On the Establishment of the Faculty of Female Police Officers

The General People’s Committee

Upon review of:

• Law No. (1) of 1369 FDP on people’s congresses and people’s committees and the executive regulation thereof;
• Law No. (10) of 1992 AD on the Security and Police Law;
• General People’s Committee Decree No. (118) of 1426 AD [sic] on the establishment of the Police Academy for Security Sciences;
• General People’s Committee Decree No. (65) of 1429 AD [sic] on the organisation of the administrative body of the General People’s Committee for Justice and Public Security;
• The proposal of the General People’s Committee’s during its second ordinary session of 1369 FDP;
• The decision of the secretary general of the General People’s Committee for Justice and Public Security in his letter No. (242) on 14/02/1370 FDP and his letter No. (929) on 30/06/1370 FDP;

has decreed:

Article (1)

An faculty called the “Faculty of Police Female Officers” shall be established and shall be subordinate to the General People’s Committee for Justice and Public Security. It shall be headquartered in Tripoli and supervised by the General Training Directorate. It shall undertake the preparation and graduation of police female officers with technical and practical competence in the security and police field.

Article (2)

The Faculty shall have a director to manage its affairs, supervise the work progress in accordance with the provisions of this Decree, and exercise the powers of the head of the department.

The Faculty shall have a council overseeing education affairs. The council shall be called “Female Police Officers Faculty Council” and it shall be formed by a decree from the general secretary of the General People’s Committee for Justice and Public Security.

Article (3)

The Faculty Council shall be responsible for the following matters:

1. Distribute subjects over the time period of study in the Faculty and determine the hours and grades assigned to each material and the topics to be studied.
2. Propose the organizational structure of the Faculty and the qualification levels and experience necessary in the faculty members.
3. Nominate faculty members, either by appointment or delegation. Remuneration granted to faculty nominated by delegation shall be determined by a Decree from the General People’s Committee for Justice and Public Security.
4. Provide opinion on the draft bylaws for the Faculty and propose amendments it sees fit for the bylaws or the Faculty system.
5. 5. Other issues submitted thereto by the General People’s Committee for Justice and Public Security or its secretary general.

Article (4)

The Female Police Officers Faculty Council shall convene upon invitation from its chairman or by a written request from the Faculty director or three of its members to its chairman. The Council shall convene at least twice throughout the academic year.

Article (5)

The decisions of the Council shall not be valid unless the absolute majority of its members are present. Decisions shall be issued by the majority of those present. In the event of a tie, the side with which the chairman voted shall prevail. The deliberations of the Council shall be confidential and its decisions justifiable. Its decisions shall not be valid until they are approved by the secretary general of the General People’s Committee for Justice and Public Security.

Article (6)

Female applicants to the Faculty shall meet the following conditions:

1. She must have obtained a high school diploma or equivalent;
2. She must be commendable and of a good reputation and shall not have been previously convicted of a felony or misdemeanour involving moral turpitude, unless she has been rehabilitated;
3. She must be no less than 18 years of age and no more than 25. If necessary, it may be possible to exempt the maximum age condition by virtue of a decree by the secretary general of the General People’s Committee for Justice and Public Security;
4. She must not have been dismissed from the police by a disciplinary decision;
5. She must be physically fit and her physical fitness shall be established by the prescribed medical examination;
6. She must not be married to a foreigner.

Article (7)

The secretary general of the General People’s Committee for Justice and Public Security, by virtue of a decree, shall form a committee to select the female candidates to be accepted in the Faculty among the applicants who meet the required conditions to join the Faculty.

The secretary general of the General People’s Committee for Justice and Public Security, by virtue of a decree, shall determine the number of female candidates to be accepted each year in the Faculty.

Article (8)

Any female student who is proven unfit to study in the Faculty for any reason whatsoever shall be dismissed, and the dismissal shall be by virtue of a decree by the secretary general of the General People’s Committee for Justice and Public Security.

Article (9)

The expenses of educating, training, feeding, clothing, sheltering, treating, and transporting the female students shall be free and they shall receive a monthly stipend whose sum shall be determined by virtue of a decree by the secretary general of the General People’s Committee for Justice and Public Security.

Article (10)

The study period in the Faculty shall be two years divided over four terms. Each term shall not be less than four months.

Article (11)

In the Faculty, the female students shall receive studies that include material pertaining to security and legal, practical, technical, administrative, disciplinary, social, and cultural materials, in addition to sport and military training, in accordance with the Faculty bylaws.

The Faculty bylaws shall set forth detailed provisions for the study system and manner, the examination systems and dates thereof, rules for passing, disciplinary sanctions that may be imposed, and the competent authority that may do so.

Article (12)

The Faculty shall grant female students who pass the final year exams a diploma called the “Police Faculty Diploma” and it shall appoint them to the police forces at the rank of lieutenant, in accordance with Law No. (10) of 1992 AD on the Security and Police Law.

Article (13)

In the event a female student leaves the Faculty or is dismissed for any reason, she shall repay all the expenses spent on her during her study period in the Faculty, including the stipends she had received. A decree approving the student’s leaving the Faculty shall be issued by the secretary general of the General People’s Committee for Justice and Public Security.

The secretary may exempt the student from reimbursing the expenses referred to above if he is convinced by her justifications.

Article (14)

Any student who is injured or dies because of the training or as a result of an accident or injury during her study period, provided that this is not the result of her misconduct or neglect, shall be treated as a police officer with regards to medical treatment or other financial rights. Her dues shall be calculated on the basis of the first salary she would have received in the event she had graduated from the Faculty.

Article (15)

The Faculty bylaws shall be issued by virtue of a decree by the secretary general of the General People’s Committee for Justice and Public Security. They shall include in particular the organisation of departments in the Faculty and specifying the manner of study, training, and accommodation.

Article (16)

This Decree shall enter into force from its date of issuance. Any contrary article shall be repealed and it shall be published in the Code of Procedure.
