authorising the Cabinet to use the cash surplus

of the budget for 2012 AD and preceding years

The General National Congress,

Upon review of:

  • The Constitutional Declaration issued on 03 August 2011 AD and amendments thereto;
  • The rules of procedure of the General National Congress;
  • The Law of the Financial System of the State, and the budget, accounts, and stores regulations;
  • Law No. (7) of 2013 AD on approving the general budget for 2013 and amendments thereto;
  • The conclusions of the General National Congress in its one hundred forty-eighth general meeting held on Tuesday, 7 Safar 1435 AH, corresponding to 10 December 2013 AD;

issued the following Resolution:

Article (1)

The Cabinet shall be authorised to use the cash surplus from 2012 AD and the preceding years, with a total value of six billion, four hundred forty million Libyan dinars (LYD 6,440,000,000) only, to meet liquidity shortages of eight billion, four hundred forty million Libyan dinars (LYD 8,440,000,000) only, based on the schedule below, provided the difference in projected revenue is addressed in November and December 2013 AD.

Article (2)

The Ministry of Finance shall not transfer third and fourth quarter liquidity from Part (2) allocations to any ministry or administrative unit until all data, information, and disbursal balances for such unit are completed up to 30 September 2013 AD by the concerned administrative unit or ministry.

Article (3)

This Resolution shall enter into force on the date of its issue and all provisions conflicting herewith shall be repealed. This Resolution shall be published in the Official Gazette.
