Decree No. (388) of 2011 on the establishment of the interim Supreme Security Committee and the determination of its competence and organizational structure

on the establishment of the interim Supreme Security Committee and the determination of its competence and organisational structure

The Minister of Interior
:

Upon review of:

  • The Victory Statement of the 17 February Revolution issued on 22 February 2011;
  • The declaration establishing the Interim National Transitional Council issued on 2 March 2011;
  • Law No. (10) of 1992 on security and police;
  • The bylaws of the Interim National Transitional Council and the determination of its competences issued on 12 March 2011;
  • Interim National Transitional Council Resolution No. (184) of 2011 on adopting the transitional government;
  • Interim National Transitional Council Resolution No. (142) of 2011 on amending National Transitional Council Resolution No. (140) of 2011;
  • National Transitional Council Resolution No. (191) of 2011 on the dissolution of the Supreme Security Committee;
  • And the requirements of the national interest;

has decided:

Article (1)

An interim Supreme Security Committee shall be established and a chairman and deputy chairman shall be assigned to head it. They shall be appointed by virtue of a decision from the Minister of Interior. The spatial jurisdiction of the Committee’s branches shall comprise all territories of the Libyan State.

Article (2)

The interim Supreme Security Committee shall be entrusted with the following:

  1. Implement security plans and programs and the decisions and instructions of the Minister of Interior.
  2. Secure and protect utilities and facilities assigned to it by the Minister of Interior by taking the necessary measures and procedures to ensure this.
  3. Take the necessary investigative measures and collect evidence on issues related to the 17 February Revolution.
  4. Contribute to the implementation of security plans in which it is assigned to participate.
  5. Investigate and collect evidence from the agents of the former regime and on the topics threatening the security of the 17 February Revolution.
  6. Provide the necessary security support as assigned by the Minister of Interior.
  7. Propose practical and scientific programs related to preventing and combating crime and take the necessary security measures in this regard.
  8. Work on increasing security awareness among community members and urge them to contribute to security.
  9. Propose programs to train the committee staff to increase their competence and performance level.

Article (3)

The organisational structure of the interim Supreme Security Committee shall be composed of the following:

First: The Secretary of the Committee, with the following powers:

  1. Organise the interviews for the Committee’s chairman and his deputy.
  2. Receive the correspondence of the Committee’s chairman and his deputy, review them, and collect the information required.
  3. Prepare for meetings chaired or called for by the Committee’s chairman or his deputy, record their minutes, report their findings, and follow up on their implementation in coordination with other departments and branches.
  4. Register and document the decisions, publications, and instructions issued by the Committee’s chairman or his deputy and communicate them to the competent bodies.
  5. Any other work assigned to it by the Committee’s chairman or his deputy.

Second: The Department of Legal Affairs, with the following powers:

  1. Provide legal opinion and advice in matters submitted thereto by the chairman, his deputy, or heads of other departments or branches.
  2. Prepare decisions and publications that fall within the jurisdiction of the chairman and his deputy.
  3. Provide legal opinion in cases filed against the Committee by its employees or others.
  4. Conduct administrative investigation into legal violations by the employees of the Committee and act in the same in accordance with the legislation in force.
  5. Attend the meetings assigned thereto by the Committee’s chairman or his deputy.

Third: Inspection and Follow-up Department, with the following powers:

  1. Carry out inspections on the functioning of the bodies subordinate to the interim Supreme Security Committee.
  2. Prepare reports on the functioning of the bodies mentioned in the preceding paragraph and present them to the Committee’s chairman to decide on them.

Fourth: Media Affairs Office, with the following powers:

  1. Provide media coverage, follow up on security-related events and activities, highlight the importance of the role of the interim Supreme Security Committee in extending security, and preserve national gains.
  2. Publish news and events on the website of the interim Supreme Security Committee.
  3. Cover and follow up on press and social conferences, seminars, and interviews.
  4. Document and archive national events.
  5. Issue explanatory and instructional leaflets and posters to support civil security and peace programs and raise the awareness of security personnel with regards to their responsibilities towards the nation and citizens.
  6. Prepare and comment critically on programs that strengthen citizens’ confidence in the security bodies of the State.
  7. Provide a translation team for several languages and ask for their assistance in carrying out the works of the office.

Fifth: Public Affairs Administration, with the following powers:

  1. Send and receive letters and save files and documents.
  2. Conduct professional affairs.
  3. Maintain attendance and leave records for the Committee employees.
  4. Save templates of signatures and seals related to the work of the Committee.
  5. Carry out printing, copying, scanning, and photocopying works necessary for the Committee.
  6. Carry out public services necessary for the Committee.
  7. Regulate vehicles and their needs and carry out necessary maintenance.
  8. Carry out financial affairs, procurement, and warehouses.
  9. Study the Committee’s needs and work to provide them.

The internal regulation of the Public Affairs Administration shall be as follows:

  1. Administrative Affairs Department, to which the following are subordinate:

– Archives Unit.

– Staff Affairs Unit.

– Public Services Unit.

– Vehicle Affairs Unit.

– Equipment and Supply Unit.

  1. Finance Department, to which the following are subordinate:

– Accounts and Budget Unit.

– Storing Unit.

– Procurement and Warehouses Unit.

– Financial Audit Unit.

Sixth: Department of Information Security, Documentation, and Confidential Affairs, with the following powers:

  1. Collect important and serious information and information that affects state security.
  2. Collect information on the movements of agents of the former regime and anything that constitutes a threat to state security.
  3. Analyse and save the information and present it to the Minister of Interior directly and promptly.
  4. Monitor information security in various public and private institutions and facilities.
  5. Monitor civil society organisations to ensure that they do not use anything that affects state security.
  6. Collect and receive files and documents found in the headquarters of the former state bodies and departments, study and analyse them, and present them to the Minister of Interior directly and promptly.

The internal organisation of the Department of Information and Confidential Affairs shall be as follows:

  1. Information Collection Division.
  2. Confidential Affairs Division.
  3. Information Analysis Division.
  4. Confidential and Electronic Archives Division.
  5. Agents of the Former Regime Monitoring Division.

Seventh: Operations Department, with the following powers:

  1. Maintain security and carry out support operations upon request.
  2. Secure and guard government and vital headquarters assigned to it.
  3. Carry out security coordination with other state agencies on the implementation of security plans, programs, and decisions assigned to the interim Supreme Security Committee.
  4. Receive complaints and reports by jurisdiction and act upon them in accordance with the legislation in force.
  5. Conducts investigations and arrests and collect evidence.
  6. Prepare the police records of criminals and suspects and classify them.
  7. Implement prosecutor and court orders regarding the work and functions of the Committee.
  8. Implement the plans and policies entrusted to the Committee.

The internal organisation of the Operations Department shall be as follows:

  1. Division for Securing Vital Facilities.
  2. Division of Investigation, Arrest, and Evidence Collection.
  3. Patrols Division.
  4. Support Forces constituted in the form of multiple brigades as per the systems in place.

Eighth: Technical Affairs Department, with the following powers:

  1. Carry out the works of the Telecommunications Room.
  2. Carry out technical affairs.
  3. Save files and information related to security and IT.
  4. Make use of civilian and security structures in state institutions and link them to the interim Supreme Security Committee.

The internal organisation of the Operations Department shall be as follows:

  1. Telecommunications Room (the main security operations centre).
  2. Technical Affairs Division.
  3. Telecommunications and IT Security Division.
  4. Division for the Dismantling of Explosives and Improvised Explosive Devices.

Ninth: Branches Affairs Department, with the following powers:

  1. Coordinate between branches on the security situation.
  2. Address all the instructions received from the Committee’s chairman and his deputy to the branches.
  3. Monitor the activity of the branches, and prepare reports on their workflow periodically and constantly.

Tenth: The branches, which shall enjoy the same competences as the interim Supreme Security Committee within their specified spatial jurisdiction. The internal organisation of each branch shall be as follows:

  1. Division of Investigation, Arrest, and Evidence Collection.
  2. Patrols Division.
  3. Security and Protection Division.
  4. Information Division.
  5. Telecommunications Division (Security Operations Room).
  6. Support Forces, constituted in the form of multiple brigades as per the systems in place.

Article (4)

The interim Supreme Security Committee shall directly work under the supervision of the Minister of Interior and it shall submit daily reports on its workflow.

Article (5)

The interim Supreme Security Committee shall have its main headquarters in the city of Tripoli. Branches may be established in various regions. A decree regarding the branches shall be issued by the Minister of Interior upon the proposal of the Committee’s chairman.

Article (6)

This decree shall enter into force from its date of issuance and any contrary provision shall be repealed.
