify complaints and refer them to the competent prosecution to proceed with the investigation and collect the related evidence.

Article (3)

The Prosecutor General shall issue subpoenas and arrest warrants for suspects in accordance with the established legal procedures. The local councils of the displaced persons’ families shall provide the necessary assistance to bring suspects to justice.

Article (4)

Competent courts and prosecutions shall rule on the cases related to displaced affairs in summary proceedings. The Supreme Judicial Council shall instruct courts and prosecutions to comply therewith.

Article (5)

Upon issuance of the list of wanted persons by the Prosecutor General, the interim government shall determine the date and process for the return of the displaced persons to their regions under the supervision of the Libyan National Army. The government shall reconstruct the facilities and buildings of those regions that were affected by the War of Liberation and indemnify victims who suffered physically and mentally.

Article (6)

The provisions of this resolution shall enter into force from its date of issuance. This resolution shall be implemented by the concerned entities, each within their mandate. It shall be published in the Official Gazette.
