on dissolving the compensation fund

for the families of martyrs, the wounded and the missing of the February 17 Revolution

The Cabinet:

Upon review of:

  • The Constitutional Declaration;
  • The Law of the Financial System of the State, and budget, accounts and warehouse regulation, and the amendments thereof;
  • Law No. (12) of 2010 on issuing the Labour Relations Law and the executive regulation thereof;
  • Interim National Transitional Council Resolution No. (174) of 2011 on determining the structure of the interim government;
  • Interim National Transitional Council Resolution No. (184) of 2011 on approving the interim government;
  • Former General People’s Committee Decree No. (148) of 2009 on establishing the Charity Contributions Fund;
  • Executive Office Resolution No. (62) of 2011 on reorganising the compensation fund for the families of martyrs, the wounded and the missing;
  • Cabinet Decree No. (28) of 2012 on organising the Administrative Unit of the Ministry for the Compensation of Families of Martyrs and the Missing;
  • Cabinet Decree No. (174) of 2012 on withdrawing two decrees and adopted a provision;
  • Financial and Petroleum Affairs Officer Decision No. (3) of 2011 on the establishment of the compensation fund for the families of martyrs, the wounded and the missing of the February 17 Revolution;
  • Minister of Compensation for Families of Martyrs and the Missing Letter No. (367) of 23/02/2012;
  • The decision of the Cabinet in its 9th and 15th ordinary sessions of 2012;

has decreed:

Article (1)

The said Compensation Fund for Families of Martyrs, the wounded and the missing of the February 17 Revolution, established by Decree No. (3) of 2011, shall be dissolved. All of its assets, properties, balances and competencies related to the affairs of the prisoners and the missing shall revert to the Ministry for the Compensation of Families of Martyrs and the Missing. Employees of the dissolved fund shall also be transferred thereto under the same professional and financial circumstances.

The assets, holdings, properties and balances of the Charity Contributions Fund as well as employees thereof shall be exempt from the provisions of the preceding paragraph.

Article (2)

A committee shall be formed by virtue of a decree issued by the Minister of Compensation for Families of Martyrs and the Missing. The committee shall be responsible for the implementation of the provisions of this decree. It shall have a representative from the Ministry of Finance as one of its members, who shall be responsible for approving the results thereof.

Article (3)

This decree shall enter into effect from its date of issuance. The competent authorities shall implement it and it shall be published in the Official Gazette.
