on organising the Secretariat

of the General People’s Committee for Justice and Public Security

The General People’s Committee,

Upon review of:

  • Law of the financial system of the state, and the amendments thereof;
  • Law No. (11) of 1971 on civil defence;
  • Law No. (87) of 1971 on the State Lawsuits Authority;
  • The justice system law issued by Law No. (51) of 1976 and the amendments thereof;
  • The civil service law issued by Law No. (55) of 1976;
  • Law No. (21) of 1977 on establishing the Public Safety Commodity Importing Company;
  • Law No. (75) of 1976 on the Jamahiriya Security Organization;
  • Law No. (4) of 1981 on establishing the Department of People’s Legal Defence;
  • Law No. (15) of 1981 on the salary system of national employees in the Great Socialist People’s Libyan Arab Jamahiriya;
  • Law No. (4) of 1985 on travel documents;
  • Law No. (12) of 1988 on the Department of Socialist Real Estate Registration & Authentication;

  • General People’s Committee Decree No. (417) of 1987 on establishing the Internal Security Agency, and the amendments thereof;
  • General People’s Committee Decree No. (772) of 1989 on establishing sectorial centres for information and documentation;
  • General People’s Committee Decree No. (1160) of 1990 on reorganising the Secretariat of Justice, and the amendments thereof;
  • General People’s Committee Decree No. (1186) of 1990 on establishing the Public Facility and Establishment Security Authority;
  • General People’s Committee Decree No. (158) of 1991 on establishing a general directorate of judicial police, and the amendments thereof;
  • General People’s Committee Decree No. (933) of 1991 on establishing the police academy and its regulations;
  • General People’s Committee Decree No. (383) of 1992 on establishing the General Department for the Protection of Morals and Tourist Facilities;
  • The proposal of the Chairman of the General People’s Committee for Justice and Public Security;
  • The approval granted by the General People’s Committee during its 18th ordinary session of 1992;

has decreed:

Article (1)

The General People’s Committee for Justice and Public Security shall propose, implement, monitor, track the outcome of, and assess the general policies pertaining to justice and public security in accordance with the resolutions of Basic People’s Congresses.

Article (2)

The General People’s Committee for Justice and Public Security shall draft the necessary plans and programs to implement the general sector policy in accordance with the resolutions of Basic People’s Congresses. In particular, the General People’s Committee for Justice and Public Security shall:

  1. Protect the Jamahiriyan people-based regime by taking all the necessary measures and procedures in this regard.
  2. Draft plans and conduct executive programs to maintain security, public order, and morals, and to protect lives, honour, and properties.
  3. Monitor and follow up on hostile activities and monitor foreign entities in the country and abroad.
  4. Draft plans and the necessary practical programs for their implementation in accordance with the General People’s Committee for Justice and Public Security’s targets related to the prevention and proactive deterrence of crimes, and take the necessary judicial procedures in this regard.
  5. Draft the plans and programs for the implementation of the legislation on local people’s security, and follow up on the same.
  6. Produce draft laws, regulations, and resolutions, and offer legal counsel to public entities.
  7. Defend the interests of the State and individuals before courts and judicial bodies in the country and abroad.
  8. Conduct research and studies, analyse statistics to deduce results and thereupon propose and determine the policy aspects and general plans in its fields of work, and oversee their executing activities.
  9. Handle affairs pertaining to judicial expertise, criminal investigation, and identity verification.
  10. Handle affairs pertaining to public road traffic, civil defence, rescue, communication, coast guard, and police aircraft.
  11. Execute court orders, announcements, and notices issued by courts, prosecutions, prison administrations, and reform and rehabilitation institutions.
  12. Handle affairs of passports, citizenship, ID cards, foreigners’ residence, and control entry and exit through designated ports.
  13. Handle socialist real estate registration and documentation.
  14. Assume administrative and financial oversight of courts, prosecutions, and other judicial bodies in accordance with the law.
  15. Train and qualify the members of judicial and security bodies and the volunteers of local people’s security in coordination with the concerned entities.
  16. Handle affairs of marriage registrars, appoint and oversee the same, and disburse their remunerations.
  17. Guard public facilities and establishments and vital targets in accordance with the relevant legislation.
  18. Introduce citizens to the culture of local people’s security, raise security awareness, and hold local forums and gatherings for this purpose through various media outlets.
  19. Oversee and inspect the work of affiliated entities, and monitor the performance of their duties in accordance with the law.

Article (3)

The Secretariat of the General People’s Committee for Justice and Public Security shall have an undersecretary for judicial and legal affairs, and an undersecretary for security affairs. Each undersecretary shall exercise the functions prescribed for undersecretaries in the legislation in force.

Each undersecretary shall assist the Secretary in his duties within the limits of their assigned mandate.

Each undersecretary, within his mandate, shall oversee the work progress at the Secretariat under the direct supervision of the chairman.

Pursuant to Article (17) of General People’s Committee Decree No. (17) of 1997 on establishing the Department of Travel Documents, Citizenship, and Foreigners’ Affairs:

Article (4)

First: The organisational structure of the Secretariat of the General People’s Committee for Justice and Public Security shall be composed of the following:

  1. Judicial bodies.
  2. General Department for the Affairs of Judicial Bodies
  3. General Department for Judicial Police.
  4. General Department for Local People’s Security.
  5. Repealed.
  6. General Directorate of Criminal Investigation.
  7. General Department for Civil Defence.
  8. General Department for Traffic, Rescue, and Central Support.
  9. General Department for Combating Crimes of Narcotics and Psychotropic Substances.
  10. General Department for the Protection of Tourism Facilities.
  11. General Department for Inspection and Control.
  12. General Department for Administrative and Financial Affairs.
  13. General Department for Relations and Cooperation.
  14. General Training Department.
  15. Committee Affairs Office.
  16. Legal Office.
  17. Arab and International Criminal Police Office.

Second: The following entities shall be affiliated with the Secretariat of the General People’s Committee for Justice and Public Security:

  1. Office of the Chief Prosecutor
  2. Internal Security Agency.
  3. External Security Agency.
  4. Department of Socialist Real Estate Registration & Authentication.
  5. Public Facility and Establishment Security Authority.
  6. Police Academy.
  7. Judicial Institute.
  8. Judicial Research Centre.
  9. Information and Documentation Centre.

Each entity shall exercise its duties in accordance with its regulating legislation.

Article (5)

The Secretariat of the General People’s Committee for Justice and Public Security shall oversee the companies affiliated therewith.

The general assemblies of society-owned companies shall be established by a resolution issued by the Secretary of the General People’s Committee for Justice and Public Security. The general assembly of each company shall be composed of at least five members including the chairman and a financially specialised representative of the Secretariat of the General People’s Committee for Planning, Trade, and Finance. Any member who is nominated to the general assembly shall have experience and competence shall be of grade 11 and above.

Article (6)

Judicial bodies shall include courts, prosecutions, the Judicial Body Inspection Department, the State Lawsuits Authority, the Department of People’s Legal Defence, and the Law Department. Such bodies shall exercise their functions in accordance with their regulating legislation.

Article (7)

The General Department for the Affairs of Judicial Bodies shall exercise the following functions:

  1. Organise and keep the personal files and career cards of the members of judicial bodies, in addition to seniority tables.
  2. Conduct administrative and clerical inspection of the employees of courts, prosecutions, and other judicial bodies.
  3. Assess the judicial bodies’ requirements of offices, furniture, work supplies and tools, and manpower, provide the same in coordination with the competent entities, and submit the necessary reports relating to the Department’s mandate.
  4. Handle affairs of marriage registrars, assume their appointment procedures, execute the decision issued in their regard, disburse their remuneration, and keep their files without prejudice to the related competencies of courts.
  5. Oversee affairs of traffic, means of transportation, and warehouses of judicial bodies.

Article (8)

The General Department for Judicial Police shall exercise the following functions:

  1. Execute court orders, announcements, and notices issued by courts and prosecutions.
  2. Execute the arrest warrants of persons sentenced to freedom-restricting penalties, and place them in the custody of reform and rehabilitation institutions.
  3. Execute hudud orders in accordance with the relevant procedures.
  4. Execute courts and prosecutions’ summons of prisoners.
  5. Guard the premises of judicial bodies and ensure the safety of their members.
  6. Maintain order and security on judicial bodies’ premises and prevent any disruption to their hearings or to the work of their members.
  7. Secure the means of transportation of judges and members of the public prosecution during investigation and examination duties.
  8. Handle affairs of reform and rehabilitation institutions, oversee such institutions, collect data and statistics related thereto, and submit the necessary reports thereon.
  9. Oversee the work of ushers and monitor their performance without prejudice to the provisions of the Code of Civil and Commercial Procedure.
  10. Perform any other duty assigned thereto or falling under its jurisdiction by virtue of the legislation in force.

The General Department for Judicial Police shall have branches and offices. The organisation, mode of operation, and oversight mechanism of such branches and offices shall be determined in a resolution by the Secretary of the General People’s Committee for Justice and Public Security.

They shall be managed by a member of judicial bodies who shall be appointed by a resolution issued by the Secretary of the General People’s Committee for Justice and Public Security.

Article (9)

The General Department for Local People’s Security shall exercise the following functions:

  1. Keep count of Local People’s Security volunteers, monitor their affairs, collect data thereon, and produce a central manual thereon.
  2. Propose the necessary practical plans, rules, and parameters for the successful implementation of Local People’s Security programs.
  3. Coordinate between the branches of Local People’s Security, overcome the technical and organisational obstacles to the performance of their duties, monitor their work, and submit periodical reports thereon.
  4. Propose training and rehabilitation plans for Local People’s Security volunteers and boost their competency to ensure improved performance.
  5. Contribute to mobilisation and guidance programs to incite citizens to join Local People’s Security.
  6. Propose the necessary amendments to the existing legislation that govern Local People’s Security to ensure their proper comprehensive application.

Pursuant to Article (17) of General People’s Committee Decree No. (17) of 1997 on establishing the Department of Travel Documents, Citizenship, and Foreigners’ Affairs:

Article (10)

Repealed.

Article (11)

The General Directorate of Criminal Investigation shall exercise the following functions:

  1. Propose security plans pertaining to crime prevention and deterrence and the fight against crimes in coordination with the concerned entities.
  2. Handle the planning of technical criminal investigation activities, and provide and develop the necessary tools and equipment to improve the professional performance methods of technical activities in the field of criminal investigation.
  3. Handle affairs of criminal evidence and the necessary evidence activities for judicial control.
  4. Handle affairs related to identity verification.
  5. Protect public morals in public places, coffee shops, restaurants, theatres, and other public or publicly used places, and enforce the relevant legislation.
  6. Receive reports and complaints related to public morals crimes.
  7. Collect criminal statistics and receive daily reports on major crimes and critical incidents, and prepare a special daily bulletin thereon.
  8. Conduct inquiries and collect evidence in critical and important criminal cases as assigned by the Secretary or Undersecretary for Security Affairs.
  9. Count and classify dangerous criminals, their tendencies, and their criminal methods, monitor their activity, and prepare a manual thereon.
  10. Conduct research and studies related to crime causes and prevention methods.

Article (12)

The General Department for Civil Defence shall exercise the functions set forth in the aforementioned Law No. (11) of 1971 on civil defence. It shall exercise any other functions assigned thereto or falling under its jurisdiction by virtue of the legislation in force.

Article (13)

The General Department for Traffic, Rescue, and Central Support shall exercise the following functions:

  1. Propose the necessary plans to implement traffic rules and regulations on public roads, and handle road planning and traffic signs in accordance with the laws and regulations issued in this regard.
  2. Regulate the procedures pertaining to vehicles, driver’s licence, movement permits, and registration plates, and standardise the applicable procedure for the acquisition, renewal, and cancellation of such licences, which includes producing the relevant designs and the standardised templates used in this regard.
  3. Conduct central traffic patrols on highways and coastal roads outside urban areas, ensure contact therewith, and follow up on the security situation.
  4. Conduct central rescue patrols and perform coast guard duties and desert patrols in coordination with the competent entities.
  5. Perform the activities pertaining to police aircraft and boats.
  6. Support other security units with manpower and any other necessary capabilities to cover any security shortcoming across the Great Jamahiriya.
  7. Conduct search, inquiry, and data gathering on infiltrators into the Great Jamahiriya, combat infiltration, and take the legal procedures for their deportation.
  8. Handle secure (coded) communication activities.
  9. Build, coordinate, maintain, and monitor telecommunications system across the Great Jamahiriya.
  10. Manage a central security operations room.

Article (14)

The General Department for Combating Crimes of Narcotics and Psychotropic Substances shall exercise the following functions:

  1. Propose general and detailed plans to combat the crimes of narcotics and psychotropic substances in the Great Jamahiriya.
  2. Examine the smuggling of narcotics and psychotropic substances into the Great Jamahiriya, identify the sources and methods thereof and the groups, entities, individuals, or organizations suspected of such act.
  3. Apply preventive and positive security measures to prevent the entry of narcotics and psychotropic substances into the Great Jamahiriya, and prohibit their culture, trade, consumption, or use for other than the cases authorised by law.
  4. Examine ways of using bilateral, regional, and international agreements on combating the illegal use of narcotics and psychotropic substances, and use the information available with international organisations, agencies, and institutions pertaining to narcotics and psychotropic substances, their sources, and their trafficking methods.
  5. Gather information on narcotic and psychotropic substance users and dangerous criminals with precedents in the smuggling or trafficking of such substances, record comprehensive data thereon, and propose the necessary methods for dealing with such phenomena.
  6. Handle the technical methods and media used to detect narcotics and psychotropic substances.
  7. Draft awareness programs to highlight the danger of this affliction in coordination with the other concerned entities.
  8. Conduct research, seminars, and relevant cultural activities, and use their outcome to increase efficiency and personnel knowledge.
  9. Perform any other duty assigned thereto or falling under its jurisdiction by virtue of the legislation in force.

Article (15)

The General Department for the Protection of Tourism Facilities shall exercise the following functions:

  1. Provide the necessary protection for tourists, protect and secure tourism facilities, possessions, and archaeological sites.
  2. Escort group tourism convoys inside the Great Jamahiriya and provide them with the necessary protection.

Article (16)

The General Department for Inspection and Control shall exercise the following functions:

  1. Monitor the execution of Basic People’s Congresses’ resolutions pertaining to the sector, and produce the necessary reports thereon.
  2. Monitor the enforcement of sector-related legislation and the execution of the decisions and orders issued by the Committee or its secretary, examine their implementation by the Secretariat-affiliated entities, and produce the necessary reports thereon.
  3. Ensure the safe use of vehicles during designated official events, and produce periodical reports thereon.
  4. Investigate complaints against police members for acts committed on duty and submit the results of such investigation to the Secretary or Undersecretary for Security Affairs.
  5. Conduct periodical and spot inspections of the security services affiliated with the Secretariat to examine work progress therein and the diligence of their employees in performing their duties and maintaining bearing.
  6. Inspect civil defence headquarters and equipment.
  7. Monitor the execution of standing orders.

Article (17)

The General Department for Administrative and Financial Affairs shall exercise the following functions:

  1. Handle the service affairs of the General People’s Committee for Justice and Public Security Secretariat personnel, which includes determining the Secretariat’s needs for employees of various specialisations, regulating the full-time staff, organising and classifying positions on a yearly basis, taking procedures pertaining to appointment, promotion, transfer, secondment and reassignment and other professional matters related to personnel, in accordance with the legislation governing professional affairs.
  2. Organise and monitor the attendance and departure of the Secretariat’s Bureau personnel, prepare daily shift schedules, oversee compliance therewith and follow up thereon, and report any neglect in this regard.
  3. Maintain the personal files of the Secretariat personnel as well as the full staff and seniority registers, and career cards.
  4. Prepare the meetings of the staff committee and the disciplinary board, handle its secretariat affairs, and take necessary action to implement their decisions.
  5. Prepare the Secretariat’s budget estimates, and keep the relevant necessary records.
  6. Prepare payrolls and other benefits and carry out their disbursement procedures.
  7. Undertake affairs related to contracts, procurement, warehouses, supply, operations, vehicles, and the maintenance of the Secretariat’s buildings.
  8. Receive the proposals of other departments regarding work requirements of personnel, missions, and other supplies, compile and present the same in a proposal to work on their fulfilment.
  9. Handle the Secretariat’s archiving affairs, including receiving incoming letters and memoranda, transferring outgoing correspondence and letters, and recording the same in their designated register.
  10. Assess the Secretariat’s needs for vehicles and machinery, draft the necessary plans for their provision, and propose the necessary procedures and controls for their proper distribution.
  11. Handle the examination and review of all financial and accounting affairs related to the Secretariat, its revenues and expenditures, and ensure proper application in accordance with the law.
  12. Conduct studies related to the Secretariat’s projects and transformation budget.
  13. Perform any other duty falling under its jurisdiction or assigned thereto by virtue of the legislation in force.

Article (18)

The General Department for Relations and Cooperation shall exercise the following functions:

  1. Make the necessary arrangements to receive guests, organise their meetings in coordination with the competent departments and offices, and carry out their procedures.
  2. Handle the public relations affairs of Secretariat personnel.
  3. Reinforce interpersonal relations between employees, identify and solve their problems.
  4. Organise social, cultural, and sports activities for employees, and prepare programs that contribute to participation in such activities in coordination with the competent entities.
  5. Introduce citizens to the culture of local people’s security, raise awareness among police officers, Local People’s Security volunteers, and other citizens on crime prevention and deterrence through various media outlets, seminars, and cultural gatherings.
  6. Promote the work of the Secretariat and its affiliated entities on the media.
  7. Follow up on any information or publication related to the Secretariat’s work or activities, submit a summary thereon to the Secretary, and execute the Secretary’s instructions in this regard.
  8. Provide the Secretariat with any specialised books, references, publications, magazines, and bulletins it requires in its fields of competence.
  9. Receive complaints and grievances and present the same to the Secretary with the necessary relevant notes.
  10. Monitor the implementation of bilateral, regional, and international agreements on justice and public security.
  11. Keep the reports of official delegations to international conferences and meetings, and monitor the execution of any procedure taken in their respect.
  12. Undertake the affairs of the Police Social Welfare Fund, clubs, shops, and the Justice Press.
  13. Undertake the procedures pertaining to the persons delegated on official missions inside and outside the country, and complete such procedures in coordination with the competent department.

Article (19)

The General Training Department shall exercise the following functions:

  1. Propose training and qualification plans for the members of the justice and security sector, and implement the same in coordination with the competent departments and other concerned entities.
  2. Propose the necessary training and qualification curricula and programs to increase the efficiency of personnel in this sector, and take the necessary procedures in this respect.
  3. Monitor affairs pertaining to sessions and scholarships of sector personnel inside and outside the country in coordination with the competent entities.
  4. Provide the means and needs of training and qualification in coordination with the competent department.
  5. Produce training and qualification statistics and data.
  6. Oversee training and qualification institutions affiliated with the Secretariat.
  7. Handle training and participate in various sports activities through the Police Sports Union.

Article (20)

The Committee Affairs Office shall exercise the following functions:

  1. Arrange the meetings of the General People’s Committee for Justice and Public Security, write down and register the minutes thereof, distribute its decrees, and monitor their implementation.
  2. Organise the Secretary’s meetings and calls, and collect the data and information requested by the Secretary.
  3. Handle the archives affairs related to mail and information of special or confidential nature.
  4. Receive the Secretary’s mail, transfer it to the Secretary, and follow up thereon.
  5. Prepare the meetings of committees chaired by the Secretary, record their minutes, and implement their decisions.

Article (21)

The Legal Office shall exercise the following functions:

  1. Prepare and review draft regulations, decisions, and legislation to be issued by the General People’s Committee for Justice and Public Security or related to its work.
  2. Provide legal opinion and counsel in matters proposed thereto.
  3. Follow up on lawsuits filed by or against the Secretariat in coordination with the State Lawsuits Authority.
  4. Draft and review contracts and agreements that are concluded by the Secretariat.
  5. Attend the meetings and committees assigned thereto.

Article (22)

The Arab and International Criminal Police Office shall exercise the following functions:

  1. Cooperate with Arab and international criminal police organisations in the fight against crimes and the apprehension of wanted persons.
  2. Conduct inquiries and collect evidence related to wanted persons with Arab and international criminal police offices, and arrest them.
  3. Cooperate with the competent entities regarding reception and extradition of criminals in accordance with the laws and bilateral, regional, and international agreements.
  4. Create and maintain files, cards, registers, and other records pertaining to international criminals.
  5. Participate in Arab and international conferences and conventions against crimes, prepare the data and studies related thereto, and benefit from the same.
  6. Perform any other duty entrusted thereto or falling under its jurisdiction in accordance with the legislation or agreements in force.

Article (23)

Service offices affiliated with the General People’s Committee for Justice and Public Security may be established in certain regions, in a transitional and provisional manner, by virtue of a decree by the General People’s Committee. Such offices shall provide the services falling under the Secretariat’s jurisdiction.

Article (24)

The internal regulation of the Secretariat shall be determined by a decree by the Secretary of the General People’s Committee for Justice and Public Security without contravening the provisions of the present decree.

Article (25)

The General People’s Committee Decree No. (1160) of 1990 on reorganising the Secretariat of Justice shall be repealed. Any other provision that contravenes the provisions of the present decree shall be repealed.

Article (26)

This decree shall enter into force from its date of issuance. It shall be published in the Official Gazette.
