Decision No. (71) of 2010 on establishing the Tripoli summary traffic court and prosecution

· The Code of Criminal Procedure;

· Law No. (11) of 1984 on road traffic and amendments thereto;

· Minister of Justice Decree No. (63) of 1974 AD on establishing a summary traffic court in Tripoli;

· Supreme Council of Judicial Bodies Decree No. (13) of 1425 FBP on establishing first instance courts and summary prosecutions;

· Supreme Council of Judicial Bodies Decree No. (2) of 1371 FDP on establishing a first instance court and a public prosecution.

· Supreme Council of Judicial Bodies Decree No. (28) of 1375 FDP on establishing the East Tripoli First Instance Court and Prosecution and amending the jurisdiction of of two first instance courts and prosecutions;

· Supreme Council of Judicial Bodies Decree No. (51) of 1378 FDP on establishing summary traffic courts and prosecutions;

· The submission of the head of the Supreme Council for Judicial Bodies in the eighth meeting of the Supreme Council for Judicial Bodies of 1378 FDP on 02/08/2010;

has decreed:

Article (1)

A summary court called the Tripoli Summary Traffic Court shall be established. This Court shall have its headquarters in the city of Tripoli and be affiliated to the South Tripoli Court of First Instance. The Court shall hold jurisdiction to rule on cases related to violations of traffic provisions and rules on public roads located within the jurisdiction of the North, South, and East Tripoli Courts of First Instance.

Article (2)

The indictment chamber at the East Tripoli Court of First Instance shall hear cases related to the offences set out in the preceding Article referred to it from the South Tripoli First Instance Prosecution.

Article (3)

A summary prosecution called the Tripoli Summary Traffic Prosecution shall be established within the jurisdiction of the Tripoli Summary Traffic Court set out in Article (1). This Prosecution shall be affiliated to the South Tripoli Court of First Instance and shall have its headquarters in the city of Tripoli. The Prosecution shall hold competence to investigate and file criminal cases on incidents related to violations of the traffic provisions and rules on public roads located within the jurisdiction of the aforementioned Court.

Article (4)

Decree No. (51) of 2010 AD on establishing summary traffic courts and prosecutions shall be repealed, and any provision conflicting with those of this Decree shall also be repealed.

Article (5)

The competent bodies shall implement this Decree, and it shall enter into force on the date of its issue. This Decree shall be published in the Procedures Register.
