on establishing the Statistics and Census Authority

The Cabinet,

Upon review of:

  • The Constitutional Declaration;
  • The Law of the Financial System of the State, and the budget, accounts, and stores regulations and amendments thereto;
  • Law No. (13) of 2000 AD on planning and the implementing regulations thereof;
  • Law No. (12) of 2010 AD on issuing the Labour Relations Law and the implementing regulations thereof;
  • National Transitional Council Decree No. (174) of 2011 AD on determining the structure of the transitional government;
  • National Transitional Council Decree No. (184) of 2011 AD on approving the transitional government;
  • Cabinet Decree No. (1) of 2012 AD specifying the competencies of deputy and assistant deputy ministers;
  • Cabinet Decree No. (137) of 2012 AD approving the organisational structure and competencies of the Ministry of Planning and organising its administrative unit;
  • (Former) General People’s Committee Decree No. (282) of 2006 AD reorganising the General Authority for Information;
  • The submission of the Minister of Planning in Letter No. (106) dated 30/01/2012 AD;
  • The decrees of the Cabinet in its fifth ordinary meeting of 2012 AD;

has decreed:

Article (1)

Pursuant to this Decree, an authority called the Statistics and Census Authority shall be established, which shall be a legal entity with financial autonomy affiliated to the Ministry of Planning.

Article (2)

The Authority’s headquarters shall be in the city of Tripoli. The Authority may establish branches in other cities pursuant to a resolution of the Authority’s administrative board, in accordance with work requirements.

Article (3)

The Authority shall be responsible for collecting, sorting, and categorising national statistics related to various social and economic activities, and shall do such by conducting general censuses, comprehensive surveys, and sample surveys during specific time periods, using the statistical methods in place internationally. The Authority shall monitor and assess censuses and surveys, and analyse the options and alternatives available based on thorough knowledge of the facts, by providing comprehensive and accurate statistical information, where the Authority shall be entrusted with the competencies related to statistics and census performed by the General Authority for Information and Documentation. The Authority may undertake the following in particular:

  1. Collect, process, analyse, and publish statistical information on the State, in coordination with the related bodies.
  2. Conduct population censuses and demographic, social, economic, and environmental surveys, and collect statistics from various administrative records.
  3. Actively participate in building and developing various administrative records to meet statistic work requirements.
  4. Provide public bodies, economic institutions, international organisations, the media, and researchers with statistical data related to the various fields.
  5. Supervise the statistics activities performed by the competent statistics offices in all ministries, institutions, and companies in which the government is a shareholder, and coordinate among their statistics activities, to provide the statistics and data necessary for the Authority’s work.
  6. Propose the strategic plan for statistics work in the State, in coordination with the concerned bodies.
  7. Apply international standards in all fields of statistics work.
  8. Consolidate the standards used in statistics work in the State, as well as their definitions, products, and classification, in coordination with the related bodies.
  9. Represent the State in statistical matters at the national, regional, and international level, in coordination with the concerned bodies in the State.
  10. Propose concluding international cooperation agreements to improve the State’s national statistics system, in accordance with the legislation in force and in coordination with the competent bodies.
  11. Perform the duties assigned to the Authority by the government, in line with the statistical process and the legislation in force.
  12. Collect statistics from their primary and field sources through surveys and censuses or through the reports of governmental and non-governmental bodies and institutions, and examine and process them clerically or electronically, to reach a statistical presentation of the facts for all fields included in the statistical system.
  13. Develop techniques for collecting and publishing data, adopting appropriate and up-to-date methods.
  14. Perform annual surveys covering all different aspects. The Authority may also perform price surveys and non-annual surveys at regular intervals.

Article (4)

The Authority shall be managed by an administrative board consisting of a chairman and four members. Such board shall be formed pursuant to a decree from the Cabinet, based on a submission from the Minister of Planning.

Article (5)

The Authority’s administrative board shall hold competence to perform the following:

  1. Establish policies on the Authority’s work and work to have them approved.
  2. Establish the branches or offices necessary for the Authority’s work.
  3. Approve the Authority’s draft budget and balance sheet and refer it to the Ministry of Planning for approval.
  4. Propose the financial, administrative, and technical regulations and systems governing the Authority’s work, and refer them to the Minister of Planning to adopt the necessary measures for their approval by the Cabinet, in accordance with the legislation in force.
  5. Exercise other competencies assigned thereto in the legislation in force.

Article (6)

The Authority’s administrative board shall hold competence to perform the following:

  1. Monitor the Authority’s daily work.
  2. Issue decisions and procedures related to employee affairs, in accordance with the legislation in force.
  3. Adopt administrative and financial procedures in accordance with the legislation in force.
  4. Approve the administrative board’s resolutions and adopt the necessary measures for the implementation thereof.
  5. Represent the Authority in its relations with third parties and before the judiciary.

Article (7)

The administrative board shall draft the regulations setting out the board’s work method, the manner in which its meetings are held, and those who have the right to attend such meetings.

Article (8)

The Authority’s resources shall consist of:

  1. Amounts allocated thereto in the State’s general budget.
  2. Any other revenue stipulated by law.

Article (9)

The Authority’s financial year shall commence with the start of the State’s fiscal year and end at the end thereof. The Authority’s first fiscal year shall commence from the date this Decree enters into force and end at the end of the following fiscal year.

Article (10)

The assets of the General Authority for Information related to statistics shall be transferred to the authority established under this Decree, along with the employees thereof in statistics under the same employment terms.

Article (11)

One or more committees shall be formed pursuant to a decree issued by the Minister of Planning to implement this Decree.

Article (12)

The Authority’s organisational structure shall be issued pursuant to a decree from the Cabinet, based on a proposal from the Minister of Planning, and the internal regulation shall be issued pursuant to a decree from the minister.

Article (13)

This Decree shall enter into force on the date of its issue. The concerned bodies shall implement this Decree and it shall be published in the Official Gazette.
