The Secretary of General People’s Committee for Justice and Public Security

Upon review of:

• Law No. (10) of 1992 and the amending laws thereof;
• General People’s Committee for Justice and Public Security Decree No. (126)/73 AD on the establishment and organisation of the Police Training Institute;
• This Secretariat’s Decree No. (418) of 1424 FBP on the establishment of the Benghazi Police Training Institute issued on 13 Muharram 1404 FDP corresponding to 12 June 1424 FBP;
• The proposal of the General Directorate for Training by virtue of its memorandum;

has decreed:

Chaper (1)

System for Admitting New Recruits

Article (1)

The number of new recruits that are to be admitted into police training institutes from among citizens of the Great Jamahiriya shall be determined in accordance with the needs of the General People’s Committee for Justice and Public Security on the basis of the proposal of the Director of the General Directorate for Training.

Article (2)

The General Directorate for Training shall determine the procedures that must be taken during the submission of applications for enrolment in the institutes, as well as the date and place for submission of the same, which shall be advertised in newspapers and radio and television broadcasts in coordination with the Public Relations and International Cooperation Directorate.

Article (3)

Applications to enrol in the institutes shall be submitted on the basis of the applicant’s region. The applicant shall be subject to the necessary health examination by the competent doctor to determine his physical fitness, which shall be completed on the form designated therefor by the General People’s Committee for Justice and Public Security. The same shall only be accepted after it is approved by the assigned police doctor or regional doctor.

Article (4)

A committee of Institute officers shall be formed to select new recruits applying to join the police from the applicants that meet the conditions stipulated in Article (22) of Law No. (10) of 1992 AD on security and police. Anyone that fails to meet the stipulated conditions may not be admitted. The committees shall be formed by virtue of a decree issued by the Director of the General Directorate for Training.

Article (5)

A file shall be prepared for each new recruit containing the following information:

1. Documents submitted thereby to enrol in the Institute, medical examination results, and an in-person interview.
2. Brief summary of the disciplinary penalties imposed on the recruit during the duration of his time in the Institute.
3. Other documents from medical and other clinics.
4. Documents related to examinations and their results, a declaration of the final grades.

Article (6)

A register shall be created in the Institute for new recruits. Recorded therein shall be the full name of the recruit, his date of birth, place of residence, educational level, guardian’s name, profession, and address.

The register shall include the number of the admission decision issued by the General People’s Committee for Justice and Public Security.

Article (7)

An introductory document shall be created for each class of admitted recruits. It shall include the information stated in the preceding article and a photograph of each recruit affixed to the right side of the document.

Article (8)

A decree shall be issued by the General People’s Committee for Justice and Public Security on the admission of new recruits that have enrolled in the institutes.

Chapter (2)

Admission of Non-Libyan Recruits

Article (9)

The number of new recruits that are to be admitted for study in the institutes from friendly and fellow Arab states shall be specified by the General People’s Committee for Justice and Public Security. The recruits shall be admitted on the basis of a request from their governments or the representatives thereof in the Great Jamahiriya in accordance with availability.

Article (10)

Applicants must meet the academic qualifications and physical fitness conditions and pass the prescribed medical examination. The delegate recruit shall be subject to the regulations in effect in the institutions during the prescribed duration of the course. One or more of the prescribed conditions may be waived.

Article (11)

If a delegate recruit is absent, the General Directorate for Training shall be notified. The latter shall then notify the General People’s Committee for Justice and Public Security, which shall in turn notify the representative of the country that nominated the recruit. If the absence continues for a period of fifteen consecutive days, the recruit shall be considered suspended from the course with the exception of cases of absolute necessity.

Article (12)

The Director of the Institute shall communicate with the General Directorate for Training to complete the procedures for suspending a delegate recruit during the probation period for a duration of 45 days from the date of his enrolment in the course if he violates the regulation in force in the Institute.

Article (13)

Delegate recruits shall not be granted a police ranking after their graduation from the Institute. Likewise, the Great Jamahiriya shall bear no responsibility for him obtaining a position in the General People’s Committee for Justice and Public Security.

Chaper (3)

System for Admission into Courses

Article (14)

Advanced specialised courses and resuscitation courses for non-officer security personnel shall be determined in accordance with the requirements of the yearly training plan for the period specified in the training plan. The opinion of Institute management shall be taken in terms of the designated number for and duration of each course.

Article (15)

Candidates for the course shall be obligated to attend at the specified time and place. They shall arrive with their complete military equipment. The Director of the Institute may decide not to admit anyone that misses the admission date or fails to arrive with his complete equipment.

Article (16)

Course participants of all ranks shall comply with the regulations and rules in force inside the Institute. The disciplinary procedures stipulated in the organising laws for their status shall apply to violators. They shall be subject to the penalties stipulated in Article (27) of this regulation.

Chapter (4)

Duration of Study and Subjects Taught in the Institute

Article (17)

The duration of study in the Institute shall be six months. The Secretary of the General People’s Committee for Justice and Public Security may amend the duration by increasing or decreasing the same in accordance with the requirements of public interest.

Article (18)

Study in the Institute shall be comprised of the following subjects:

First: Legal subjects:

Subjects selected from the Code of Criminal Procedure – subjects selected from the Penal Code – special and complementary laws – border legislation.

Second: Police sciences:

Police management – police duties, operations, and crime prevention methods – national security – civil defence – rescue and first aid – criminal investigation – physical activity and self-defence exercises – military training.

Third: General sciences:

National thought – the Great Green Charter of Human Rights – religious education – information on history and geography.

Fourth: Supplementary courses:

The scientific method – forensics.

Chaper (5)

Examinations

Article (19)

Examinations shall be held in the middle of the course to measure the extent of the recruits’ absorption of their practical and theoretical classes. The date thereof shall be determined by the Director of the Institute.

Article (20)

Final examinations shall be held for each course on the curriculum prescribed therefor. Each teacher shall bear responsibility for preparing the questions in the subject he teaches with the utmost confidentiality. In the event of multiple teachers responsible for a single subject, the questions shall be placed in a closed envelope for the Director of the Institute, who shall specify the date of the examination and form special committees therefor composed of officers affiliated with the Institute after consulting the Director of the General Directorate for Training.

Article (21)

If a recruit is unable to take the prescribed examination in the course for justifiable reasons accepted by the Director of the Institute, he shall be given a special examination within a period of no more than two weeks from the completion of examinations. In all cases, participation in the examination shall necessitate the recruit’s attendance of two-thirds of the prescribed course hours and for him to not be considered as having failed the course.

Article (22)

Passing grades shall be as follows:

85% and above of the total score for the grade of excellent.

75% and above of the total score for the grade of very good.

65% and above of the total score for the grade of good.

55% and above of the total score for the grade of acceptable.

Article (23)

1. The recruit shall be allowed to retake an examination for no more than three subjects. The test shall be given to the same on a date determined by the Director of the Institute within one month of the completion of the course.
2. The recruit shall be considered to have failed and shall have to repeat the term if he fails four or more subjects.
3. In the event of a recruit’s failure in the second term, he shall be suspended from the course and released.
4. If a recruit is caught cheating during the examination in any way, the answer paper shall be taken therefrom. He shall be granted a grade of 0 in the subject. If he repeats the same method again, he shall be banned from taking the examination. The same provision shall apply to any recruit that helps another person cheat.

Article (24)

Answer papers shall be corrected by a committee of Institute officers assigned by the Director. The Director of the Institute shall approve test results, which shall be ratified by the Director of the General Directorate for Training.

Article (25)

Seniority on the level of the graduating class shall be determined on the basis of the order of success in the prescribed subjects.

Chapter (6)

Disciplinary Penalties

Article (26)

All course participants, whether new recruits or other, shall appear in appropriate attire out of respect for the entity to which they belong. They shall be prohibited from committing actions that are unethical or that violate public morality and prejudice military discipline inside and outside of the Institute.

Article (27)

The disciplinary penalties that may be imposed on students in the Institute shall be as follows:

First: Warning.

Bringing the student’s attention to not repeating a trivial offense he committed after a brief trial and on one occasion during the course.

Second: Additional education.

Student shall undertake the military education prescribed in the curriculum with all of his military equipment at 45 minutes per hour, which may not be implemented for more than one hour per day.

Third: Shaving off all hair.

Fully shaving the student’s hair down to zero. This penalty may only be imposed one time per month.

Fourth: Deprivation of leave.

Denying the student permission to leave on Thursday and Friday and during official holidays, and keeping him in his military attire inside the Institute. He may be commissioned for any daily work. The duration of the deprivation of leave shall not exceed four weeks per penalty. Each vacation day shall represent one week.

Fifth: Deprivation of rank.

Deprivation of the student’s temporary rank. The same may not be returned thereto.

Sixth: Confinement to the room.

This shall be done for a maximum period of two weeks and the student shall continue to attend lectures and military training.

Seven: Suspension from course.

In the event that the student commits a felony or misdemeanour of moral turpitude, fails to attend his classes for a period of more than fifteen days without a reasonable excuse, or commits other actions that lead the Director of the Institute to think that the perpetrator is not fit to continue in the course. The General Directorate for Training shall be notified of the suspension decision.

Article (28)

1. The Director of the Institute may inflict all the penalties stipulated in the preceding article. The articles shall be considered in force immediately after they are signed, with the exception of the suspension penalty, which shall be considered in force after being approved by the Secretary of the General People’s Committee for Justice and Public Security.
2. Other Institute officers may inflict the disciplinary penalties in Paragraphs (1), (2), (3), and (4) and confinement to the room for no more than three days. In all cases, the penalties shall be presented to the Director of the Institute for approval.

Article (29)

The behaviour grade for recruits subject to disciplinary penalties shall incur the following deductions:

1. Warning: two points.
2. Additional education: one point for each hour.
3. Shaving off all hair: two points for each act of shaving.
4. Denial of permission: one point for each day.
5. Detainment in the room: one point for each day.
6. Removal of ranking: five points.

Article (30)

The grade for the trainee’s behaviour shall be determined out of 50 points. If the trainee loses more than 20 points, he shall be considered to have failed the course.

Chapter (7)

Discipline and Order

Article (31)

Recruits shall not be permitted to exit the Institute after enrolling in the course before the completion of four weeks from the date of their enrolment.

Article (32)

Administrative hierarchy shall be followed when meeting with officers inside the Institute, from the lowest to the highest levels in the platoon.

Article (33)

A weekly inspection shall be conducted every Thursday to assess personal hygiene, uniform, weapons, equipment, and duties.

Article (34)

Clinic papers may only be granted by the commander of the training wing in the Institute. The Director of the Institute shall be notified thereof.

Article (35)

The Director of the Institute may grant an emergency leave to recruits during the course, the duration of which shall not exceed one week. Leave shall be granted in cases of absolute necessity such as the death of a parent or a sibling, or to give testimony in court.

Article (36)

After the completion of the first four weeks, students shall be permitted to exit the Institute during weekly, official and religious holidays. They shall all return on the evening of the same holiday at the time specified by the Director of the Institute, unless otherwise prescribed for serious reasons.

Students shall only be permitted to sleep outside of the Institute or leave the city in which the same is located after obtaining written permission from Institute management.

Article (37)

Convalescence shall be spent inside the Institute in a designated place in the clinic whenever possible.

Article (38)

If it is prescribed that a student be kept in the hospital for treatment, Institute management shall notify his guardian or one of his relatives as well as the entity that recruited him and the General Directorate for Training.

The clinic officer shall visit him in the hospital and submit a report on his health condition.

The student shall abstain from any action that exposes him to legal accountability during his stay in the hospital.

When the student leaves the hospital, he shall notify Institute management accordingly.

Article (39)

Recruits may be visited in the Institute during the period of the initial four weeks as follows:

1. Every Thursday from 16:00 until 18:00.
2. Every Friday from 11:00 until 18:00.
3. The visit shall be under the supervision of the Institute’s guard officer or guard sergeant and in the designated place therefor.
4. Women may only be visited by guardians. The entry of cars and food into the Institute shall be prohibited.
5. Recruits shall be prohibited from accompanying visitors outside of the visiting area or to any place inside the Institute.

Chapter (8)

Uniform

Article (40)

Student uniform shall be as follows:

1. Work suit, belt, “broad” long shoes, socks, shirt, tie, and round cap during training and while attending theoretical classes. The student shall have two suits for courses that last for more than three months.
2. Work suit, waist belt, half light shoes, and a hat outside of training hours and during weekly holidays.
3. Prescribed athletic clothing during the summer and winter.
4. Recruits shall receive their official prescribed military duties a sufficient amount of time before their graduation.
5. Wearing civilian clothing inside the Institute shall be prohibited, with the exception of cooks and nurses.

Chapter (9)

General Provisions

Article (41)

Duties and competencies shall be in accordance with Decree No. (126) of 1973 on the establishment of the Benghazi Police Training Institute.

Article (42)

Instructions shall be issued by the Director of the General Directorate for Training to specify daily time during regular days and holidays, as well as during the month of Ramadan.

Article (43)

During each course convened in the Institute, a number of recruits shall be granted a temporary ranking that enables them to supervise their classmates by virtue of a command from the Director of the Institute, as follows:

1. Rank of Staff Sergeant for each course.
2. Rank of Sergeant for each faction.
3. Rank of Corporal for each section in the platoon.

The selection of these rankings shall observe moral, disciplinary, practical, and educational level aspects.

Article (44)

The top three students in the prescribed final examination for all courses shall be granted an award that shall act as incentive for the same and for others to improve their discipline and academic attainment.

Article (45)

A graduation ceremony shall be organised in each Institute for each graduating class of new recruits. This shall apply to courses that exceed a period of three months. Officials from the General People’s Committee for Justice and Public Security shall be invited to the ceremony.

Article (46)

A yearly festival shall be organised in the Institute during the month of September that shall include training, cultural, and sports aspects. Awards shall be distributed therein to the winners.

Article (47)

To ensure self-reliance and exercise self-confidence, new students shall be assigned to guard functions, night patrols, notification records, and other duties.

Article (48)

The functions of the restaurant, clinic, barber, store, washing system, and other functions shall be organised by instructions from the Director of the Institute, which shall facilitate the flow of work in the Institute in a way that does not contradict with the provisions of this regulation.

Article (49)

The attached tables shall be adopted as a measure of the nutrition, clothing, and tasks prescribed for each student in the Institute. The student shall be fined for the value of anything that he loses or consumes out of negligence or remissness in accordance with the police regulations in effect.

Article (50)

The competent bodies shall implement this regulation. It shall enter into force from its date of issuance and shall be published in the Gazette.
