The General Secretariat of the Basic People’s Congresses

Upon review of:

  • Law No. (1) of 1369 on People’s Congresses and People’s Committees, and its executive regulation;
  • Law No. (17) of 1369 FDP on organising the Legal Register;
  • General People’s Congresses Resolution No. (16) of 1369 FDP on organising the Legal Register and Code of Procedure;
  • The minutes of the General Secretariat of the Basic People’s Congress Session No. (1) of 1370 FDP held on 2 June 1370 FDP.

has decreed:

Article (1)

In accordance with the provisions of this decree, a code shall be established called the Code of Procedure, which shall be issued in the Arabic language.

Article (2)

The follow material shall be published in the Code of Procedure:

  1. Organisational decisions issued by the General Secretariat of Basic People’s Congresses, the Secretariat of the People’s Congresses for Districts, and the Secretariat of the General People’s Congress, in which it is stipulated that they shall be published in the Code of Procedure.
  2. Organisational decisions issued by the General Secretariat of the Basic People’s Congresses, their Secretariats, General People’s Committees for Districts, and General People’s Committees for Sectors and their Secretariats.
  3. Decrees and materials specified by a decision by the Secretariat of the Basic People’s Congress.

Article (3)

  1. The materials prepared for publication shall be sent to Legal Affairs and Human Rights in the Secretariat of the Basic People’s Congress, which shall be responsible for compiling the same in a special register by date of receipt.
  2. Publication in the Code of Procedure shall be effected by an order from the Secretary of Legal Affairs and Human Rights in the Secretariat of the General People’s Congress.
  3. The pages of the Code shall be number in sequential order continuously from the start until the end of the year. The page number and volume number of the Code shall be mentioned at the top of every page.

Article (4)

Each volume of the Code shall indicate its date of issuance. Such date shall not be prior or subsequent to the actual date of issuance of the volume.

At the beginning of each volume of the Code, an index shall be published including the page number, text number, date and subject matter of each text published therein.

Article (5)

If tables, documents, or information are appended to the decisions, they shall be published in full in the Code.

The original copies of the materials shall be retained after publication in the Code in a specific file for each volume of the Code, according to the order of publication.

Article (6)

Legal Affairs and Human Rights in the Secretariat of the General People’s Congress shall be responsible for distributing the volumes of the Code to the relevant bodies in return for a consideration or for free. It shall also determine the circulation price thereof and the cost of subscription thereto.

Volumes of the Code of Procedure that are issued in accordance with the provisions of this decree shall be deemed proof of their contents without need for any other evidence.

Article (7)

Any provision contrary to the provisions of this decree shall be repealed.

Article (8)

This decree shall enter into force from its date of issuance, and it shall be published in the Legal Register.
