amending a provision of Law No. (40)

of 1974 on military service

The National Transitional Council:

Upon review of:

• The interim Constitutional Declaration issued on 03/03/2011;
• Law No. (40) of 1974 on service in the Libyan army, and its amendments;
• Law No. (5) of 1978 amending some provisions of military laws;
• Law No. (11) of 2012 establishing some provisions concerning the powers of command levels in the Libyan army;

issued the following law:

Article (1)

Article (7) of Law No. 40 of 1974 shall be replaced with the following text:

“Officers in the Libyan army shall initially be appointed the rank of second lieutenant. They may be promoted to a higher rank as required by the higher interest of the country. A decision from the Minister of Defence based on a proposal from the Chief of the General Staff shall set the rules regulating promotions above second lieutenant.”

Article (2)

This law shall enter into force from its date of issuance, and any contrary provision shall be abolished. It shall be published in the Official Gazette.
