Decree No. (10) of 1998 AD, on Amending Certain Provisions of

Decree No. (3) of 1428 FBP

 

The Supreme Council of Judicial Bodies,
Upon review of:

  • The Judicial System Law issued by Law No. (51) of 76 AD;
  • The Penal and Criminal Procedure Code;
  • Decree No. (3) of 28 AD by the Supreme Council of Judicial Bodies on Establishing specialized Courts and Prosecutions; and
  • The submission of the Chairman of the Supreme Council of Judicial Bodies in the Council’s 4th Meeting of 1428 AD held on 05/11/28 FBP,

 

has decreed the following:

Article (1) 

The first paragraph of Articles 1 and 2 of Decree No. 3 of 28 AD of the Supreme Council of Judicial Bodies shall be amended to read as follows: 

(Article 1, Para A) 

  • A specialized appeal court shall be established and assigned the competence to determine upon the cases referred thereto by the indictments chamber of the specialized court of first instance. Such court shall be headquartered in Tripoli and shall be assigned the same jurisdiction of Tripoli, Misrata, Benghazi and Al Jabal Al Akhdar appeal courts. 

(Article 2, Para A)

– A specialized court of first instance shall be established and assigned the competence to determine upon the cases referred thereto by the specialized plenary prosecution. Such court shall be headquartered in Tripoli and shall be assigned the same jurisdiction of the courts of first instance located within the jurisdiction of Tripoli, Misurata, Benghazi and Al Jabal Al Akhdar appeal courts.

 

Article (2) 

This Decree shall enter into effect as of the date of its issuance and shall be published in the official gazette.
