Regulations on the work of the committee to prepare the proposal to amend the Constitutional Declaration and the proposed general elections law

Article (1)

A committee to prepare the proposal to amend the Constitutional Declaration and the proposed general elections law (the “Committee”) shall be formed of fifteen members, in accordance with General National Congress Resolution No. (12) of 2014 AD on forming the committee.

The Committee shall select a chairman, vice chairman, and rapporteur.

Article (2)

The Committee shall hold its meetings at its headquarters located in Tripoli and may move to any other location under a resolution from the majority of its members.

Article (3)

The Committee shall seek the assistance of anyone it deems fit, in accordance with Resolution forming the Committee.

Article (4)

The Committee’s sessions shall be held with the attendance of an absolute majority of its members, and its resolutions on the proposal to amend the Constitutional Declaration and the proposed general elections law shall be passed by consensus. If a consensus is not reached, the discussion shall be postponed until the following session, then resubmitted to the Committee. If no consensus is reached, the resolution shall be passed by a two-thirds majority of the members.

Committee resolutions of a procedural nature shall be adopted by a majority of those present.

Article (5)

The Committee may work in groups or subcommittees to complete its duties, provided their activities are presented and discussed in the general meeting.

Article (6)

The members shall attend on the set dates and shall only be absent in cases of necessity. The Committee chairman shall be notified a sufficient time prior to the meeting and such shall be included in the minutes of the following session.

Article (7)

Committee membership shall be voluntary, and members shall not receive any benefits, wages, or remuneration of any kind.

Article (8)

The Committee shall have an open-door policy based on transparency, and a day shall be set to receive proposals, in accordance with a specific organisational mechanism.

Article (9)

The Committee shall select a member to be its official spokesperson.

Article (10)

The Committee rapporteur shall, in coordination with the chairman, prepare an agenda for each meeting, which shall be signed by the members a sufficient time prior to the meeting.

Article (11)

The Committee’s sessions shall be documented under the supervision of the Committee rapporteur. The minutes shall be distributed to the members prior to the following session and approved or observations made with regard thereto and certified by both the Committee chairman and rapporteur.

The rapporteur shall supervise the preservation thereof and they shall be deemed preparatory activities for the draft laws issued by the Committee.

If the Committee is divided into groups or subcommittees, the rapporteur of each group shall perform the documentation process, and copies thereof shall be forwarded to the rapporteur one by one, who shall supervise their distribution to all Committee members upon receipt, and such shall be deemed equivalent to corresponding with the chairman.

Upon completion of the Committee’s work, the Committee’s documents shall be forwarded to the General National Congress.

Article (12)

The Regulations shall be issued by a two-thirds majority of the Committee members, and a copy thereof shall be forwarded to the General National Congress president’s office for publication in the Official Gazette.
