Law No. (7) of 2014 AD

on amending certain provisions of the Code of Criminal Procedure

The General National Congress,

Upon review of:

  • The interim Constitutional Declaration issued on 03 August 2011 AD and amendments thereto;
  • The rules of procedure of the General National Congress;
  • The Penal Code and the Code of Criminal Procedure and the amendments and supplementary laws thereto;
  • The conclusions of the General National Congress in its ordinary meeting No. (178) held on Sunday, 22 Jumada al-Awwal 1435 AH, corresponding to 23 March 2014 AD;

issued the following law:

Article (1)

Article (241) shall be amended by adding a second paragraph, as follows:

The session shall be deemed public if it is transmitted live to the public over one or more satellite channels, via public monitors, or other communications media.

Article (2)

Article (243) shall be amended by adding a second paragraph, as follows:

In cases of necessity where there are concerns about the safety of the accused or it is feared they may escape, the court may utilise modern means of communication to link the accused with the courtroom and undertake the procedures against them in this manner. Such procedures shall apply to witnesses, experts, civil plaintiffs, and civil prosecutors if the conditions of necessity, which shall be left to the court’s discretion, are met in accordance with the conditions and circumstances in which the trial is being conducted.

Article (3)

Any provision that conflicts with those of this Law shall be repealed.

Article (4)

This Law shall enter into force from the date of its publication and shall be published in the Official Gazette and the various media.
