on organising the Committee on the Land and Maritime Borders

of the Great Jamahiriya

The General People’s Committee

Upon review of:

  • The Law on the Ministry of Foreign Affairs, and the political and consular corps issued by Law No. (39) of 1977;
  • General People’s Congress Resolution No. (8) of 1989 on organising the activity of public agencies, institutions, and companies abroad;
  • Law No. (15) of 1981 on the system of salaries of civil servants in the Great Socialist People’s Libyan Arab Jamahiriya;
  • General People’s Committee Decree No. (325) of 1887 on the organisation of the People’s Bureau for Foreign Liaison;
  • General People’s Committee Decree on the delegation and housing allowance regulation of 20/06/1979 and the amendments thereof;
  • General People’s Committee Decree No. (710) of 1988 on approving certain provisions regarding delegation on official missions;
  • General People’s Committee Decree No. (504) of 1989 on approving the provision of exemption from the provisions of the delegation and housing allowance regulation;
  • General People’s Committee Decree No. (1007) of 1985 on the reorganisation of the committee on borders;
  • General People’s Committee Decree No. (229) of 1986 on the assignment of employees;
  • General People’s Committee Decree No. (500) of 1987 on amending the designation of the continental shelf and attributing certain competences thereto;
  • The proposal of the chairman of the General People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation in his Memorandum No. (323) of 1399 FDP/1989 AD;

has decided:

Article (1)

A committee called the “Committee on the Land and Maritime Borders of the Great Jamahiriya”, hereinafter referred to as the “Committee”, shall be established under the People’s Bureau of Foreign Liaison and International Cooperation. The chairman and members of this Committee shall be appointed by a General People’s Committee decree at the proposal of the chairman of the People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation.

Article (2)

Without prejudice to Article (5) hereof, the Committee established by virtue hereof shall assume all the duties pertaining to the land and maritime borders of the Great Socialist People’s Libyan Arab Jamahiriya, notably any duties associated with existing problems. In particular, it shall:

  1. Collect and keep the documents, maps, studies, reports, and other legal and technical papers pertaining to the borders of the Great Jamahiriya.
  2. Conduct studies and research and prepare reports related to its field of work, and assess related papers and documents.
  3. Participate in border negotiations to which the Great Jamahiriya is party, prepare documents and studies thereon, and propose the proper position in their regard.
  4. Take the preliminary procedures for international prosecution or arbitration of border disputes to which the Great Jamahiriya is party, and prepare the Libyan Arab party and its defence before such entities.

Article (3)

The Committee chairman may employ any person specialised in the Committee’s field of work he deems fit. He may request any domestic entity to provide him with documents, papers, or maps, and he may request attorneys, experts, consultants, and translators from specialised foreign companies abroad to conduct any business related to the Committee’s duties.

Article (4)

The Committee shall periodically submit upon request to the chairman of the People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation a report on its work progress, activities, proposals, recommendations, and the results of its studies, particularly those pertaining to existing problems.

Article (5)

The General People’s Committee may form ad hoc committees or working groups to study a specific border-related issue or duty, in which case the Committee shall provide any documents, papers, maps, reports, studies, and other items in its possession to the ad hoc committee or working group.

The Committee shall only address the issues related to ad hoc committees or working groups if requested by such entities to do so.

Article (6)

The Secretariat of Treasury shall allocate to the Committee a constant advance payment not exceeding LYD 800,000 (eight hundred thousand) to cover the Committee’s expenses.

Part of this amount may be deposited in a special account abroad to be disbursed in the manner prescribed by the chairman of the People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation.

Article (7)

The People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation shall cover the Committee’s administrative expenses and provide it with the necessary offices and administrative employees to carry out its work.

Article (8)

The Committee chairman and members shall earn a fixed monthly remuneration for their work in the Committee, which shall be determined by a resolution by the General People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation.

The Committee chairman may propose fixed monthly remuneration or estimated sums to be paid to non-members who are assigned or employed to carry out any duties related to the work of the Committee. Approval thereof shall be granted by resolutions issued by the General People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation.

Article (9)

The Committee chairman shall perform his duties on a full-time basis. He may decide to assign any member(s) thereof on a full-time basis whenever he deems it necessary.

Article (10)

The Committee shall have an administrative secretariat to carry out bookkeeping and documentation duties.

Article (11)

The People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation shall propose the cases requiring an attorney for the Great Socialist People’s Libyan Arab Jamahiriya in the border issues and cases tried before international courts of justice or arbitration.

In such cases, the attorney of the Great Jamahiriya shall be appointed upon the approval of the General People’s Committee at the proposal of the People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation.

Article (12)

Notwithstanding the delegation and housing allowance regulation issued by a General People’s Committee decree on 20/06/1979 and the General People’s Committee Decree No. (710) of 1988 on approving certain provisions regarding delegation on official missions, delegation on official missions pertaining to the work of the Committee shall be decided by a resolution by its chairman for a duration of ten days at most for each delegation.

Article (13)

People’s agencies, public institutions, and other entities shall provide all the facilities requested by the Committee, including copies of any papers, documents, maps, reports, research, and studies in their possession.

Article (14)

Any documents, papers, reports, and research produced by the Committee shall be confidential. They may only be reviewed by special authorisation by the chairman of the General People’s Committee or by the People’s Committee for the People’s Bureau of Foreign Liaison and International Cooperation.

Article (15)

The aforementioned General People’s Committee Decree No. (1007) of 1985 and Decree No. (500) of 1987 shall be repealed. Any provision that contravenes the provisions hereof shall be repealed.

Article (16)

This decree shall be implemented by the concerned entities. It shall enter into force from its date of issuance and it shall be published in the Official Gazette.
