The General People’s Congress
:

In execution of the resolutions adopted by the Basic People’s Congresses in their annual session of 1429 FBP;

And upon review of:

• The Declaration on the Establishment of the Authority of the People;
• The Great Green Charter of Human Rights of the Jamahiriya Era;
• Law No. (20) of 1991 on promoting freedom;
• Law No. (9) of 1992 on conducting economic activities;
• Law No. (15) of 1981 on the salary system of national employees in the Great Socialist People’s Libyan Arab Jamahiriya;
• Law No. (9) of 1427 FBP on national service;
• Law No. (1) of 1425 FBP on the bylaws of people’s congresses and people’s committees, and its amendments.

drafted the following law:

Article (1)

In the application of the provisions of this law, national service shall refer to Libyans’ contribution in providing a free service to the rest of the community in all sectors at a certain period of time.

The executive regulations of this law shall determine the regulations necessary for the application of this Article.

Article (2)

Performing national service in the sectors of education and health shall be a duty for all eligible Libyans to perform in educational and health institutions, in order for education and health to continue to be provided free of charge.

The General People’s Committees of sectors and the People’s Committees of districts and bodies subordinate to them, as well as the bodies, institutions, enterprises, public companies, standalone public bodies, and other administrative units, whether they are managed by People’s Committees or not, in coordination with the National Authority for Information and Documentation, shall prepare a list of all its qualified and competent personnel and put their names in private records in order to assign them to exercise national service in rotation, according to their specialties and qualifications, in the aforementioned sectors.

Personnel subject to the exercise of national service in the sectors of education and health shall pay a proportion of their incomes as a compensation for exercising the service. These revenues shall be allocated to raise and improve the services of sectors concerned.

The executive regulations issued by the General People’s Committee shall determine the regulations necessary for the application of this Article, including the percentage to be paid.

Article (3)

All self-employed persons, whether they are individuals or working within co-operatives, joint stock companies, or other companies, shall provide declarations on their own behalves showing their academic qualifications and work experience, and present them by the deadline set forth by the executive regulations of this law, each to the competent People’s Committee in the area where he is located. Competent People’s Committees shall take the necessary measures for the purposes of commissioning them to perform national service in accordance with the provisions of the law.

It is prohibited to provide any service to those who do not provide the aforementioned declarations and competent authorities shall be informed of the persons who refrain from submitting such declarations to take the necessary actions against them, according to the provisions of this law.

The executive regulations shall determine the regulations necessary for the application of the provisions of this Article.

Article (4)

Continued payment of salary by an employer, access to services from authorities concerned with providing them, and the continued validity of licences shall depend on compliance in the performance of national service and the implementation of the order to do as such. The executive regulations of this law shall determine the regulations necessary for the application of this Article.

Article (5)

Current public health and educational institutions shall continue to provide their services with their current workers and the persons assigned to perform national service referred to in Articles (2) and (3) of this law.

The executive regulations of this law shall determine how to develop a schedule of operation for the aforementioned facilities by those assigned to perform national service and shall develop the rotational system of such works.

Article (6)

Conditions related to military training shall be regulated by decrees issued by the General Provisional Committee for Defence.

Article (7)

Law No. (9) of 1427 AH on national service shall be repealed.

Article (8)

The executive regulations of this law shall be issued by virtue of a decree from the General People’s Committee.

Article (9)

This law shall be published in the Official Gazette and shall enter into force from its date of issuance.
