Decision No. (45) of 2012

on establishing a summary court and prosecution

and amending the area of jurisdiction of a first instance court and prosecution,

and summary courts and prosecutions

The Supreme Judicial Council,

Upon review of:

  • The Constitutional Declaration issued on 3/8/2011 and amendments thereto;
  • Law No. (6) of 2006 on the justice system and amendments thereto;
  • The proposal of the Judicial Body Inspection Department in Letter No. 660 dated 14/6/2012;
  • Based on the submission of the head of the Supreme Judicial Council in the Council’s 7th meeting of 2012 held on 27/6/2012, and the approval of the Council.

has decided:

Article (1)

A summary court in the area of jurisdiction of the Zawia First Instance Court shall be established, called the “South Zawia Summary Court.” Its headquarters shall be in the Tirfas region south of the city of Zawia and its area of jurisdiction shall be defined as the areas of jurisdiction of the security centres of Nasr, Omar bin Abdelaziz, Zawia Al-Wasat.

A summary prosecution shall be established in the area of the court’s jurisdiction, affiliated to the Zawia First Instance Prosecution, called the “South Zawia Summary Prosecution.”

Article (2)

Cases falling within the jurisdiction of the South Zawia Summary Court under Article (1) shall be referred to this court unless they have been postponed until sentencing.

Cases falling within the jurisdiction of the South Zawia Summary Prosecution under Article (1) shall be referred to this prosecution, unless they have been disposed.

Article (3)

Any provision that conflicts with those of this Decision shall be repealed.

Article (4)

This Decision shall enter into force on the beginning of the 2012-2013 judicial year. The concerned bodies shall enforce this Decision and it shall be published in the Official Gazette.
