Law No. (8) of 2014 AD

on the national ID number

The General National Congress,

Upon review of:

  • The interim Constitutional Declaration issued on 03 August 2011 AD and amendments thereto;
  • The rules of procedure of the General National Congress;
  • The Law of the Financial System of the State, and the budget, accounts, and stores regulations;
  • Law No. (36) of 1968 on civil status and amendments thereto;
  • Law No. (12) of 2010 AD on labour relations;
  • Law No. (7) of 2013 AD on approving the general budget for 2013 AD and amendments thereto;
  • The conclusions of the General National Congress in its 178th ordinary meeting held on Sunday, 22 Jumada al-Awwal 1435 AH, corresponding to 23 March 2014 AD;

issued the following Law:

Article (1)

A reference number entered into an individual’s identifying information in the national database, deemed a source for identifying and confirming personal identity before all state institutions. No state body may issue any document or service until an individual obtains a national ID number.

Article (2)

The official structure of the national ID number shall be as follows:

  1. The national number shall be one unique number for each citizen made up of twelve (12) digits.
  2. The national number shall be formed as follows, from left to right:
  1. The first digit (digit 1) shall specify male or female, where the number one (1) indicates male and the number two (2) indicates female.
  2. The second, third, fourth, and fifth digits (digits 2, 3, 4, and 5) shall specify the citizen’s year of birth.
  3. Digits 6 to 11 shall specify the citizen’s number within the year of birth according to the category of male or female identified in the first digit (digit 1).
  4. The twelfth digit (digit 12) shall be used to check the national number.

Article (3)

  1. The national database shall be formed in cooperation with the Civil Status Authority and the National ID project, and shall contain the following basic information on citizens:
  • National ID number
  • Full (four-part) name
  • Mother’s name
  • Date of birth
  • Place of birth
  1. The national database shall be supplemented with the following vital data:
  • Set of ten fingerprints
  • Iris recognition print
  • Photograph
  • Signature
  1. This information shall be obtained through passport and personal ID applications.
  2. The national database shall be deemed supplementary to the data on Libyan citizens in the Civil Registry database.
  3. All applications and services for citizens may obtain a citizen’s data through the national database.

Article (4)

National ID numbers shall be granted at birth, based on an individual’s data in the Civil Registry at the Civil Status Authority, provided that such information is complete and correct and the individual is a Libyan citizen. The national ID number shall be deemed a basic condition for the right to certificates and documents indicative of citizenship and to obtain any public services requested by a citizen related to their life affairs.

Article (5)

The national ID number shall be invalidated if it is obtained illegally or if the holder loses Libyan citizenship.

Article (6)

All related bodies shall include the national ID number in all records, documents, and files on individuals and use the number to organise and save transactions, records, and files as a fixed reference for establishing an individual’s identity throughout their life, without compromising the organisation and saving methods used by such bodies.

Article (7)

All government ministries and administrative units, civil and military authorities, institutions, and bodies, public companies, and the like shall use the national ID number allotted to each Libyan citizen to disburse all salaries and remuneration and for all administrative, financial, and economic procedures related to the Libyan state. All bodies mentioned shall suspend the salary, remuneration, or financial amount due to any Libyan citizen if they do not provide their national ID number, or in the event of any undue duplicate or repeat disbursals of the salary, remuneration, or financial amount due by more than one body.

The aforementioned bodies shall not complete any administrative or financial procedures or economic activities for any Libyan citizen except pursuant to the national ID number.

Article (8)

The issuance of temporary national ID numbers for any reason shall be prohibited. The financial and administrative status of any citizens of Libyan origin who were previously registered in the Civil Registry and not issued national ID numbers shall be remedied under regulatory procedures approved by the Cabinet to allow for the disbursal of their salaries until their status is settled, without any duplicates or repetition.

Article (9)

The related bodies shall identify all cases mentioned in Article (8) of this Law, prohibit any new entries, and set a deadline to end the suspended status of such cases by granting national ID numbers or cancelling such entries and all consequent procedures.

Article (10)

Without prejudice to any more severe penalty provided under the legislation in force, anyone who violates this Law shall be subject to imprisonment for a period of not less than a year and a fine of not less than one thousand Libyan dinars and not more than five thousand Libyan dinars.

Article (11)

This Law shall enter into force on the date of its issue and shall be published in the Official Gazette. Any provision that conflicts with those of this Law shall be repealed.
