Decree No. (117) of 1993 on amending certain provisions of Law No. (16) of 1984 on establishing the General Post and Telecommunications Company

Decree No. (117) of 1993 AD

Amending Certain Provisions of Law

No. (16) of 1984 AD on the Establishment of

the General Post and

Telecommunications Company

 

The General People’s Committee,
Upon review of:

  • Law No. (16) of 1984 AD on Establishing

the General Post and Telecommunications Company; and

 

  • Law No. (16) of 1991 AD on Assigning Certain Functions

to the General People’s Committee, and

  • Based on the submission of the Secretary of the General People’s Committee for Utilities, Tourism and Transportation

in his Letter No. (57-16-4369-105) dated 21 Jumada Al-Akhar 1402 FDP, corresponding to

16 December 1992 AD,

has decreed the following:

 

Article (1)

In accordance with the functions assigned to the General People’s Committee under Law No. (16) of 1991 AD referenced above, Article (20) of Law No. (16) of 1984 AD on Establishing the General Post and Telecommunications Company shall be amended to read as follows:

Article 20:

“All fixed and movable assets related to postal and telecommunication services, that had been managed by the Secretariat of the General People’s Committee for Transportation and Maritime Transport and the People’s Committees for Transportation and Maritime Transport (formerly) in municipalities, shall be transferred to the Company. This shall include appropriations and allocations in the budgets related to the telecommunications activity.

The Company shall replace the aforementioned bodies in their rights and obligations, within the limits of such transfer thereto.

Telecommunications systems shall be transferred to the Company as an investment. The Company shall undertake the operation and maintenance of such systems, and they shall be evaluated to identify the size and returns of investment. The systems shall remain the property of the General People’s Committee for Utilities, Tourism and Transportation, and newly developed systems shall be treated according to this rule.”

 

Article (2)

This Decree shall enter into force as of the date of its issuance and shall be published in the official gazette.
