The Secretariat of the General People’s Congress

Upon review of:

  • Law No. (1) of 1369 FDP on People’s Congresses and People’s Committees;
  • Law No. (10) of 1423 FBP on purification;
  • Law No. (11) of 1425 FBP on re-organising popular oversight, amended by Law No. (30) of 1369 FDP, and its executive regulation;
  • Law No. (13) of 1371 FDP on adopting certain provisions concerning inspection, popular oversight, and purification;
  • Law No. (12) of 1371 FDP adding a provision to Law No. (1) of 1369 on People’s Congresses and People’s Committees;
  • General People’s Congress Resolution No. (6) of 1374 FDP on re-organising the General People’s Committee for Inspection and Popular Oversight;
  • General People’s Congress Resolution No. (7) of 1374 FDP on tasking the Secretariat of the General People’s Congress to select general inspectors;
  • Secretariat of the General People’s Congress Decree No. (42) of 1372 FDP on work regulations for General Inspectors of Sectors;
  • Secretariat of the General People’s Congress Decree No. (29) of 1374 FDP selecting general inspectors;
  • The session of the General People’s Congress No. (13) of 1374 FDP;

has decreed:

Article (1)

General Inspectors for Sectors shall be subordinate to the General People’s Committee for Inspection and Popular Oversight, and they shall exercise their competencies through said Committee and be members of the Secretariat thereof.

Article (2)

General Inspectors, each within their competence, shall be responsible for inspection and follow-up on the sectors with which they are entrusted in order to examine the implementation of general policies, adherence to the legislation in force, and workers’ attainment of the prescribed level of performance, and to alert to any deficiency or neglect. In particular, they possess the following competencies:

  1. Follow up on the execution of the instructions of the Brotherly Leader of the Revolution, the decisions of the Basic People’s Congresses, and the legislation regulating the work of the sector.
  2. Follow up on the execution of the general policies of the sector to which he is assigned.
  3. Inspect and follow up on the activities of the Secretariat of the General People’s Committee for the sector to which he is assigned in order to verify its commitment to achieving objectives and aims.
  4. Inspect and follow up on the activities of the People’s Committees for sectors in the districts in order to verify their adherence to the legislation in force.
  5. Inspect and follow up on the activities of public bodies, institutions, agencies and companies in the sector, and private-sector companies and institutions, in order to verify their adherence to the legislation in force and their attainment of the aims for which they were established.
  6. Study and examine the minutes of meetings of the sector and the decisions of the People’s Committee for the Sector and its Secretariat.
  7. Follow up on the execution of transformation and steering budgets for the sector.
  8. Monitor the performance of workers in the sector, and propose means to develop their capacities and increase their efficiency.
  9. Identify violations and infractions, and refer the same to the competent body to take the necessary measures.

10. Prepare quarterly reports on the activities and works of the sector, and refer the same to the General People’s Committee for Inspection and Popular Oversight.

11. Provide an opinion on sectoral matters that are presented to them.

Article (3)

In order to perform their competencies, General Inspectors may:

  1. Conduct field visits to components of the Sector in order to verify their performance of their duties.
  2. Coordinate with the competent departments in the General People’s Committee for Inspection and Popular Oversight in order to conduct accurate inspections and effective oversight.
  3. Seek to halt execution of any decision in the sector, if it is proven to be in violation of the legislation in force.
  4. Seek to refer to investigation anyone who is discovered to have committed violations or infractions.
  5. Propose to suspend employees of the sector from work, if they are proven to have committed legal violations.
  6. Seek any information or data from the sector, and examine documents and records pertaining to the performance of the sector.
  7. Present matters pertaining to the work of the sector to the Secretary of the General People’s Committee for Inspection and Popular Oversight, and propose to include matters relevant to the sector in the agenda of the Secretariat of the General People’s Committee for Inspection and Popular Oversight.
  8. Follow up on the correction of violations committed by workers in the sector.
  9. Study the causes of deficiency, neglect or administrative negligence in the sector, and propose remedies.

Article (4)

The General Planning Council, the Planning Councils in the districts, and the relevant sectors shall provide the competent General Inspector with draft plans and programs pertaining to the sector, in order to provide observations and proposals thereon.

Article (5)

General Inspectors shall be granted the capacity of judicial officers to execute this decree and the legislation regulating the professional affairs of workers in the General People’s Committee for Inspection and Popular Oversight shall apply to them.

Article (6)

The aforementioned Secretariat of the General People’s Congress Decree No. (42) of 1372 FDP on work regulations for general inspectors of sectors shall be repealed.

Article (7)

This decree shall enter into force from its date of issuance, and it shall be published in the Legal Register.
