The General People’s Committee

Decree No. (626) of 1988 AD on the Rules of Procedure of the Committee

 

Upon review of:

The Declaration on the Establishment of the Authority of the People; and

● The General People’s Congress Resolution on Establishing the General People’s Committee, and

● Based on the submission of the People’s Committee formed of some Secretaries; and

● The approval provided by the General People’s Committee in its nineteenth ordinary meeting in 1988 AD,

 

The General People’s Committee has decreed the following:

 

Article (1)

The General People’s Committee shall hold its ordinary meetings at least once a week to discuss issues within its competencies and make the necessary decisions and recommendations in their regard. Ordinary meetings shall be held at the Committee’s headquarters in Sirte.

 

Article (2)

The Secretary of the General People’s Committee shall determine the weekday and time of the Committee’s meetings. The General People’s Committee shall be deemed invited to attend the weekly meeting regularly on the day and time determined by the Secretary.

The Secretary of the Committee, if needed, may reschedule the meeting of the General People’s Committee to a different place and time. In such a case, the Office of the People’s Committees Affairs shall give a sufficient notice to that effect to the secretaries before the date of the meeting.

 

Article (3)

The secretaries shall attend the meetings of the General People’s Committee. If a secretary intends to be absent from a meeting for any reason whatsoever, he shall give a sufficient notice to that effect to the Secretary of the General People’s Committee before the date of the meeting.

No secretary shall leave the city of the headquarters of the Secretariat thereof unless a notice to that effect is given to the Secretary of the General People’s Committee.

 

Article (4)

The General People’s Committee meeting shall be valid only if attended by at least more than half of the members, including the Secretary of the Committee or, if absent, the replacement thereof.

Decrees shall be made unanimously by the attendees. In case of disagreement, the majority shall prevail. If the issue in question is not resolved this way, it shall be postponed for reconsideration in a future Committee meeting.

 

Article (5)

The Secretary of the General People’s Committee may assign one or more secretaries to participate in conferences, meetings or other local or international activities held inside or outside the Great Socialist People’s Libyan Arab Jamahiriya. In case a secretary travels abroad, takes a leave or fails to perform his duties for any reason, the Committee may temporarily assign his duties to any of the members thereof. The Secretary of the General People’s Committee may assign any member to receive, accompany and bid farewell to guests.

 

Article (6)

Sufficiently ahead of the meeting, the secretaries shall send to the Secretariat of the General People’s Committee the topics and issues that the Committee is competent to consider in the prescribed form. Such form shall be submitted along with the necessary documents and papers to decide upon such topics and issues.

 

Article (7)

The memoranda to be presented to the General People’s Committee must be full and complete from all aspects and shall include a full explanation of the matters raised by the same, the surrounding circumstances, as well as the actions previously taken in their regard. It is important to agree on the memoranda with the stakeholders and point out the stakeholders’ viewpoints before referral to the General People’s Committee. No matter shall be presented to the Committee without the approval of the concerned secretary. Only the matters required by the secretaries shall be presented to the Committee.

 

Article (9)

The Office of the People’s Committees Affairs shall provide the secretaries with the meeting agenda, along with the relevant memoranda, documents and papers enclosed therewith. This shall be done sufficiently ahead of the meeting date.

 

Article (10)

The items on the General People’s Committee’s agenda shall be discussed as per the order established in the agenda. The Secretary of the General People’s Committee may make changes to such an order.

 

Article (11)

The approval to be provided by the General People’s Committee shall be necessary for the validity of procedures, and the functioning of the entities affiliated with the General People’s Committee.

 

Article (12)

The Secretary of the General People’s Committee shall submit monthly reports on the functioning of the public entities and authorities affiliated with the General People’s Committee on a periodic basis.

 

Article (13)

During the meeting, each secretary shall present the matters of their respective secretariat before discussing and deciding upon the same. Before discussion, a secretary may request to withdraw any matter or postpone deciding upon the same.

 

Article (14)

Should the General People’s Committee decide to discuss any matter confidentially, no employee may attend the discussion.

 

Article (15)

The Secretary of the Committee may form one or more committee(s), from among the members thereof or otherwise, to study a specific matter identified in the formation decree. Such a committee shall submit, in a timely manner, to the General People’s Committee a report on the findings of the conducted study.

Upon the Committee’s approval, the Secretary may, in coordination with the concerned secretary, decide upon the matters that should not be submitted, in his opinion, to the General People’s Committee.

 

Article (16)

The Committee may engage any person, as it deems appropriate, to discuss therewith or seek the opinion thereof regarding a matter presented thereto. The Office of the People’s Committees Affairs shall notify such a person to attend at the scheduled time.

 

Article (17)

The Director of the Office of the People’s Committees Affairs shall be responsible for recording the minutes of the meetings of the General People’s Committee. To undertake his duties during a meeting, the Director may engage any person he deems appropriate for such purpose.

 

Article (18)

The Office of the People’s Committees Affairs shall record the meeting proceedings on tapes to be archived in a safe place after transcribing the content thereof in a clear and acceptable manner in a special register.  Meeting minutes shall be executed for each Committee meeting. These minutes shall include:

a. Names of secretaries who were present and absent in the meeting;

b. The matters presented to the General People’s Committee sorted by order of presentation;

c. The main points of discussing each matter;

d. The opinions and observations that the secretaries request to record in the minutes during the meeting; and

e. The text of the decree issued by the Committee.

 

Article (19)

The Office of the People’s Committees Affairs shall prepare the meeting minutes along with a summary of the highlights thereof for approval at the beginning of the next meeting. Secretaries may make comments on the meeting minutes. No comments may be made upon approval of the minutes.

 

Article (20)

The Office of the People’s Committees Affairs shall prepare a summary of the decrees of the General People’s Committee after each meeting and submit the same to the Secretary of the General People’s Committee for approval.

 

Article (21)

The Office of the People’s Committees Affairs shall prepare the final version of the decrees issued by the General People’s Committee and communicate the same to the entities concerned with implementation and the relevant entities upon signature by the Secretary of the Committee.

 

Article (22)

The General People’s Committee decree issued on 11 Rabi Al-Awwal 1392 FDP, corresponding to 18 February 1978 AD, regarding the Rules of Procedure of the General People’s Committee shall be repealed.

 

Article (23)

These Rules shall enter into force as of the date of its issuance and shall be published in the official gazette.
