on forming a fact-finding committee and determining its functions

The Prime Minister,

Upon review of:

  • The Constitutional Declaration;
  • The Code of Criminal Procedure;
  • Law No. (01) of 1999 AD issuing the Code of Criminal Procedure of the Armed People;
  • Law No. (06) of 2006 AD on the justice system and amendments thereto;
  • Law No. (06) of 2010 AD on adding an article to Law No. (40) of 1974 AD on service in the Armed People;
  • National Transitional Council Decree No. (174) of 2011 AD on determining the structure of the transitional government;
  • National Transitional Council Decree No. (184) of 2011 AD on approving the transitional government;
  • Cabinet Decree No. (74) of 2012 AD on approving the organisational structure and administrative unit of the Prime Minister’s Office;
  • Cabinet Decree No. (73) of 2012 AD on forming a committee and determining its functions;
  • The submission of the Minister of Local Governance and the chairman of the committee formed under Decree No. (73) of 2012 AD;
  • For reasons of public interest;

has decreed:

Article (1)

A fact-finding committee shall be formed as follows:

  1. Counsellor Ali Al-Hadi Al-Tayeb Al-Hadi

Head of the Judicial Inspection Department Branch at Zawiya Court of Appeals Chairman

  1. Counsellor Abdel-Hamid Milad Al-Maghboub

Representative of the Military Judiciary Member

  1. Captain Abdel-Wahab Al-Mabrouk Al-Qallali Member

Article (2)

The committee formed under the preceding Article of this Decree shall conduct fact-finding activities and work through the competent bodies to collect evidence related to the events that occurred in the Sabha region.

Article (3)

The committee may seek the assistance of anyone it deems necessary to perform its functions. The committee shall complete its activities by a deadline of no more than fifteen days from the date this Decree enters into force and shall prepare a report on the functions assigned thereto to be submitted to the Prime Minister.

Article (4)

This Decree shall enter into force on the date of its issue and shall be implemented by the competent bodies.
