amending Decree No. (98) of 1375 FDP (2007 AD)

on controls and mechanisms regulating work and residence in the Great Jamahiriya

The General People’s Committee,

Upon review of:

  • Law No. (1) of 1375 FDP on the rules of procedure of the People’s Congresses and the People’s Committees, and the implementing regulations thereof;
  • Law No. (58) of 1970 AD on work and the regulations issued pursuant thereto;
  • Law No. (13) of 1980 AD on social security, amendments thereto, and the regulations issued pursuant thereto;
  • Law No. (6) of 1987 AD on organising the entry, residence, and exit of foreigners in Libya and the implementing regulations thereof;
  • Law No. (11) of 1372 AD on income taxes;
  • Law No. (12) of 1372 FBP on the stamp tax;
  • General People’s Committee Decree No. (98) of 1375 FDP on controls and mechanisms regulating work and residence in the Great Jamahiriya and approving certain other provisions;
  • The submission of the Secretary of the General People’s Committee for Education in Letter No. (2504) dated 15/7/1375 FDP;
  • The decrees issued by the General People’s Committee in its thirteenth ordinary meeting of 1375 FDP;

has decreed:

Article (1)

Article (14) of the aforementioned General People’s Committee No. (98) of 1375 FDP shall be amended to read as follows:

Article (14)

Without prejudice to the provisions of the contracts signed and until the end of their term, health and education services for all non-Libyan workers shall be limited to private and non-governmental health and educational institutions and facilities for the consideration set for such, with the exception of educational and health services for those contracting with public bodies funded directly by the general budget, provided their work contract includes such.

Regions where there are no private educational institutions may register non-Libyans to study at public institutions for financial compensation in the amount of eight hundred Libyan dinars (LYD 800) per year.

Article (2)

Any provision that conflicts with those of this Decree shall be repealed.

Article (3)

This Decree shall enter into force on the date of its issuance. It shall be implemented by the competent bodies and published in the Procedures Register.
