on adding some provisions to Law No. (10) of 2012

on disbursing a financial sum to Libyan families on the first anniversary of the 17 February Revolution

The National Transitional Council:

Upon review of:

  • The Victory Statement of the 17 February Revolution issued on 22 February 2011;
  • The Constitutional Declaration issued on 3 August 2011;
  • The bylaws of the National Transitional Council;
  • Law No. (1) of 2005 on banks;
  • Law No. (6) of 2012 on withdrawing a monetary denomination from circulation;
  • And based on what was discussed in the National Transitional Council meeting on Tuesday 28/02/2012.

issued the following law:

Article (1)

Two articles numbered Articles (1) bis (a) and (1) bis (b) shall be added to Law No. (10) of 2012 on disbursing a financial sum to Libyan families on the first anniversary of the 17 February Revolution, and they shall read as follows:

Article (1) bis (a)

Entitlement to the amounts disbursed by virtue of this law shall be based on the marital status of every citizen by the end of Friday, 17 February 2012. Changes to this status after the above date shall not be taken into consideration.

Marital status shall be proved by virtue of a certificate issued by the Civil Status Directorate on the special form prepared for such purpose, as per the executive regulation of this law.

Article (1) bis (b)

Amounts disbursed in execution of the provisions of this law shall be funded by the funds collected, and that within the limit of 3.5 billion LYD, according to the process stipulated in the executive regulation of this law.

Article (2)

Article (2) of Law No. (10) of 2012 on disbursing a financial sum to Libyan families on the first anniversary of the 17 February Revolution shall be amended to the following:

The executive regulation of this law shall be issued by a decree from the transitional government and shall include the implementation process as proposed by the Central Bank of Libya. The executive regulation shall particularly include:

  1. The status of the following categories:
  2. Libyan women married to non-Libyans.
  3. Individuals returning from abroad who do not hold Libyan nationality and who are registered with the Department of Foreigners.
  4. Libyan nationals by virtue of the law and registered through social care institutions.
  5. The marital status certificate form stipulated in Article (1) bis (a) of this law and the data and safety means that shall be respected when preparing the reform, taking into consideration the status of individuals referred to in Clauses (2) and (3) of the previous Article.

Article (3)

This law shall be published in the Official Gazette and shall enter into force from the date Law No. (10) of 2012 entered into force. The president of the transitional government and the governor of the Central Bank of Libya shall implement it each within their mandate and take the measures necessary for its implementation.
