Decree No. (51) of 1370 FDP (2002 AD)

on the establishment of the Police College

The General People’s Committee,

Upon review of:

· Law No. (1) of 1369 FDP on the People’s Congresses and the People’s Committees, and the implementing regulations thereof;

· Law No. (10) of 1992 AD on security and police;

· General People’s Committee Decree No. (118) of 1426 FBP, on establishing the Police Academy for Security Sciences;

· Secretariat of the People’s Committee Decree No. (65) of 1429 FBP on regulating the administrative unit of the General People’s Committee in its second ordinary meeting of 1369 FDP;

· Based on the submission of the secretary of the General People’s Committee for Justice and Public Security in Letter No. 242 dated 13/12/1370 FDP and Letter No. (929) dated 30/06/1370 FDP;

· The decrees issued by the General People’s Committee Secretariat in its twenty-fifth ordinary meeting of 1370 FDP;

has decreed:

Article (1)

A college called the Police College shall be established affiliated to the General People’s Committee for Justice and Public Security. The college shall be located in the city of Tripoli and shall be overseen by the General Training Department, and shall train and graduate police officers holding technical and academic competence in the field of security and policing.

Article (2)

The college shall have a director who manages the affairs and oversees the operation of the college in accordance with this Law. The director shall exercise the competencies of the head of an agency.

The college shall have a board that oversees its educational affairs called the Police College Board. This board shall be formed pursuant to a decree from the secretary of the General People’s Committee for Justice and Public Security.

Article (3)

The College Board shall hold competence to examine the following matters:

1. Distribution of study courses over the period of study at the College, determine the hours and credits allocated to each course and the required subjects of study at the college.

2. Propose the College’s organizational structure and the credentials and expertise required of members of the College faculty.

3. Nominate members of the college faculty, whether through appointment or assignment. The remuneration granted to assigned individuals shall be specified pursuant to a decree from the secretary of the General People’s Committee for Justice and Public Security.

4. Provide an opinion on the College’s draft internal regulation and propose any amendments it deems fit to the College’s regulations or bylaws.

5. All other matters that the General People’s Committee for Justice and Public Security or the secretary thereof deems fit to submit thereto.

Article (4)

The Police College Board shall meet when called to convene by the chairman, or by a written request submitted by the College director or three Board members to the Board chairman, provided that the Board meets at least twice during the academic year.

Article (5)

Board resolutions shall be valid only when a simple majority of its members are in attendance. Resolutions shall be issued by a majority of those present. In the event of a tie, the chairman shall have the casting vote. Board deliberations shall be confidential and Board resolutions shall be substantiated and shall come into force after approved by the secretary of the General People’s Committee for Justice and Public Security.

Article (6)

Students wishing to enrol must meet the following criteria:

1. Hold a general secondary diploma, or equivalent.

2. Be of good character and conduct, and not previously convicted of a felony or misdemeanour crime of moral turpitude, unless rehabilitated in both cases.

3. Be between the ages of 18 and 25; exceptions may be made to the upper age limit when required, pursuant to a decree from the secretary of the General People’s Committee for Justice and Public Security.

4. Has not been dismissed from the police force pursuant to a disciplinary decision.

5. Physically fit, as established by the required medical exam.

6. Not married to a foreigner.

Article (7)

A committee shall be formed pursuant to a decree from the secretary of the General People’s Committee for Justice and Public Security to select nominated students for acceptance to the College out of those who meet the enrolment requirements.

The number of students accepted each year at the College shall be determined pursuant to a decree from the General People’s Committee for Justice and Public Security.

Article (8)

A student who is found to be unfit for study for any reason shall be dismissed. The dismissal shall take place pursuant to a decree from the secretary of the General People’s Committee for Justice and Public Security.

Article (9)

Expenses for student education, training, clothing, meals, treatment, shelter, and transportation shall be free, and students shall receive monthly remuneration determined pursuant to a decree from the General People’s Committee for Justice and Public Security.

Article (10)

The study period at the College shall be two years, divided into four study terms, each of which must be no less than four months.

Article (11)

Students shall receive lessons at the College including subjects on security as well as legal, academic, technical, administrative, disciplinary, social, and cultural subjects, and shall also receive sports and military training, as set out in the College’s bylaws.

The bylaws shall state the detailed provisions of the study system as well as its method, testing systems and dates, rules for passing, the disciplinary punishments that may be imposed, and the competent body to undertake such.

Article (12)

The College shall grant to students who pass the final year exam a certificate called the “Police College Diploma” and shall be appointed as lieutenants in the police force in accordance with Law No. (10) of 1992 AD.

Article (13)

If a student drops out of the College or is dismissed from the College for any reason, they must pay all expenses incurred on their behalf during their period of study at the College, including the remuneration they received. A decree from the secretary of the General People’s Committee for Justice and Public Security shall be issued accepting the student’s drop out.

The secretary may exempt the student from returning the aforementioned expenses if he finds the justifications for such convincing.

Article (14)

Any student who is injured or dies due to training or as a result of an accident or injury that occurred during their studies, without such being due to any poor conduct or negligence on their part, shall be treated as a police officer in terms of treatment or other financial rights. The calculation of the amounts due thereto shall commence on the basis of the first salary they would receive, with the assumption that they graduate from the College.

Article (15)

Students studying at the third and fourth levels at the Police College at the defunct Academy of Security Science shall be treated according to the rules and regulations in effect prior to the issuance of this decree.

Article (16)

The College’s internal regulations shall be issued pursuant to a decree from the Secretary of the General People’s Committee for Justice and Public Security and must contain in particular the organization of the sections at the College and specify the method of study, training, and residence.

Article (17)

General People’s Committee for Justice and Public Security Decree No. (118) of 1426 FBP on the Police Academy for Security Sciences shall hereby be repealed, and all provisions contrary to this Law are hereby repealed.

Article (18)

This Law shall come into force on the date of its issue, and shall be published in the Legal Register.
