Decree No. (281) of 1994 on the permits of police force members

 

The General People’s Committee for Justice and Public Security

Decree No. (281) of 1423 FBP on the Leaves of Police Members

 

Upon review of:

● Law No. (10) of 1992 AD on the Security and Police, as amended; and

● The minutes of the first meeting of the General People’s Committee for Justice and Public Security in 1423 FBP,

 

The General People’s Committee for Justice and Public Security has decreed the following:

 

Article (1)

 

Police members shall be entitled to leaves depending on the conditions and best interests of work, taking into account the requirements for each leave as set out in the law and the provisions contained herein.

 

Article (2)

The authority to grant leaves shall rest with:

1. The Undersecretary for Security Affairs, who shall have the authority to grant all kinds of leaves to district security directors and directors of general directorates.

2. District security directors and directors of general directorates, who shall have the authority to grant all kinds of leaves to heads of departments and police stations as well as their staff.

 

Article (3)

Annual leaves shall be granted in the form prescribed for such purpose. A police member’s annual leave may be postponed or interrupted only for a necessity required by work interest.

The annual leave may not be waived by a police member. In all cases, a police member must enjoy an annual leave of at least 15 days per a leave year.

 

Article (4)

As detailed in Article (2), the person in charge of granting annual leaves shall take measures to maintain the leave in case a leave request is rejected or a leave is interrupted. This shall not exceed the period prescribed in Article (56) Para. (2) of Law No. (10/92) on Security and Police.

 

Article (5)

A casual leave shall be three days at a time with a maximum of twelve days per year. It shall be granted subject to the discretion of the line manager based on the application furnished by the applicant.

 

Article (6)

A police member shall be entitled to a fully-paid special leave for the performance of Hajj (pilgrimage) once throughout their service. Such leave shall be given by the body in charge of granting annual leaves.

 

Article (7)

Subject to the provisions of Article (34) of Law No. (10/92) on Security and Police, a police member may get a special leave without pay, pursuant to the provisions of Article (72) of Law No. (55 of 76) on the Civil Service.

 

Article (8)

Subject to the provisions of Article (98) of Law No. (10/92) on Security and Police, a sick leave shall be granted to a police member, in the form prescribed for such purpose, based on a medical report by a competent doctor identifying the sickness and treatment duration. The provisions of Article (70) of Law No. (55/76) on the Civil Service shall apply to sick leaves.

 

Article (9)

A study leave may be granted to a police member in accordance with the provisions of the Civil Service Law and regulations issued thereunder.

 

Article (10)

A percentage of no more than (10%) of employees in each administrative unit shall be maintained when granting annual leaves and special leaves without pay. The General Directorate for Administrative and Financial Affairs shall be provided with a copy of each form of a leave granted to a police member upon approval, and a copy of the same shall be kept in the member’s subfolder.

 

Article (11)

This Decree shall enter into force as of the date of its issuance and shall be implemented by the competent entities and published in the official gazette.
