Decision No. (83) of 2010 amending Decision No. (22) of 2008 on the internal regulation of the Judicial Body Inspection Department

Decree No. (83) of 1378 FDP (2010 AD)

amending Decree No. (22) of 2008 AD

on the internal regulation of the Judicial Body Inspection Department

The Supreme Council of Judicial Bodies,

Upon review of:

  • Law No. (6) of 1374 FDP (2006 AD) on the judicial system;
  • Law No. (11) of 1988 AD on socialist real estate registration;
  • Law No. (12) of 1988 AD on the Socialist Real Estate Registration and Documentation Authority;
  • Law No. (2) of 1993 AD on notaries;
  • Law No. (5) of 1993 AD amending certain provisions of Law No. (2) of 1993 AD on notaries;
  • Council Decree No. (4) of 2008 AD on the judicial inspection regulations;
  • Council President Decree No. (22) of 2008 AD on the internal regulation of the Judicial Body Inspection Department;
  • The minutes of the sixth meeting of the Supreme Council for Judicial Bodies of 1378 FDP dated 19/7/2010 AD;

has decreed:

Article (1)

Article (2) of Council President Decree No. (22) of 2008 AD on the internal regulation of the Judicial Body Inspection Department shall be amended to read as follows:

The organisational structure of the Inspection Department shall consist of:

  • Office of the Department Head
  • Office of the Department Deputy
  • Judicial Body Member Affairs Division
  • Judicial Inspection Division
  • Administrative and Clerical Inspection Division
  • Notary Activities Monitoring Division
  • Information, Documentation, and Statistics Division
  • Administrative Affairs Division

Article (2)

A new article shall be added to Council President Decree No. (22) of 2008 AD on the internal regulation of the Judicial Body and Branches thereof Inspection Department that shall read as follows:

Article (7) (bis)

The Notary Activities Monitoring Division, which shall undertake the following:

  1. Prepare an inventory of all notaries and of their assistants.
  2. Open personal files for notaries and notary assistants in which a copy of their registration, transfer, disciplinary decisions, and correspondence relating to their affairs shall be placed.
  3. Receive, review, and keep the documents and authentications made by notaries that the law requires be provided to the Administration each month.
  4. Track, monitor, and inspect the activities of notaries.

Article (3)

This Decree shall enter into force on the date of its issue and shall be published in the Procedures Register.
