Cabinet Decree No. (166) of 2013 on approving the delegation of members of the Veterans Affairs Commission to study abroad and adopting some provisions concerning them

The Cabinet

Upon review of:

  • The Constitutional Declaration and the amendments thereof;
  • Law No. (18) of 2010 on education
  • Law No. (12) of 2010 on issuing the Labour Relations Law and the executive regulation thereof;
  • Former General People’s Committee Decision No. (501) of 2010 on organising higher education;
  • The National Transitional Council’s executive office Resolution No. (60) of 2011 on establishing a Veterans Affairs Council;
  • General National Congress Resolution No. (9) of 2012 on appointing a prime minister and tasking him with forming an interim government;
  • General National Congress Resolution No. (10) of 2012 on granting confidence to the transitional government;
  • Former General People’s Committee Decision No. (43) of 2005 on the bylaws of deployment for study domestically and abroad and the amendments thereof;
  • Director General of the Veterans Affairs Commission Letter No. (M/238) dated 7 April 2013;
  • Secretary of Cabinet Affairs Letter No. (1193) dated 11 April 2012;
  • The requirements of the public interest and the necessary extraordinary measures to accommodate revolutionaries;
  • The decisions of the Cabinet in its thirteenth ordinary meeting held on 10 April 2013;

has decreed:

Article (1)

Eighteen-thousand (18,000) members of the Veterans Affairs Council shall be approved to be sent to complete their higher education abroad to obtain a master’s and doctoral degree in applied and scientific fields to meet the needs for building Libya. Their delegation shall occur according to the following:

  • The first group shall comprise 5,000 students during the year 2013.
  • The second group shall comprise 4,000 students during the year 2014.
  • The third group shall comprise 4,500 students during the year 2015.
  • The fourth group shall comprise 4,500 students during the year 2016.

Article (2)

Delegates from the Veterans Affairs Commission shall be exempted from the age requirement prescribed in Article (9) of Decision No. (43) of 2005 on delegation for study domestically and abroad. The age of the delegate shall be specified according to the provisions of this decree at forty-five (45) to obtain a master’s degree and fifty (50) to obtain a doctoral degree.

Article (3)

The period of delegation for a master’s degree shall be thirty-six (36) months, and for a doctoral degree forty-eight (48) months.

Article (4)

The Ministry of Higher Education shall assume all expenses incurred in the execution of this decree.

Article (5)

The provisions of the studying domestically and abroad bylaw that pertain to anything not present in this decree shall be applicable to the delegate.

Article (6)

This decree shall enter into force from its date of issuance, all concerned parties shall execute it, and it shall be published in the Official Gazette.
