Decree No. (5) of 2016

on forming the Operations Room for the Military Operations Command

in the Jufra-Sirte region against the Islamic State

The Commander-in-Chief of the Libyan Army,

Upon review of:

• The Constitutional Declaration issued on 3 August 2011 and amendments thereto;

• The Libyan Political Agreement signed on 17 December 2015;

• Military Penal Code No. (37) of 1974 and amendments thereto;

• Law No. (40) of 1974 on military service and amendments thereto;

• Law No. (43) of 1974 on the retirement of members of the military and amendments thereto;

• Law No. (35) of 1977 on the restructuring of the Libyan Army;

• Code of Military Procedure No. (1) of 1999;

• The requirements of public interest and demands of the current period;

has decreed:

Article (1)

An operations room for the Military Leadership Command against the so-called Islamic State in the area of Jufre-Sirte shall be formed affiliated directly to the Commander-in-Chief of the Libyan Army.

Article (2)

All military and quasi-military formations shall be prohibited from conducting any fighting operations within this area without complying with the orders and instructions of the operations room formed pursuant hereto, with the exception of cases of self-defence.

The Room’s command shall be as follows:

Article (4)

This decree shall enter into force on the date of its issuance. Any conflicts with this decree shall be repealed and it shall be implemented by all concerned bodies.
