Law No. (11) of 2012
adopting some provisions
concerning the powers of command levels in the Libyan Army
The National Transitional Council:
issued the following law:
Article (1)
In the words and expressions in the military laws and legislation in force, usage shall follow the powers ascribed to the terms in this law.
Article (2)
The Libyan Army is a statutory military force composed of officers, non-commissioned officers and privates tasked to defend Libya, protect national unity, not infringe upon the civil constitutional regime, and uphold public order and security when needed.
Article (3)
The Head of State is the supreme commander of the Libyan Army and shall have the following responsibilities:
10. Approve final death sentences issued by military tribunals.
11. Pardon or commute sentences handed down by military tribunals.
12. Reinstate personnel to military service with conditions, based on a proposal from the Chief of the General Staff and the Minister of Defence.
13. Institute military decorations and medals.
14. Summon officers to military service after their departure, halt their referral to retirement, and extend their term of service after they reach the prescribed age for a period not exceeding three years, based on a proposal from the Chief of Staff referred by the Minister of Defence.
15. Approve the cases where nominal periods are added to active service, based on the proposal of the Chief of Staff referred by the Minister of Defence.
16. Delegate some of his powers relating to defence affairs under the law to the Minister of Defence.
Article (4)
The Minister of the Defence is a member of government representing the defence portfolio. He shall have the following responsibilities:
10. Approve measures, structures and prerogatives adopted by the Chief of the General Staff in execution of the general policy of the State.
11. Approve procurement contracts for weapons, ammunition, equipment and installations for the Libyan Army.
12. Assess rates of performance and work progress in the Libyan Army in accordance with reports prepared by military oversight bodies.
13. Conclude regional and international agreements related to security and military cooperation.
14. Approve the adoption the lists of officers retired and submit the same to the Commander-in-Chief to issue decisions in this regard.
15. Grant exceptional bonuses to anyone who performs distinguished services to the nation, based on a proposal from the Chief of the General Staff.
16. Request financial coverage for some urgent matters not listed in defence budget items.
17. Prepare draft laws related to the Libyan Army based on a proposal from the Chief of the General Staff and refer the same to the legislature according to the procedures in place.
18. Notify the Chief of Staff of the political leadership’s vision concerning how to use the Libyan Army to defend Libya and protect its security to take the necessary measures in this regard.
19. Represent the Libyan Army and respond to the questions of competent bodies, including what is published or broadcast in different media outlets.
20. Accept non-Libyan students in military educational institutions based on a proposal from the Chief of the General Staff.
21. Grant military decorations and medals and allow foreigners to wear such based on a submission from the Chief of the General Staff.
22. Approve the continued service of officers who have been passed over for promotion if they so desire, based on a proposal from the Chief of Staff.
23. Determine the powers of area commanders and military forces based on a proposal of the Chief of the General Staff.
24. Approve the secondment of military personnel to countries and local, regional and international civilian bodies, based on the proposal of the Chief of the General Staff.
25. Appoint employees, terminate their service and contract with technicians and foreign civilian technicians in the army on special contracts that set the conditions of their employment and their other rights, based on the proposal of the Chief of Staff.
26. Approve the cases where nominal periods are added to active service, based on the proposal of the Chief of Staff and refer the same to the Minister of Defence.
27. The Minister of Defence may delegate some powers to the Chief of the General Staff, in accordance with the law.
Article (5)
The Chief of the General Staff of the Libyan Army is the highest military rank for an army officer. His direct superior is considered the Minister of Defence. He is directly responsible for the military from the technical side, in terms of organisation, equipment, training, leadership, management and maintaining the combat readiness of the Libyan Army. All staff, branches, bodies, departments and independent units are under his command, and he shall be responsible for the following:
10. Announce the death of missing soldiers and army personnel, establish the status of personnel killed in action, taken prisoner, missing, wounded or disabled from such.
11. Grant a bonus equal to the annual bonus fixed for the soldier’s rank or an incentive award for excellent performance.
12. Reinstate non-commissioned officers and privates to the service.
13. Determine the military bonuses granted to soldiers (technical and professional).
14. Establish the partial and plenary military prosecutions and clarify their administrative boundaries. The swearing of the legal oath by permanent military tribunal presidents and members shall be before the Chief of the General Staff.
15. Determine the powers of periodic courts and organise their procedures and the crimes decided therein.
16. Approve legal memoranda issued by the public body of the judiciary concerning martyrs, martyrs killed in the line of duty and wounded, and settling retirement dues.
17. Determine rank insignia and military uniform.
18. Draft recommendation reports for command and leadership posts and recommendations to grant military decorations, medals, etc.
19. Determine the necessary qualification to promote military personnel.
20. Approve the enrolment of military personnel in institutes, university faculties and academies and participation in delegations to study and training courses abroad.
21. Form medical committees, determine the powers and duties thereof and meeting location. Approve the treatment of military personnel outside Libya if it is established that they cannot be treated locally.
22. Recommend the reinstatement to military service of officers placed on half pay.
23. Promote up to the rank of unit staff sergeant, and terminate the service of non-commissioned officers and privates in accordance with the cases stipulated by law.
24. Halt the referral of non-commissioned officers and privates to retirement and extend their service for a specified period or for one time in accordance with the Military Personnel Retirement Law after they reach the statutory age for retirement.
25. Help form the Crisis and Natural Disasters Department, form committees and name delegates.
26. Form committees to travel abroad on official duties and joint military committees, whether to follow up on aspects of cooperation with countries with whom agreements, memoranda of understanding or military cooperation protocols have been signed, discuss some military matters or take part in international military exhibitions, seminars or conferences.
27. Approve the spending of vacations outside Libya.
28. Award the training bonus granted to members of the training corps at military educational institutions.
29. Determine the financial scholarships for students of military educational institutions.
The Chief of the General Staff may delegate some of his powers to his aide with respect to the heads of the main service branches and the Organisation and Administration Unit.
Article (6)
The Minister of Defence, based on the proposal of the Chief of the General Staff, is responsible for determining the powers of the heads of the service branches (army – navy – air force – air defence) and the heads of other units, branches and forces.
Article (7)
This law shall enter into force from its date of issuance, and it shall be published in the Official Gazette and the various media. Law No. (59) of 1989 concerning the establishment of the General Defence Committee and its organisation shall be repealed, in addition to any provision that contravenes the provision of this law. Each person, within his mandate, shall implement the provisions of this law and notify the transitional government and local councils thereof.

مادة (1)
في ﺍﻷﻟﻔﺎﻅ ﻭﺍﻟﺘﺴﻤﻴﺎﺕ ﺍﻟﻮﺍﺭﺩﺓ في ﺍﻟﻘﻮﺍﻧين ﻭﺍﻟﺘﺸﺮﻳﻌﺎﺕ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺍﻟﻨﺎﻓﺬﺓ ﻳﺘﻌﺎﻣﻞ ﺣﺴﺐ ﺍﻻﺧﺘﺼﺎﺻﺎﺕ المسندﺓ ﻟﻠﻤﺴﻤﻴﺎﺕ ﺍﻟﻮﺍﺭﺩﺓ في ﻫﺬﺍ ﺍﻟﻘﺎﻧﻮﻥ.
مادة (2)
الجيش الليبيﻫﻮ ﻗﻮﺍﺕ ﻋﺴﻜﺮﻳﺔ ﻧﻈﺎﻣﻴﺔ ﺗﺘﺄﻟﻒ ﻣﻦ ﺿﺒﺎﻁ ﻭﺿﺒﺎﻁ ﺻﻒ ﻭﺟﻨـﻮﺩ ﻳﺘﻮلى ﺍﻟﺪﻓﺎﻉ ﻋﻦ ﻟﻴﺒﻴﺎ ﻭالحفاﻅ ﻋﻠﻰ ﺍﻟﻮﺣﺪﺓ ﺍﻟﻮﻃﻨﻴﺔ ﻭﻋﺪﻡ ﺍلمساس ﺑﺎﻟﻨﻈـﺎﻡ المدني ﺍﻟﺪﺳﺘﻮﺭﻱ ﻭﺍلمحاﻓﻈﺔ ﻋﻠﻰ ﺍﻟﻨﻈﺎﻡ ﻭﺍﻷﻣﻦ ﺍﻟﻌﺎﻡ ﻋﻨﺪ الحاﺟﺔ.
مادة (3)
رئيس الدولة هو القائد الأعلى للجيش الليبي ويختص بما يلي:
1- تحديد ﺣﺠﻢ الجيش الليبي ﻭﺗﺸﻜﻴﻠﻪ ﻭﺗﺪﺭﻳﺒﻪ.
2- الموﺍﻓﻘﺔ ﻋﻠﻰ ﺧﻄﻂ ﺍﻟﻌﻤﻠﻴﺎﺕ ﺍلحربية.
3- ﺇﻋﻼﻥ ﺣﺎﻟتي ﺍﻟﻨﻔير ﻭﺍﻟﺘﻌﺒﺌﺔ ﺍﻟﻌﺎﻣﺔ.
4- ﻗﺒﻮﻝ ﻭﺇﻋﻼﻥ ﻭﻗﻒ ﺇﻃﻼﻕ ﺍﻟﻨﺎﺭ.
5- ﺍﺳﺘﺪﻋﺎﺀ ﺍﻻﺣﺘﻴﺎﻁ في الحالات المقررة ﺑﺎﻟﻘﺎﻧﻮﻥ.
6- تعيين ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﻭﻣﻌﺎﻭﻧﻪ ﻭﺇﻋﻔﺎﺅﳘﺎ.
7- ﺇﻧﺸﺎﺀ ﻗﻮﺍﺕ ﺟﺪﻳﺪﺓ ﻭﲢﺪﻳﺪ ﻣﺴﺆﻭﻟﻴات ﻭﺗﺒﻌﻴﺘﻬﺎ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﻭﻋﺮﺽ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
8- ﺗﻌﻴﲔ ﺍﻟﻀﺒﺎﻁ ﻭﻣﻨﺤﻬﻢ ﺍﻟﺘﺮﻗﻴﺎﺕ ﺍﻻﻋﺘﻴﺎﺩﻳﺔ ﻭﺍﻻﺳﺘﺜﻨﺎﺋﻴﺔ ﻭﺍﻟﻘﺪﻡ ﺍﳌﻤﺘﺎﺯ ﻭﺇنهاء ﺧﺪﻣاتهم ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﻣﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﻭﺗﺼﺪﻳﻖ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
9- ﺍﻟﺘﺼﺪﻳﻖ ﻋﻠﻰ ﻗﻮﺍﺋﻢ ﺍﶈﺎﻟﲔ ﺇﱃ ﺍﻟﺘﻘﺎﻋﺪ ﻭﻓﻘﺎﹰ ﻟﻠﺘﻮﺻﻴﺎﺕ ﺍﶈﺎﻟـﺔ ﻣـﻦ ﺭﺋـﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﻭﺍﻋﺘﻤﺎﺩ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
10- ﺍﻟﺘﺼﺪﻳﻖ ﻋﻠﻰ ﺃﺣﻜﺎﻡ ﺍﻹﻋﺪﺍﻡ ﺍﻟﻨﻬﺎﺋﻴﺔ ﺍﻟﺼﺎﺩﺭﺓ ﻣﻦ ﺍﶈﺎﻛﻢ ﺍﻟﻌﺴﻜﺮﻳﺔ.
11- ﺍﻟﻌﻔﻮ ﻋﻦ ﺍﻟﻌﻘﻮﺑﺎﺕ ﺍﶈﻜﻮﻡ بها ﻣﻦ ﺍﶈﺎﻛﻢ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺃﻭ ﲣﻔﻴﻔﻬﺎ.
12- ﺍﻹﻋﺎﺩﺓ ﻟﻠﺨﺪﻣﺔ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺑﻌﺪ ﺗﺮﻛﻬﺎ ﺑﺸﺮﻭﻁ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﻣـﻦ ﺭﺋـﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﻭﻋﺮﺽ ﻣﻦ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
13- ﺇﻧﺸﺎﺀ ﺍﻷﻭﲰﺔ ﻭﺍﻷﻧﻮﺍﻁ ﺍﻟﻌﺴﻜﺮﻳﺔ.
14- ﺍﺳﺘﺪﻋﺎﺀ ﺍﻟﻀﺒﺎﻁ ﻟﻠﺨﺪﻣﺔ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺑﻌﺪ ﺗﺮﻛﻬﺎ ﻭﻭﻗﻒ ﺇﺣﺎﻟﺘﻬﻢ ﺇﱃ ﺍﻟﺘﻘﺎﻋـﺪ ﻭﲤﺪﻳﺪ ﻣﺪﺓ ﺧﺪﻣﺘﻬﻢ ﺑﻌﺪ ﺑﻠﻮﻏﻬﻢ ﺍﻟﺴﻦ ﺍﳌﻘﺮﺭﺓ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﻣـﻦ ﺭﺋـﻴﺲ ﺍﻷﺭﻛﺎﻥ ﻭﻋﺮﺽ ﻣﻦ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ ﻭﳌﺪﺓ ﻻ ﺗﺘﺠﺎﻭﺯ (3) ﺳﻨﻮﺍﺕ.
15- ﺍﻋﺘﻤﺎﺩ ﺍﻷﻣﺎﻛﻦ ﺍﻟﱵ ﺗﻀﺎﻑ ﻓﻴﻬﺎ ﺇﱃ ﺍﳋﺪﻣﺔ ﺍﻟﻔﻌﻠﻴﺔ ﻣﺪﺩ ﺍﻋﺘﺒﺎﺭﻳﺔ ﺑﻨـﺎﺀ ﻋﻠـﻰ ﺍﻗﺘﺮﺍﺡ ﻣﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﻭﻋﺮﺽ ﻣﻦ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
16- ﺗﻔﻮﻳﺾ ﻭﺯﻳﺮ ﺍﻟﺪﻓ ـﺎﻉ ﰲ ﺑﻌﺾ ﺍﺧﺘﺼﺎﺻ ـﺎﺗﻪ ﺫﺍﺕ ﺍﻟﻌﻼﻗﺔ ﺑﺸﺆﻭﻥ ﺍﻟـﺪﻓﺎﻉ ﻭﻓﻖ ﺍﻟﻘﺎﻧﻮﻥ.
مادة (4)
وزير الدفاع هو عضو الحكومة ويمثل حقيبة الدفاع فيها ويختص بما يلي:
1- ﻭﺿﻊ ﻭﺗﻄﻮﻳﺮ ﺍﻟﺴﻴﺎﺳﺔ ﺍﳊﺮﺑﻴﺔ ﻭﻓﻘﺎﹰ ﻟﻠﻌﻘﻴﺪﺓ ﺍﻟﺴﻴﺎﺳﻴﺔ ﻟﻠﺪﻭﻟﺔ ﻭﺍﻹﺷﺮﺍﻑ ﻋﻠـﻰ ﺗﻨﻔﻴﺬﻫﺎ.
2- ﻭﺿﻊ ﻭﺍﻗﺘﺮﺍﺡ ﺍﳌﻮﺍﺯﻧﺔ ﺍﻟﻌﺎﻣﺔ ﻟﻠﺪﻓﺎﻉ ﻭﻣﻨﺎﻗﺸﺘﻬﺎ ﺃﻣﺎﻡ ﺍﳊﻜﻮﻣﺔ ﻭﺍﻟﱪﳌﺎﻥ.
3- ﺍﻟﺘﺼﺪﻳﻖ ﻋﻠﻰ ﺍﻟﺘﺮﻗﻴﺎﺕ ﺍﻻﻋﺘﻴﺎﺩﻳﺔ ﻭﺍﻻﺳﺘﺜﻨﺎﺋﻴﺔ ﻭﻣﻨﺢ ﺍﻟﻘﺪﻡ ﺍﳌﻤﺘﺎﺯ ﻟﻠﻀﺒﺎﻁ ﺑﻨﺎﺀ ﻋﻠﻰ ﺗﻮﺻﻴﺎﺕ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﻭﺭﻓﻌﻬﺎ ﻟﻠﻘﺎﺋﺪ ﺍﻷﻋﻠﻰ ﻟﻼﻋﺘﻤﺎﺩ.
4- ﺇﺻﺪﺍﺭ ﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﳌﺘﻌﻠﻘﺔ ﺑﺘﻌﻴﲔ ﺍﳌﻠﺤﻘﲔ ﺍﻟﻌﺴﻜﺮﻳﲔ ﺑﺎﻟﺴﻔﺎﺭﺍﺕ ﺍﻟﻠﻴﺒﻴﺔ ﺑﺎﳋﺎﺭﺝ ﺑﻨﺎﺀ ﻋﻠﻰ ﺗﺮﺷﻴﺢ ﻣﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ.
5- ﺇﺻﺪﺍﺭ ﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﳌﺘﻌﻠﻘﺔ ﺑﺘﻌﻴﲔ ﺍﳌﺪﻋﻲ ﺍﻟﻌﺎﻡ ﺍﻟﻌﺴﻜﺮﻱ ﻭﺃﻋﻀﺎﺀ ﺍﳍﻴﺌﺎﺕ ﺍﻟﻘﻀﺎﺋﻴﺔ ﻭﺗﺮﻗﻴﺘﻬﻢ ﻭﺗﺸﻜﻴﻞ ﺍﶈﺎﻛﻢ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺑﻨﺎﺀ ﻋﻠﻰ ﺗﺮﺷﻴﺢ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ.
6- ﻭﺿﻊ ﺍﻟﺴﻴﺎﺳﺔ ﺍﳌﺎﻟﻴﺔ ﻟﻠﺠﻴﺶ ﺍﻟﻠﻴﱯ ﻭﲢﺪﻳﺪ ﻣﺼﺎﺩﺭ ﺍﻟﺘﻤﻮﻳﻞ ﺍﻷﺳﺎﺳﻴﺔ ﻭﺍﻹﺿ ﺎﻓﻴﺔ ﻭﻓﻘﺎﹰ ﻟﺘﻮﺟﻴﻬﺎﺕ ﺍﳊﻜﻮﻣﺔ.
7- ﺍﻹﺷﺮﺍﻑ ﻋﻠﻰ ﺇﺩﺍﺭﺓ ﺍﻟﺼﺮﺍﻋﺎﺕ ﺍﻟﺴﻴﺎﺳﻴﺔ ﻭﺍﻟﻌﺴﻜﺮﻳﺔ ﺃﺛﻨﺎﺀ ﺍﻟﻌﻤﻠﻴﺎﺕ ﺍﻟﻔﻌﻠﻴـﺔ ﺿﺪ ﺍﻟﻌﺪﻭ.
8- ﺭﻓﻊ ﺍﻟﺘﻮﺻﻴﺎﺕ ﺍﳌﺘﻌﻠﻘﺔ ﺑﺘﺮﻗﻴﺎﺕ ﺍﻟﻀﺒﺎﻁ ﺍﻟﻌﺎﺩﻳﺔ ﻭﺍﻻﺳﺘﺜﻨﺎﺋﻴﺔ ﻭﻣﻨﺢ ﺍﻟﻘﺪﻡ ﺍﳌﻤﺘﺎﺯ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﻣﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﻹﺣﺎﻟﺘﻬﺎ ﻟﻠﻘﺎﺋﺪ ﺍﻷﻋﻠﻰ.
9- ﺍﻋﺘﻤﺎﺩ ﺍﻟﻌﻘﻴﺪﺓ ﺍﻟﻌﺴﻜﺮﻳﺔ ﻟﻠﺠﻴﺶ ﺍﻟﻠﻴﱯ ﺍﻟﱵ ﺗﺘﺒﻨﺎﻫﺎ ﺭﺋﺎﺳﺔ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﻭﻓﻘﺎﹰ ﻟﻠﻌﻘﻴﺪﺓ ﺍﻟﺴﻴﺎﺳﻴﺔ ﻟﻠﺪﻭﻟﺔ.
10- ﺍﻋﺘﻤﺎﺩ ﺍﻹﺟﺮﺍﺀﺍﺕ ﻭﺍﳍﻴﻜﻠﻴﺎﺕ ﻭﺍﻻﺧﺘﺼﺎﺻﺎﺕ ﺍﻟﱵ ﺗﺘﺒﻨﺎﻫﺎ ﺭﺋﺎﺳﺔ ﺍﻷﺭﻛـﺎﻥ ﺍﻟﻌﺎﻣﺔ ﺗﻨﻔﻴﺬﺍﹰ ﻟﻠﺴﻴﺎﺳﺔ ﺍﻟﻌﺎﻣﺔ ﻟﻠﺪﻭﻟﺔ.
11- ﺍﻋﺘﻤﺎﺩ ﻋﻘﻮﺩ ﺷﺮﺍﺀ ﺍﻷﺳﻠﺤﺔ ﻭﺍﻟﺬﺧﺎﺋﺮ ﻭﺍﳌﻌﺪﺍﺕ ﻭﺍﻟﺘ ﺠﻬﻴﺰﺍﺕ ﺍﳋﺎﺻﺔ ﻟﻠﺠﻴﺶ ﺍﻟﻠﻴﱯ.
12- ﺗﻘﻴﻴﻢ ﻣﻌﺪﻻﺕ ﺍﻷﺩﺍﺀ ﻭﺳﲑ ﺍﻟﻌﻤﻞ ﺑﺎﳉﻴﺶ ﺍﻟﻠﻴﱯ ﻭﻓﻘﺎﹰ ﻟﻠﺘﻘﺎﺭﻳﺮ ﺍﻟـﱵ ﺗﻌـﺪﻫﺎ ﺍﳉﻬﺎﺕ ﺍﻟﺮﻗﺎﺑﻴﺔ ﺍﻟﻌﺴﻜﺮﻳﺔ.
13- ﺇﺑﺮﺍﻡ ﺍﻻﺗﻔﺎﻗﻴﺎﺕ ﺍﻹﻗﻠﻴﻤﻴﺔ ﻭﺍﻟﺪﻭﻟﻴﺔ ﰲ ﳎﺎﱄ ﺍﻟﺘﻌﺎﻭﻥ ﺍﻷﻣﲏ ﻭﺍﻟﻌﺴﻜﺮﻱ.
14- ﺍﻟﺘﺼﺪﻳﻖ ﻋﻠﻰ ﺍﻋﺘﻤﺎﺩ ﻗﻮﺍﺋﻢ ﺍﻟﻀﺒﺎﻁ ﺍﶈﺎﻟﲔ ﻋﻠﻰ ﺍﻟﺘﻘ ﺎﻋﺪ ﻭﺭﻓﻌﻬﺎ ﻟﻠﻘﺎﺋﺪ ﺍﻷﻋﻠﻰ ﻹﺻﺪﺍﺭ ﺍﻟﻘﺮﺍﺭﺍﺕ ﺑﺸﺄنها.
15- ﻣﻨﺢ ﺍﳌﻜﺎﻓﺂﺕ ﺍﻻﺳﺘﺜﻨﺎﺋﻴﺔ ﳌﻦ ﻳﺆﺩﻭﻥ ﺧﺪﻣﺎﺕ ﺟﻠﻴﻠﺔ ﻟﻠﻮﻃﻦ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘـﺮﺍﺡ ﻣﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ.
16- ﻃﻠﺐ ﺍﻟﺘﻐﻄﻴﺔ ﺍﳌﺎﻟﻴﺔ ﻟﺒﻌﺾ ﺍﳌﻮﺍﺿﻴﻊ ﺍﻟﻌﺎﺟﻠﺔ ﻏﲑ ﺍﳌﺪﺭﺟﺔ ﰲ ﺑﻨﻮﺩ ﻣﻴﺰﺍﻧﻴﺔ ﺍﻟﺪﻓﺎﻉ.
17- ﺇﻋﺪﺍﺩ ﻣﺸﺎﺭﻳﻊ ﺍﻟﻘﻮﺍﻧﲔ ﺍﳌ ﺘﻌﻠﻘﺔ ﺑﺎﳉﻴﺶ ﺍﻟﻠﻴﱯ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﻣـﻦ ﺭﺋـﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﻭﺇﺣﺎﻟﺘﻬﺎ ﺇﱃ ﺍﻟﺴﻠﻄﺔ ﺍﻟﺘﺸﺮﻳﻌﻴﺔ ﺣﺴﺐ ﺍﻹﺟﺮﺍﺀﺍﺕ ﺍﳌﻌﻤﻮﻝ بها.
18- ﺇﺑﻼﻍ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺑﺮﺅﻳﺔ ﺍﻟﻘﻴﺎﺩﺓ ﺍﻟﺴﻴﺎﺳﻴﺔ ﺣﻮﻝ ﻛﻴﻔﻴﺔ ﺍﺳﺘﺨﺪﺍﻡ ﺍﳉـﻴﺶ ﺍﻟﻠﻴﱯ ﻟﻠﺪﻓﺎﻉ ﻋﻦ ﻟﻴﺒﻴﺎ ﻭﲪﺎﻳﺔ ﺃﻣﻨﻬﺎ ﻻﲣﺎﺫ ﺍﻹﺟﺮﺍﺀﺍﺕ ﺍﻟﻼﺯﻣﺔ ﺑﺎﳋﺼﻮﺹ.
19- ﲤﺜﻴﻞ ﺍﳉﻴﺶ ﺍﻟﻠﻴﱯ ﻭﺍﻹﺟﺎﺑﺔ ﻋﻦ ﺗﺴﺎﺅﻻﺕ ﺟﻬﺎﺕ ﺍﻻﺧﺘﺼﺎﺹ ﲟﺎ ﰲ ﺫﻟﻚ ﻣﺎ ﻳﻨﺸﺮ ﺃﻭ ﻳﺬﺍﻉ ﰲ ﻭﺳﺎﺋﻞ ﺍﻹﻋﻼﻡ ﺍﳌﺨﺘﻠﻔﺔ.
20- ﻗﺒﻮﻝ ﻃﻠﺒﺔ ﻣﻦ ﻏﲑ ﺍﻟﻠﻴﺒﻴﲔ ﺑﺎﳌﺆﺳﺴﺎﺕ ﺍﻟﺘﻌﻠﻴﻤﻴﺔ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘـﺮﺍﺡ ﻣﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ.
21- ﻣﻨﺢ ﺍﻷﻭﲰﺔ ﻭﺍﻷﻧﻮﺍﻁ ﺍﻟﻌﺴﻜﺮﻳﺔ ﻭﻗﺒﻮﻝ ﲪﻞ ﺍ ﻷﺟﻨﱯ ﳍﺎ ﺑﻨﺎﺀ ﻋﻠﻰ ﻋﺮﺽ ﻣـﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ.
22- ﺍﳌﻮﺍﻓﻘﺔ ﻋﻠﻰ ﺍﺳﺘﻤﺮﺍﺭ ﺧﺪﻣﺔ ﺍﻟﻀﺎﺑﻂ ﺍﳌﺘﺨﻄﻰ ﰲ ﺍﻟﺘﺮﻗﻴﺔ ﺇﺫﺍ ﺭﻏﺐ ﰲ ﺫﻟﻚ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ.
23- ﲢﺪﻳﺪ ﺍﺧﺘﺼﺎﺻﺎﺕ ﺁﻣﺮﻱ ﺍﳌﻨﺎﻃﻖ ﻭﺍﻟﺼﻨﻮﻑ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺑﻨﺎﺀً ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ.
24- ﺍﻋﺘﻤﺎﺩ ﺇﻋﺎﺭﺓ ﺍﻟﻌ ﺴﻜﺮﻳﲔ ﺇﱃ ﺍﻟﺪﻭﻝ ﻭﺍﳍﻴﺌﺎﺕ ﺍﳌﺪﻧﻴﺔ ﺍﶈﻠﻴـﺔ ﺃﻭ ﺍﻹﻗﻠﻴﻤﻴـﺔ ﺃﻭ ﺍﻟﺪﻭﻟﻴﺔ ﺑﻨﺎﺀً ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ.
25- ﺗﻌﻴﲔ ﺍﳌﻮﻇﻔﲔ ﻭﺇنهاء خدماتهم ﻭﺍﻟﺘﻌﺎﻗﺪ ﻣﻊ ﺍﻟﻔﻨﻴﲔ ﻭﺍﳌﺪﻧﻴﲔ ﺍﻟﻔﻨﻴﲔ ﺍﻷﺟﺎﻧﺐ ﰲ ﺍﳉﻴﺶ ﺑﻌﻘﻮﺩ ﺧﺎﺻﺔ ﲢﺪﺩ ﺷﺮﻭﻁ ﺍﺳﺘﺨﺪﺍﻣﻬﻢ ﻭﺳﺎﺋﺮ ﺣﻘﻮﻗﻬﻢ ﺑﻨﺎﺀ ﻋﻠﻰ ﻋﺮﺽ ﻣﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ.
26- ﻋﺮﺽ ﺍﻷﻣﺎﻛﻦ ﺍﻟﱵ ﺗﻀﺎﻑ ﻓﻴﻬﺎ ﺇﱃ ﻣﺪﺓ ﺍﳋﺪﻣﺔ ﺍﻟﻔﻌﻠﻴﺔ ﻣﺪﺩ ﺍﻋﺘﺒﺎﺭﻳﺔ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﻣﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﻭﺇﺣﺎﻟﺘﻬﺎ ﻟﻠﻘﺎﺋﺪ ﺍﻷﻋﻠﻰ.
ﻭﻟﻮﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ ﺃﻥ ﻳﻔﻮﺽ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﰲ ﺑﻌﺾ ﺍﻻﺧﺘﺼﺎﺻﺎﺕ ﻭﻓﻘﺎﹰ ﻟﻠﻘﺎﻧﻮﻥ.

ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﻟﻠﺠﻴﺶ ﺍﻟﻠﻴﱯ ﻫﻮ ﺍﻷﻗﺪﻡ ﰲ ﺍﻟﺮﺗﺐ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺑﲔ ﺿـﺒﺎﻁ ﺍﳉﻴﺶ ﻭﻳﻌﺘﱪ ﺭﺋﻴﺴﻪ ﺍﳌﺒﺎﺷﺮ (ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ ) ﻭﻫﻮ ﺍﳌﺴﺌﻮﻝ ﺍﳌﺒﺎﺷـﺮ ﻋﻠـﻰ ﺍﳉﺎﻧـﺐ ﺍﻟﻌﺴﻜﺮﻱ ﻣﻦ ﺍﻟﻨﺎﺣﻴﺔ ﺍﻟﻔﻨﻴﺔ، ﻣﻦ ﺣﻴﺚ ﺍﻟﺘﻨﻈﻴﻢ ﻭﺍﻟﺘﺠﻬﻴـﺰ ﻭﺍﻟﺘـﺪﺭﻳﺐ ﻭﺍﻟﻘﻴـﺎﺩﺓ ﻭﺍﻹﺩﺍﺭﺓ، ﻭﺍﳊﻔﺎﻅ ﻋﻠﻰ ﺍﳉﺎﻫﺰﻳﺔ ﺍﻟﻘﺘﺎﻟﻴﺔ ﻟﻠﺠﻴﺶ ﺍﻟﻠﻴﱯ، ﻭﺗﻘﻊ ﲢﺖ ﺇﻣﺮﺗـﻪ ﻛﺎﻓـﺔ ﺃﺭﻛﺎﻧﻪ ﻭﻓﺮﻭﻋﻪ ﻭﻫﻴﺌﺎﺗﻪ ﻭﺇﺩﺍﺭﺍﺗﻪ ﻭﻭﺣﺪﺍﺗﻪ ﺍﳌﺴﺘﻘﻠﺔ ﻭﳜﺘﺺ ﲟﺎ ﻳﻠﻲ:
1- ﻣﺘﺎﺑﻌﺔ ﺗﻨﻔﻴﺬ ﺍﳋﻄﻂ ﺍﳌﺘﻌﻠﻘﺔ ﺑﺎﻷﻋﻤﺎﻝ ﺍﳊﺮﺑﻴﺔ ﻛﺎﻓﺔ ﻭﻋﻤﻠﻴﺎﺕ ﺍﳉـﻴﺶ ﺩﺍﺧـﻞ ﻭﺧﺎﺭﺝ ﺍﻟﻮﻃﻦ.
2- ﻃﻠﺐ ﺍﳌﻮﺍﻃﻨﲔ ﻷﺩﺍﺀ ﺍﳋﺪﻣﺔ ﺍﻹﻟﺰﺍﻣﻴﺔ ﺑﺎﻟﻨﺴﺒﺔ ﳌﻦ ﺟﺎﻭﺯﺕ ﺳﻨﻪ ﺍﳋﺎﻣﺴﺔ ﻭﺍﻟﺜﻼﺛﲔ ﰲ ﺣﺎﻟﺔ ﺍﳊﺮﺏ ﻭﺍﻟﻄﻮﺍﺭﺉ ﻭﺍﳊﺮﻛﺎﺕ ﺍﻟﻔﻌﻠﻴﺔ ﺑﻌﺪ ﻣﻮﺍﻓﻘﺔ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
3- ﺗﻌﻴﲔ ﻭﺇﻗﺎﻟﺔ ﺭﺅﺳﺎﺀ ﺍﻷﺭﻛﺎﻥ ﻟﻜﺎﻓﺔ ﻓﺮﻭﻉ ﺍﻷﺳﻠﺤﺔ ﻭﻋﺮﺿﻪ ﻋﻠﻰ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
4- ﺗﻌﻴﲔ ﻭﺇﻗﺎﻟﺔ ﺭﺅﺳﺎﺀ ﺍﳍﻴﺌﺎﺕ ﻭﻣﺪﺭﺍﺀ ﺍﻹﺩﺍﺭﺍﺕ ﻭﺍﻷﺟﻬﺰﺓ ﻭﺍﻟﻮﺣﺪﺍﺕ ﺍﳌـﺴﺘﻘﻠﺔ ﻭﺁﻣﺮﻱ ﺍﳌﺆﺳﺴﺎﺕ ﺍﻟﺘﻌﻠﻴﻤﻴﺔ ﺍﻟﻌﺴﻜﺮﻳﺔ.
5- ﺍﻗﺘﺮﺍﺡ ﺗﻌﻴﲔ ﺍﳌﺪﻋﻲ ﺍﻟﻌﺎﻡ ﺍﻟﻌﺴﻜﺮﻱ ﻭﺃﻋﻀﺎﺀ ﺍﳍﻴﺌـﺎﺕ ﺍﻟﻘـﻀﺎﺋﻴﺔ ﻭﺗﺮﻗﻴﺘـﻬﻢ ﻭﺗﺸﻜﻴﻞ ﺍﶈﺎﻛﻢ ﺍﻟﻌﺴﻜﺮﻳﺔ ﻭﺇﺣﺎﻟﺘﻬﺎ ﻟﻮﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
6- ﺇﻋﺪﺍﺩ ﺍﳌﻮﺍﺯﻧﺔ ﺍﻟﺘﺴﻴﲑﻳﺔ المجمعة ﻟﻠﺠﻴﺶ ﻭﺇﺣﺎﻟﺘﻬﺎ ﻟﻮﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
7- ﺍﻟﺘﻮﺻﻴﺎﺕ ﺍﳌﺘﻌﻠﻘﺔ ﺑﺘﺮﻗﻴﺎﺕ ﺍﻟﻀﺒﺎﻁ ﺍﻟﻌﺎﺩﻳﺔ ﻭﺍﻻﺳﺘﺜﻨﺎﺋﻴﺔ ﻭﻣﻨﺢ ﺍﻟﻘـﺪﻡ ﺍﳌﻤﺘـﺎﺯ ﻭﺭﻓﻌﻬﺎ ﺇﱃ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ ﻹﺣﺎﻟﺘﻬﺎ ﺇﱃ ﺍﻟﻘﺎﺋﺪ ﺍﻷﻋﻠﻰ.
8- ﺗﺮﺷﻴﺢ ﺍﳌﻠﺤﻘﲔ ﺍﻟﻌﺴﻜ ﺮﻳﲔ ﺑﺎﻟﺴﻔـﺎﺭﺍﺕ ﺍﻟﻠﻴﺒﻴﺔ ﰲ ﺍﳋﺎﺭﺝ ﻭﺇﺣﺎﻟﺘـﻬﺎ ﺇﱃ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
9- ﺍﻗﺘﺮﺍﺡ ﺍﻷﻣﺎﻛﻦ ﺍﻟﱵ ﺗﻀﺎﻑ ﻓﻴﻬﺎ ﺇﱃ ﻣﺪﺓ ﺍﳋﺪﻣﺔ ﺍﻟﻔﻌﻠﻴﺔ ﻣﺪﺩ ﺍﻋﺘﺒﺎﺭﻳﺔ ﻭﺇﺣﺎﻟﺘﻬﺎ ﺇﱃ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ.
10- ﺇﻋﻼﻥ ﻣﻮﺕ ﺍﳌﻔﻘﻮﺩ ﻣﻦ ﺍﻟﻌﺴﻜﺮﻳﲔ ﻭﺍﳌﻮﻇﻔﲔ ﺍﻟﺘﺎﺑﻌﲔ ﻟﻠﺠﻴﺶ ﻭﺇﺛﺒﺎﺕ ﺻﻔﺔ ﻗﺘﻠﻰ ﺍﻟﻌﻤﻠﻴﺎﺕ ﺍﻟﻌﺴﻜﺮﻳﺔ ﻭﺍﻷﺳﺮﻯ ﻭﺍﳌﻔﻘﻮﺩﻳﻦ ﻭﺍﳉﺮﺣﻰ ﻭﺍﳌﻌﺎﻗﲔ ﺑﺴﺒﺐ ﺫﻟﻚ.
11- ﻣﻨﺢ ﻋﻼﻭﺓ ﺗﻌﺎﺩﻝ ﺍﻟﻌﻼﻭﺍﺕ ﺍﻟﺴﻨﻮﻳﺔ ﺍﳌﻘﺮﺭﺓ ﻟﺮﺗﺒﺘﻪ ﺃﻭ ﻣﻜﺎﻓﺄﺓ ﺗﺸﺠﻴﻌﻴﺔ ﻋﻨـﺪ ﻗﻴﺎﻣﻪ ﺑﺄﻋﻤﺎﻝ ﳑﻴﺰﺓ.
12- ﺍﻹﻋﺎﺩﺓ ﻟﻠﺨﺪﻣﺔ ﺑﺎﻟﻨﺴﺒﺔ ﻟﻀﺒﺎﻁ ﺍﻟﺼﻒ ﻭﺍﳉﻨﻮﺩ.
13- ﲢﺪﻳﺪ ﺍﻟﻌﻼﻭﺍﺕ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺍﻟﱵ ﲤﻨﺢ ﻟﻠﻌﺴﻜﺮﻳﲔ (ﺍﻟﻔﻨﻴﺔ ﻭﺍﳌﻬﻨﻴﺔ).
14- ﺇﻧﺸﺎﺀ ﺍﻟﻨﻴﺎﺑﺎﺕ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺍﳉﺰﺋﻴﺔ ﻭﺍﻟﻜﻠﻴﺔ ﻭﺑﻴﺎﻥ ﺣﺪﻭﺩﻫﺎ ﺍﻹﺩﺍﺭﻳﺔ ﻭﻳﻜﻮﻥ ﺃﺩﺍﺀ ﺣﻠﻒ ﺍﻟﻴﻤﲔ ﺍﻟﻘﺎﻧﻮﱐ ﻟﺮﺅﺳﺎﺀ ﻭﺃﻋﻀﺎﺀ ﺍﶈﺎﻛﻢ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺍﻟﺪﺍﺋﻤﺔ ﺃﻣﺎﻡ ﺭﺋـﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ.
15- ﲢﺪﻳﺪ ﺍﺧﺘﺼﺎﺻﺎﺕ ﺍﶈﺎﻛﻢ ﺍﻟﺪﻭﺭﻳﺔ ﻭﺗﻨﻈﻴﻢ ﺇﺟﺮﺍﺀاتها ﻭﺍﳉﺮﺍﺋﻢ ﺍﻟﱵ ﺗﻔﺼﻞ ﻓﻴﻬﺎ.
16- ﺍﻋﺘﻤﺎﺩ ﺍﳌﺬﻛﺮﺍﺕ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ ﺍﻟﺼﺎﺩﺭﺓ ﻣﻦ ﺍﳍﻴﺌﺔ ﺍﻟﻌﺎﻣﺔ ﻟﻠﻘﻀﺎﺀ ﺑﺸﺄﻥ ﺍﻟـﺸﻬﺪﺍﺀ ﻭﺷﻬﺪﺍﺀ ﺍﻟﻮﺍﺟﺐ ﻭﺍﳉﺮﺣﻰ ﻭﺗﺴﻮﻳﺔ ﺍﳌﺴﺘﺤﻘﺎﺕ ﺍﻟﺘﻘﺎﻋﺪﻳﺔ.
17- ﲢﺪﻳﺪ ﻋﻼﻣﺎﺕ ﺍﻟﺮﺗﺐ ﻭﺍﻟﻘﻴﺎﻓﺔ ﺍﻟﻌﺴﻜﺮﻳﺔ.
18- ﻭﺿﻊ ﺍﻟﺘﻘﺎﺭﻳﺮ ﺍﳋﺎﺻﺔ ﻟﻠﺘﻮﺻﻴﺔ ﺑﺘﻮﱄ ﺍﳌﻨﺎﺻﺐ ﺍﻟﻘﻴﺎﺩﻳﺔ ﻭﺍﻟﺮﺋﻴﺴﻴﺔ ﻭﺍﻟﺘﻮﺻـﻴﺔ ﲟﻨﺢ ﺍﻷﻭﲰﺔ ﻭﺍﻷﻧﻮﺍﻁ ﺍﻟﻌﺴﻜﺮﻳﺔ ﻭﻏﲑ ﺫﻟﻚ.
19- ﲢﺪﻳﺪ ﺍﻟﺘﺄﻫﻴﻞ ﺍﻟﻼﺯﻡ ﻟﺘﺮﻗﻴﺔ ﺍﻟﻌﺴﻜﺮﻳﲔ.
20- ﺍﳌﻮﺍﻓﻘﺔ ﻋﻠﻰ ﺍﻧﺘﺴﺎﺏ ﺍﻟﻌﺴﻜﺮﻳﲔ ﻟﻠﺪﺭﺍﺳﺔ ﰲ ﺍﳌﻌﺎﻫﺪ ﺃﻭ ﺍﻟﻜﻠﻴـﺎﺕ ﺍﳉﺎﻣﻌﻴـﺔ
ﻭﺍﻷﻛﺎﺩﳝﻴﺎﺕ ﻭﺍﻹﻳﻔﺎﺩ ﻟﻠﺪﺭﺍﺳﺔ ﻭﺍﻟﺪﻭﺭﺍﺕ ﺍﻟﺘﺪﺭﻳﺒﻴﺔ ﺑﺎﳋﺎﺭﺝ.
21- ﺗﺸﻜﻴﻞ ﺍﻟﻠﺠﺎﻥ ﺍﻟﻄﺒﻴﺔ ﻭﲢﺪﻳﺪ اختصاصاتها وواجباتها ﻭﺃﻣـﺎﻛﻦ ﺍﻧﻌﻘﺎﺩﻫـﺎ ﻭﺍﳌﻮﺍﻓﻘﺔ ﻋﻠﻰ ﻋﻼﺝ ﺍﻟﻌﺴﻜﺮﻳﲔ ﺧﺎﺭﺝ ﻟﻴﺒﻴﺎ ﺇﺫﺍ ﺛﺒﺖ ﺗﻌﺬﺭ ﻋﻼﺟﻬﻢ ﳏﻠﻴﺎﹰ.
22- ﺍﻟﺘﻮﺻﻴﺔ ﺑﺈﻋﺎﺩﺓ ﺍﻟﻀﺎﺑﻂ ﺍﶈﺎﻝ ﺇﱃ ﻗﺎﺋﻤﺔ ﻧﺼﻒ ﺍﻟﺮﺍﺗﺐ ﻟﻠﺨﺪﻣﺔ ﺍﻟﻌﺴﻜﺮﻳﺔ.
23- ﺍﻟﺘﺮﻗﻴﺔ ﺣﱴ ﺭﺗﺒﺔ (ﺭ.ﻉ.ﻭ) ﻭإنهاء ﺧﺪﻣﺔ ﺿﺒﺎﻁ ﺍﻟﺼﻒ ﻭﺍﳉﻨﻮﺩ ﻭﻓﻘﺎﹰ ﻟﻠﺤﺎﻻﺕ ﺍﳌﻘﺮﺭﺓ ﻗﺎﻧﻮﻧﺎﹰ.
24- ﻭﻗﻒ ﺇﺣﺎﻟﺔ ﺿﺒﺎﻁ ﺍﻟﺼﻒ ﻭﺍﳉﻨﻮﺩ ﺇﱃ ﺍﻟﺘﻘﺎﻋﺪ ﻭﲤﺪﻳﺪ ﺧﺪﻣﺎتهم ﻃﺒﻘﺎﹰ ﻟﻘـﺎﻧﻮﻥ ﺗﻘﺎﻋﺪ ﺍﻟﻌﺴﻜﺮﻳﲔ ﺑﻌﺪ ﺑﻠﻮﻏﻬﻢ ﺍﻟﺴﻦ ﺍﳌﻘﺮﺭﺓ ﻟﻠﺘﻘﺎﻋﺪ ﻭﳌﺪﺓ ﳏﺪﺩﺓ ﻭﳌﺮﺓ ﻭﺍﺣﺪﺓ.
25- ﺍﳌﺴﺎﳘﺔ ﰲ ﺗﺸﻜﻴﻞ ﺇﺩﺍﺭﺓ ﺍﻷﺯﻣﺎﺕ ﻭﺍﻟﻜﻮﺍﺭﺙ ﺍﻟﻄﺒﻴﻌﻴﺔ ﻭﺗـﺸﻜﻴﻞ ﺍﻟﻠﺠـﺎﻥ ﻭﺗﺴﻤﻴﺔ ﺍﳌﻨﺪﻭﺑﲔ.
26- ﺗﺸﻜﻴﻞ ﺍﻟﻠﺠﺎﻥ ﻟﻠﺴﻔﺮ ﺇﱃ ﺍﳋﺎﺭﺝ ﰲ ﻣﻬﺎﻡ ﺭﲰﻴﺔ ﻭﳉﺎﻥ ﻋـﺴﻜﺮﻳﺔ ﻣـﺸﺘﺮﻛﺔ ﺳﻮﺍﺀ ﳌﺘﺎﺑﻌﺔ ﺃﻭﺟﻪ ﺍﻟﺘﻌﺎﻭﻥ ﻣﻊ ﺍﻟﺪﻭﻝ ﺍﳌﻮﻗﻊ ﻣﻌﻬﺎ ﺍﺗﻔﺎﻗﻴﺎﺕ ﺃﻭ ﻣﺬﻛﺮﺍﺕ ﺗﻔﺎﻫﻢ ﺃﻭ ﳏﺎﺿﺮ ﺗﻌﺎﻭﻥ ﻋﺴﻜﺮﻱ، ﺃﻭ ﻟﺒﺤﺚ ﻭﻣﻨﺎﻗﺸﺔ ﺑﻌﺾ ﺍﳌﻮﺍﺿﻴﻊ ﺍﻟﻌـﺴﻜﺮﻳﺔ ﺃﻭ ﺍﳌﺸﺎﺭﻛﺔ ﰲ ﺍﳌﻌﺎﺭﺽ ﻭﺍﻟﻨﺪﻭﺍﺕ ﻭﺍﳌﺆﲤﺮﺍﺕ ﺍﻟﻌﺴﻜﺮﻳﺔ ﺍﻟﺪﻭﻟﻴﺔ.
27- ﺍﳌﻮﺍﻓﻘﺔ ﻋﻠﻰ ﻗﻀﺎﺀ ﺍﻹﺟﺎﺯﺍﺕ ﺧﺎﺭﺝ ﻟﻴﺒﻴﺎ.
28- ﻣﻨﺢ ﻋﻼﻭﺓ ﺍﻟﺘﺪﺭﻳﺐ ﺍﻟﱵ ﲤﻨﺢ ﻷﻋﻀﺎﺀ ﻫﻴﺌﺎﺕ ﺍﻟﺘﺪﺭﻳﺲ ﺑﺎﳌﺆﺳﺴﺎﺕ ﺍﻟﺘﻌﻠﻴﻤـﺔ ﺍﻟﻌﺴﻜﺮﻳﺔ. ﻋــﺪد
29- ﲢﺪﻳﺪ ﺍﳌﻨﺢ ﺍﳌﺎﻟﻴﺔ ﻟﻄﻠﺒﺔ ﺍﳌﺆﺳﺴﺎﺕ ﺍﻟﺘﻌﻠﻴﻤﻴﺔ ﺍﻟﻌﺴﻜﺮﻳﺔ.
ﻭﻟﺮﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﺃﻥ ﻳﻔﻮﺽ ﻣﻌﺎﻭﻧﻪ ﰲ ﺑﻌﺾ ﺍﺧﺘﺼﺎﺻﺎﺗﻪ ﺇﱃ ﺭﺅﺳﺎﺀ ﺃﺭﻛﺎﻥ ﺍﻷﺳﻠﺤﺔ ﺍﻟﺮﺋﻴﺴﻴﺔ ﻭﺭﺋﻴﺲ ﻫﻴﺌﺔ ﺍﻟﺘﻨﻈﻴﻢ ﻭﺍﻹﺩﺍﺭﺓ.

ﻳﺘﻮﱃ ﻭﺯﻳﺮ ﺍﻟﺪﻓﺎﻉ ﺑﻨﺎﺀ ﻋﻠﻰ ﺍﻗﺘﺮﺍﺡ ﻣﻦ ﺭﺋﻴﺲ ﺍﻷﺭﻛﺎﻥ ﺍﻟﻌﺎﻣﺔ ﲢﺪﻳﺪ ﺍﺧﺘﺼﺎﺻﺎﺕ ﺭﺅﺳﺎﺀ ﺍﻷﺭﻛﺎﻥ ﺍﻟﺮﺋﻴﺴﻴﺔ (ﺍﻟﱪﻳﺔ - ﺍﻟﺒﺤﺮﻳﺔ - ﺍﳉﻮﻳﺔ - ﺍﻟﺪﻓﺎﻉ ﺍﳉـﻮﻱ ) ﻭﺭﺅﺳـﺎﺀ ﺍﻟﻮﺣﺪﺍﺕ ﻭﺍﻷﺳﻠﺤﺔ ﻭﺍﻟﺼﻨﻮﻑ ﺍﻷﺧﺮﻯ.

ﻳﻌﻤﻞ بهذا ﺍﻟﻘﺎﻧﻮﻥ ﻣﻦ ﺗﺎﺭﻳﺦ ﺻﺪﻭﺭﻩ ﻭﻳﻨﺸﺮ ﰲ ﺍﳉﺮﻳﺪﺓ ﺍﻟﺮﲰﻴﺔ ﻭﻭﺳﺎﺋﻞ ﺍﻹﻋﻼﻡ ﺍﳌﺨﺘﻠﻔﺔ ﻭﻳﻠﻐﻰ ﺍﻟﻘﺮﺍﺭ ﺭﻗﻢ (59) ﻟﺴﻨﺔ 1989ﻡ. ﺑﺸﺄﻥ ﺇﻧﺸﺎﺀ ﺍﻟﻠﺠﻨﺔ ﺍﻟﻌﺎﻣـﺔ ﻟﻠـﺪﻓﺎﻉ ﻭﺗﻨﻈﻴﻤﻬﺎ ﻭﻛﻞ ﺣﻜﻢ ﳜﺎﻟﻒ ﺃﺣﻜﺎﻡ ﻫﺬﺍ ﺍﻟﻘﺎﻧﻮﻥ، ﻭﻋﻠﻰ ﻛﻞ ﻓﻴﻤﺎ ﳜﺼﻪ ﺗﻨﻔﻴﺬ ﺃﺣﻜﺎﻣﻪ ﻭﺗﺒﻠﻎ ﺑﻪ ﺍﳊﻜﻮﻣﺔ ﺍﻻﻧﺘﻘﺎﻟﻴﺔ ﻭﺍلمجالس ﺍﶈﻠﻴﺔ.
