on work controls of inspectors-general for the sectors

 

The Secretariat of the General People's Congress,

 

Upon review of:

  • Law No. (1) of 1369 FDP on on the People's Congresses and the People's Committees, and the implementing regulations thereof;
  • Law No. (11) of 1425 FBP on reorganising the People's Oversight and amendments thereto;
  • Law No. (12) of 1371 FDP adding a provision to Law No. (1) of 1369 FDP on the People's Congresses and the People's Committees;
  • General People's Congress Decree No. (3) of 1372 FDP on reorganising the Secretariat of the General People's Committee;
  • Based on the proposal of the Secretariat of the General People's Committee under Letter No. (3092) dated 15 April 1372 FDP;

 

has decreed:

 

Article (1)

Inspectors-general for the sectors shall exercise their competencies in accordance with the controls set out in this Decree.

 

Article (2)

Inspectors-general shall handle the inspection and monitoring of all matters within their competence related to the performance of the concerned sectors and the workers therein to assess their commitment to performing the duties of their positions and achieving the set performance rates. They shall also collect information and data related to the implementation of plans and programs, monitor the implementation of public policies related to the sectors and the bodies affiliated thereto, assess sector performance, issue warnings on any negligence or neglect, and refer violators to investigation. In doing such, they may undertake the following in particular: 

  • Monitor the works of the people's committees for the sectors in the districts, to confirm the extent of their commitment to achieving its goals and applying the legislation in force. 
  • Inspect, monitor, and provide technical supervision of the bodies, agencies, and public companies in the concerned sectors, and confirm the extent of their commitment to achieving their goals and applying the legislation in force. 
  • Request any information or data related to the performance of the people's committees for the sectors in the districts and the workers therein, and review the related documents, certifications, and records.
  • Propose solutions to problems hindering workflow and means for improving the administrative and technical performance in the concerned sectors.
  • Coordinate among the people's committees of the districts, the General People's Committee, the Secretariat of the General People's Committee, and the General People's Committee for the Districts as relates to the sectors they inspect.
  • Monitor the performance of the workers in the concerned sectors and propose ways of improving their performance.
  • Review minutes of the meetings of the concerned general people's committees for the sectors in the districts and make any observations that might be required. 
  • Study the proposals of people's committees for the districts and other committees related to the concerned sectors and adopt the necessary measures to refer them to the Secretariat of the General People's Committee.
  • Prepare the necessary reports on sector activities and refer them to the Secretariat of the General People's Committee.
  • Submit matters related to sector work based on an assignment from the Secretariat of the General People's Committee, and propose inclusion of issues related thereto in the agenda of the General People's Committee, the Secretariat of the General People's Committee, or the General People's Committee for the Districts.
  • Notify the oversight and judicial bodies of violations committed by workers in the concerned sectors and refer them to investigation in accordance with the legislation in force.
  • Monitor the rectification of violations committed by workers in the concerned sectors, and the penalties imposed thereon, and inform the concerned bodies of the outcomes.
  • Investigate causes of negligence, neglect and administrative laxity in the concerned sectors in the districts and contain and propose ways of remedying them. 
  • Provide opinions on the matters submitted to the General People's Committee, the Secretariat of the General People's Committee, or the General People's Committee for the Districts that concern one of the concerned sectors in the districts.

 

Article (3)

The planning councils and sectors in the districts shall provide the competent inspector-general with the draft plans and programs for the sector, for him to provide his suggestions thereon.

 

Article (4)

Secretaries of popular committees of the concerned sectors in the districts shall refer copies of the procedures adopted thereby and the reports of people's committees in the districts forwarded thereto to the sector's inspector-general, and shall comply with the observations he makes thereon with regard to such procedures and reports.

 

Article (5)

The inspector-general may invite the secretaries of people's committees in the concerned sectors in the districts to discuss a specific matter concerning more than one district and refer it to the Secretariat of the General People's Committee to adopt the necessary measures with regard thereto.

 

 

Article (6)

Inspectors-general shall monitor general policies on the specified sectors in Libya and abroad based on an assignment from the Secretariat of the General People's Committee.

 

Article (7)

The internal regulations of the administrative unit of the inspectors-general shall be issued in a decree from the Secretariat of the General People's Committee that shall specify the necessary organisational divisions and their detailed competencies, based on a proposal from the Secretary of the General People's Committee for Manpower, Training, and Employment.

 

Article (8)

With regard to his workers’ employee affairs, the inspector-general shall exercise the powers of the competent secretary under the legislation in force.

 

Article (9)

This Decree shall not prejudice the competencies assigned to oversight and judicial bodies in the legislation in force.

 

Article (10)

Any provision that conflicts with those of this Decree shall be repealed.

 

Article (11)

This Decree shall come into force on the date of its issue and shall be published in the Legal Register.
