Decree No. (906) of 1994 on abolishing remote prosecutions and establishing summary prosecutions

Decree No. (906) of 1423 FBP

on Abolishing Remote Prosecutions and Establishing Summary Prosecutions

 

Secretary of the General People’s Committee for Justice and Public Security,
Upon review of:

  • The Judicial System Law issued by Law No. (51) of 1976

AD;

  • Law No. (18) of 1423 FBP on the Establishment and Organization of People’s Courts

and the Basic People’s Congresses;

  • The General People’s Committee Decree No. (19) of 1993 AD on Organizing 

the Secretariat of the General People’s Committee for Justice and Public Security; and

  • The Secretary of the General People’s Committee for Justice and Public Security Decree No. (905) of

1423 FBP, on Abolishing Remote Courts and Establishing Summary Courts, and

  • Upon consultation with the Chairman of the Judicial Bodies Inspection Management Committee, and
  • Based on the submission of the Undersecretary for Judicial and Legal Affairs,

 

has decreed the following:

 

Article (1)

The following remote prosecutions shall be abolished: 

1. Bir Al-Ghanam remote prosecution; 2. Al-Shaqiqa remote prosecution; 

3. Nasmah remote prosecution; 4. Al Qaryat al Sharqiyah remote prosecution; 

5. Al Qaryat al Gharbiyah remote prosecution; 6. Tabaqah remote prosecution; 

7. Al Shweiref remote prosecution; 8. Kabaw remote prosecution; 

9. Wazzin remote prosecution; 10. Sinawen remote prosecution; 

11. Daraj remote prosecution; 12. Tiji remote prosecution; 

13. Badr remote prosecution; 14. Al Jawsh remote prosecution; 

 15. Bent Baya remote prosecution; 16. Wanzarik remote prosecution;

 

Article (2)

A Summary prosecution to be cited as “Bir Al-Ghanam Summary Prosecution” shall be established within the jurisdiction of Zaweya Plenary Prosecution. The new Summary prosecution shall be headquartered in Bir Al-Ghanam City and have the same jurisdiction assigned to Bir Al-Ghanam Summary Court.

 

Article (3)

Summary prosecutions shall be established within the jurisdiction of Ghrayan Plenary Prosecution. The headquarters and jurisdictions of such prosecutions shall be as follows: 

1. Al-Shaqiqa Summary Prosecution: Having its headquarters in Al-Shaqiqa City, and the same jurisdiction assigned to Al-Shaqiqa Summary Court. 

2. Nasmah Summary Prosecution: Having its headquarters in Nasmah City, and the same jurisdiction assigned to Nasmah Summary Court. 

3. Al Qaryat Summary Prosecution: Having its headquarters in Al Qaryat City, and the same jurisdiction assigned to Al Qaryat Summary Court. 

4. Tabaqah Summary Prosecution: Having its headquarters in Tabaqah City, and the same jurisdiction assigned to Tabaqah Summary Court. 

5. Al Shweiref Summary Prosecution: Having its headquarters in Al Shweiref City, and the same jurisdiction assigned to Al Shweiref Summary Court.

 

Article (4)

Summary prosecutions shall be established within the jurisdiction of Jadu Plenary Prosecution. The headquarters and jurisdictions of such prosecutions shall be as follows: 

1. Kabaw Summary Prosecution: Having its headquarters in Kabaw City, and the same jurisdiction assigned to Kabaw Summary Court. 

2. Wazzin Summary Prosecution: Having its headquarters in Wazzin City, and the same jurisdiction assigned to Wazzin Summary Court. 

3. Sinawen Summary Prosecution: Having its headquarters in Sinawen City, and the same jurisdiction assigned to Sinawen Summary Court. 

4. Daraj Summary Prosecution: Having its headquarters in Daraj City, and the same jurisdiction assigned to Daraj Summary Court. 

5. Tiji Summary Prosecution: Having its headquarters in Tiji City, and the same jurisdiction assigned to Tiji Summary Court.

 

Article (5)

Two summary prosecution shall be established within the jurisdiction of Sabha Plenary Prosecution. The headquarters and jurisdictions of such courts shall be as follows: 

1. Bent Baya Summary Prosecution: Having its headquarters in Bent Baya City, and the same jurisdiction assigned to Bent Baya Summary Court. 

2. Wanzarik Summary Prosecution: Having its headquarters in Wanzarik City, and the same jurisdiction assigned to Wanzarik Summary Court.

 

Article (6)

This Decree shall be published in the official gazette and shall enter into force as of the date of publication.
