on travel documents

The General People’s Committee

Upon review of:

  • Law No. (4) of 1985 on travel documents;
  • The proposal of the Secretariat of the General People’s Committee for Justice;

has decreed:

Article (1)

The travel document shall be considered an important document. Its holder may not provide any unauthorized persons with access to the travel document or send it abroad.

Article (2)

The Secretariat of Justice shall bear exclusive responsibility for preparing and printing travel documents in accordance with the specifications and information stipulated in Articles (4), (5), and (6) of this decree.

Article (3)

Travel documents shall be written and the information therein filled out in Arabic. They may be translated to a foreign language in the form of a seal in accordance with the rules of reciprocity.

Article (4)

Travel document specifications shall be as follows:

  1. Regular individual passport:
    1. Rectangular shape, fifteen centimetres long, ten centimetres wide.
    2. Green cover made of plastic with “Libya” inscribed on its outside in gold colour in a curved shape, followed by a drawing of the Hawk of Quraish followed by the word “Passport.”
    3. Number of pages (48) forty-eight pages of a greenish colour, each page contains an inscription, a decorative design, and the following phrases from the Green Book distributed throughout the pages’ corners:
      1. Committees everywhere.
      2. No democracy without people’s congresses.
      3. In necessity lies freedom.
      4. The party system is the abortion of democracy.
    4. In the middle of each page is an oval drawing with the Green Book drawn above it, with its three chapters. The phrase “Power of the People” is written below it, followed by a map of the Arab World, followed by a horseman carrying a rifle. Two white bands are wrapped around the drawing. The phrase “One Arab People” is written on the right, and “One Arab Nation” is written on the left, meeting in a base on which “Libya” is written.
  2. Collective passport:
    1. Rectangular shape, (23.5 cm.) twenty-three and a half centimetres long, (16.5 cm.) sixteen and a half centimetres wide.
    2. Light green cover made of cardboard with “Libya” written on it in black, followed by a drawing of the Hawk of Quraish, followed by the phrase “Collective Passport.”
    3. Number of pages (18) eighteen pages of a greenish colour, each page contains a drawing of the Hawk of Quraish between two white rectangles with “Libya” written in each one.
  3. Temporary travel document:
    All specifications of the regular individual passport apply with the following exceptions:
    1. Dark green cover with the phrase “Temporary Travel Document” written on it instead of the phrase “Passport.”
    2. Number of pages (32) thirty two pages of a dark green colour.
  4. Travel document for Palestinians:
    All specifications of the regular individual passport apply with the following exceptions:
    1. Olive green cover with the phrase “Revolution until victory” inscribed on the top of the outside cover in gold. Below the hawk is a map of Palestine outlined in red, followed by the phrase “Travel Document for the Children of Occupied Palestine” instead of the phrase “Passport,” and the phrase “We are returning” written on the bottom.
    2. Number of page (32) thirty two pages of an olive green colour.

Article (5)

Travel document information shall be as follows:

  1. Regular individual passport:
    1. Information inside cover page
      1. Place and date of issue.
      2. Signature of director of General Department of Passports and Nationality or member of the People’s Committee for Consular Affairs.
    2. Page (1) information
      1. Passport number.
      2. Passport holder name, date and place of birth, occupation, place of residence.
      3. Accompanying children in a chart containing full name, place and date of birth, sex.
    3. Page (2) information
      1. List of countries to which passport holder may travel.
      2. Passport payment voucher.
      3. Signature or fingerprint of passport holder.
    4. Page (3) information
      1. Picture, height, hair colour, eye colour, and distinguishing features of passport holder.
      2. Passport expiration date.
    5. Page (4) information
      1. Renewals.
    6. Page (5) information
      1. Notes.
    7. Pages (6 to 16)
      1. Visas.
    8. Page (47)
      1. No information.
    9. Page (48) and end cover

      1. Picture and signature or fingerprint of the holder.

  3. Travel document for Palestinians

      2. Signature of director of General Department of Passports and Nationality or member of the People’s Committee for Consular Affairs.
    2. Page (1) information
      1. Document number.
      2. Name, date and place of birth, occupation, place of residence, height, hair colour, eye colour, and distinguishing features of document holder.
      3. The accompanying in a chart containing full name, place and date of birth, sex, kinship.
    3. Page (2) information
      1. Declaration of countries to which travel document holder may travel.
      2. Document payment voucher.
      3. Document validity date.
    4. Page (3) information

Article (6)

The General Department of Passports and Nationality shall determine the specifications and information of the hajj travel document, provided that they are approved by the General People’s Committee for Justice.

Article (7)

All required information in the travel document must be filled out. This information may only be settled by virtue of documents issued by a competent body.

Article (8)

Travel document fees shall be as follows:

  1. Issue or attach regular individual passport (10) (ten LYD)
  2. Issue a regular individual passport replacement (30) (thirty LYD)
  3. Renew validity of a regular individual passport (3) (three LYD)
  4. Inclusion in a collective passport (1.50) (one and a half LYD)
  5. Issue a temporary travel document (3) (three LYD)
  6. Issue a temporary travel document replacement (20) (twenty LYD)
  7. Renew validity of a temporary travel document (1.50) (one and a half LYD)
  8. Issue a hajj travel document (2) (two LYD)
  9. Issue a travel document for Palestinians (3) (three LYD)
  10. Renew validity of travel document for Palestinians (1.50) (one and a half LYD)
  11. Request inclusion in a regular individual or collective passport (1) (one LYD) per person
  12. Request modification of information in a passport or document (1) (one LYD)
  13. Request translation of travel document to a foreign language (1) (one LYD)

Article (9)

Citizens shall submit a request for a regular individual passport on the designated form with the following attached:

  1. Four frontal passport photos sized (4 × 6 cm.) certified by the district People’s Committee or employer.
  2. Official certificate specifying his occupation or trade.
  3. Civil registry extracts to indicate place and date of birth and place of residence, or the family document in order for the competent employee to examine and record the required information on the designated form, in accordance with General People’s Committee Decree No. (395) of 1982.
  4. Arab nationality certificate, if unable to provide the family document.

Article (10)

The passport holder shall submit a request to include his wife or children who are below eighteen years of age on the designated form with the documents required for including them attached, as stipulated in Clauses (2), (3), and (4) of Article (9) of this decree.

Article (11)

The period of validity of a regular individual passport may be less than the legally determined period, or for one trip for the purpose of return in the following cases:

  1. If the passport holder is wanted to appear before judicial authorities.
  2. If the passport is issued as a replacement.
  3. If the passport holder no longer has reason to remain abroad.
  4. If the passport was issued on exceptional grounds and expires during a specific period, or if it was issued for the purpose of performing a task or specific job.

Article (12)

The validity period of a regular individual passport issued abroad by a Brotherhood Bureau, People’s Bureau, or bodies that protect Libyan interests, shall be two years. It may be renewed for the same duration three times.

Article (13)

A new passport may be issued before the expiration of the previous passport if its pages run out before the expiration date.

Article (14)

A collective passport shall be issued for athletic, technical, scout and student teams, as well as for members of education or training envoys under the supervision of one body or for a collective mission. The number of people included in one passport shall not be below five and not exceed fifty. Each person shall submit the required documents for issuing a regular individual passport.

A collective passport must include the full name, frontal passport photo, place and date of birth of each person included therein, as well as the countries to which he is permitted to travel.

Article (15)

A temporary Libyan travel document may be issued for the following categories:

  1. Citizens who are unable to obtain a passport or those who have lost it that need to obtain a travel document due to compelling circumstances.
  2. Anyone included in a collective passport that has failed to return, and thus only for the purpose of return.
  3. Refugees who are recognized as such.
  4. Stateless persons or persons without a fixed nationality.
  5. Anyone unable to obtain travel documents from the states to which they belong for political reasons.
  6. Returnees who can prove their Libyan origin that failed to acquire certificates proving their Arab nationality.
  7. Wives and children below eighteen years of age of the categories mentioned in Clauses (4), (5), (6), (7) provided that they meet one of the descriptions required by these categories to obtain the document.

Issuing temporary Libyan travel documents for the categories mentioned in Clauses (3), (4), and (5) requires the approval of the competent public authorities responsible for these categories.

If the categories specified in Clauses (3), (4), and (5) and their wives and children who are below eighteen years of age desire to permanently depart Libya, they may be granted temporary travel documents valid for a period of three months and for the sole purpose of travel.

Article (16)

Citizens shall submit requests for the hajj travel document on the designated form with the following attachments:

  1. Four frontal passport photos sized (4 × 6 cm.) certified by the District People’s Committee or by the employer.
  2. Employer’s approval of travel for the purpose of hajj.
  3. Excerpts from the civil registrar to declare place and date of birth and place of residence, or the family document in order for the competent employee to examine and record the said information on the designated form, in accordance with General People’s Committee Decree No. (395) of 1982.
  4. Arab nationality certificate if unable to provide the family document.

A hajj travel document may not be granted to females who are under fifty years of age, unless they are accompanied by their husbands or a mahram.

Article (17)

Requests for the travel document for Palestinians shall be submitted on the designated form with the following attachments:

  1. Four frontal passport photos sized (4 × 6 cm.) certified by the official Palestinian Organization office in Libya.*
  2. A certificate from the aforementioned organization proving Palestinian origin.
  3. Certificate declaring date and place of birth.
  4. Certificate of residency in Libya, or permission from the General People’s Committee for Justice to grant this document.

To obtain the travel document for Palestinians, the applicant must not hold the nationality of any specific country, and must not hold a travel document issued by any other state.

Children who are below eighteen years of age as well as the wife may be included, provided that she meets the conditions required for her husband.

Article (18)

The full name and title of the travel document applicant shall be written on the back of photos attached to the request certified by the Secretary of the District People’s Committee for the locality or the authority’s official and shall be stamped by that body, according to the case.

Article (19)

The travel document holder shall be exempt from submitting new documents when requesting a new travel document to be issued or an existing one renewed, if the information found within the document he holds has not changed.

Article (20)

The travel document may not be granted or renewed by the issuing body until the application’s submission receipt has been produced, the recipient’s identity is confirmed, his signature is taken upon receipt, and it has been confirmed that the payable fees have been collected.

Article (21)

No issuing body is permitted to issue a first-time travel document without the approval of the General Department of Passports and Nationality.

Article (22)

The General Department of Passports and Nationality must prepare an guide for tallying the various travel documents issued. It shall contain the date and place of issue, validity period, and the full name, mother’s name, nationality, date and place of birth, sex, and residency of each document holder.

Issuing bodies must inform the General Department of Passports and Nationality of all necessary information to be included in the guide.

Article (23)

The person concerned must immediately report the loss of a travel document to the nearest police, public security, or passport authority, or People’s Bureau or their equivalents. These bodies must notify the General Department of Passports and Nationality of this within 48 hours of the time of the initial notification.

The report and notification must include the following:

(Full name, title, date and place of birth, mother’s name of the travel document holder, and the number, type, place and date of issue, and place and date of loss of the lost travel document.)

Article (24)

No replacement travel document may be issued before one year of notifying the General Department of Passports and Nationality, with the exception of the following categories:

  1. Members of official delegations.
  2. Persons assigned to work abroad.
  3. Students abroad.
  4. Persons traveling for medical treatment abroad and their companions.
  5. Citizens residing abroad that are registered in the consular records in the countries in which they reside.

Article (25)

The numbers of documents issued to each person must be consistent. The number of the last issued valid travel document shall be considered his main number, and all entries in previous files shall be collected in the file of the last travel document.

Article (26)

If a new travel document is issued for its applicant after the expiration of the previous travel document, the new number shall be given to the document distinguished by the letter “b” above the main number separated by a horizontal divider.

Article (27)

The number, date, issuing body, and reason for cancellation of the previous document shall be included in the notes page of the new travel document.

The cancelled document may be given to its owner after the removal of its corners.

Article (28)

An applicant may be refused to have a travel document issued or a travel document holder may be refused to have it renewed in the following cases:

  1. If he has a criminal record related to international crime such as smuggling or drug trafficking.
  2. If evidence is made available indicating that he will use the travel document to harm the security or well-being of Libya domestically or abroad.
  3. If his inability to preserve the travel document is proven.
  4. If his excessive unexcused traveling has led to the neglect of his family, negligence of his duties, or offense to either his or his country’s reputation.
  5. If he has exercised any act against the authority of the people or Libyan politics.*
  6. If he remains outside of Libya without excuse despite being warned to return.
  7. If he loses his Arab nationality.

A travel document may be revoked in any of the cases stipulated in the previous clauses.

In all cases, the revocation or refusal to issue or renew shall be by virtue of a justified decision issued by the director of the General Department of Passports and Nationality certified by the Secretary of the General People’s Committee for Justice.

Article (29)

If a People’s Bureau, Brotherhood Bureau, or one of their equivalents undertakes the deportation of a citizen at the expense of the people, the body shall temporary revoke the deportee’s travel document and grant him a free travel document valid solely for his return. The body shall refer the revoked document with a notification to the General Department of Passports and Nationality, clarifying the reasons that led to the deportation and revocation along with a specification of deportation costs in Libyan currency.

Article (30)

On the basis of the Proposal of the director of the General Department of Passports and Nationality, the General People’s Committee for Justice shall issue organizing decisions for the following matters:

  1. Application forms for obtaining and renewing travel documents, as well as all related additions, inclusions, and amendments.
  2. Determining the bodies that are permitted to request the revocation of a travel document or to refuse to issue or renew one.
  3. Any other organizational matters required for the implementation of provisions of the aforementioned Law No. (4) of 1985 and regulations issued thereunder.

Article (31)

This decree shall enter into force from its date of issuance and shall be published in the Official Gazette.
