Decree No. (238) of 1994 on organizing the administrative unit of the General People’s Committee

Decree No. (238) of 1423 FBP

on Organizing the Administrative Body of the General People’s Committee

 

The Secretariat of the General People’s Committee
Upon review of:

  • Law No. (55) of 1976 AD on the Civil Service;
  • Law No. (15) of 1981 AD On the Salary system of for National workers;

in the Socialist People’s Libyan Arab Jamahiriya;

  • Law No. (3) of 1423 FBP on the People’s Committees; and
  • The General People’s Committee Decree No. (190) of 1423 FBP on the Promulgation of

the Implementing Regulations of Law No. (3) of 1423 FBP on People’s Committees, and

  • Based on the submission of the Secretary of the General People’s Committee,

 

has decreed the following:

 

Article (1)

In application of the provisions of this Decree, an administrative body shall refer to the set of organizational divisions entrusted with performing the work related with the General People’s Committee and the Secretariat thereof.

 

Article (2)

The Administrative Body of the General People’s Committee shall be organized and the mandates of the main organizational divisions thereof shall be identified in accordance with this Decree.

 

Article (3)

The Administrative Body shall perform the following functions: 

a. In cooperation and coordination with the competent entities, make preparations for the issues presented to the General People’s Committee or the Secretariat thereof, and address the deficiencies therein; 

b) Study and consider the issues to be presented to the General People’s Committee or the Secretariat thereof, draft decisions and directives issued by the same and communicate them to the concerned entities; 

c) Draw up and review the draft regulations and decisions that the General People’s Committee or the Secretariat thereof is responsible for their issuance, and express an opinion on legal and regulatory issues; 

d) Follow up the implementation of the resolutions of the Basic People’s Congresses drafted in the General People’s Congress, in cooperation with the various People’s Committees and other competent entities, and develop periodic reports on the progress of implementation; 

e. Follow up the implementation of bylaws, decrees and instructions issued by the General People’s Committee and the Secretariat thereof, and prepare periodic reports on the progress of implementation; 

f. Receive and present the correspondence and minutes of the meetings of the People’s Committees of Basic People’s Congresses and Specialized General People’s Committee and communicate the resolutions and instructions issued thereto; 

g. Collect and provide data, information and statistics related to the work of the General People’s Committee and the Secretariat thereof, which are to be presented before the Basic People’s Congresses; 

h. Communicate and follow up the implementation of the decisions, instructions and directives of the Secretary of the General People’s Committee; 

i. Prepare draft laws and any other matters the General People’s Committee wishes to present to the Basic People’s Congresses for approval; 

j. In coordination with the concerned entities, follow up foreign cooperation matters and prepare the necessary reports thereon; 

k) As for the activities of the General People’s Committee and the Secretariat thereof, set up a system for documentation and data entry, update and extraction using state-of-the-art scientific methods; 

l. Undertake the process of military coordination for those enrolled in national service, in accordance with the decisions made in this regard; and 

m. Undertake the financial and administrative affairs of the Body and its employees.

 

Article (4)

The Body shall have an undersecretary to be responsible – under the supervision of the Secretary of the General People’s Committee – for communicating the decisions and instructions of the General People’s Committee and the Secretariat thereof to other bodies, in addition to undertaking the responsibilities designated for the Undersecretary in the legislation in force.

 

Article (5)

The Organizational Structure of the Body shall consist of the following offices: 

a. Secretary’s Office; 

b. Legal Affairs Office; 

c. Committee Affairs Office; 

d. Follow-Up Office; 

e. Administrative and Financial Affairs Office; and 

f. Computer and Documentation Unit.

 

Article (6)

The Secretary’ Office shall have the following mandates: 

a. Organize the Secretary’s appointments, meetings and contacts, and receive his guests; 

b. Receive the correspondence of the Secretary and present the same thereto; 

c. Receive, prepare, organize and keep the correspondence of a special nature; and

d. Make preparations for meetings of the Secretary of the General People’s Committee, prepare and keep their minutes and follow up the measures taken in their regard.

 

Article (7)

The Legal Affairs Office shall have the following mandates: 

f) Draw up and review the draft regulations and decisions that the General People’s Committee or the Secretariat thereof is responsible for their issuance; 

b. Review the draft laws, which the General People’s Committee decides to present to the Basic People’s Congresses prior to referring the same to the Secretariat of the General People’s Congress; 

c. Consider, express an opinion in, prepare legal memoranda and give advice on legal and regulatory matters; 

d. Follow up the lawsuits filed against the General People’s Committee or the Secretariat thereof exclusively, and coordinate with the State Lawsuits Authority in their regard; 

e. Organize and supervise the library, undertake the supply and borrowing processes, and propose books and references for acquisition; and 

f. Keep full copies of the official gazette, legal encyclopedias, circulated newspapers and journals and other studies, research and publications relevant to the functions of the Body in the library.

 

Article (8)

The Committee Affairs Office shall have the following mandates: 

a. Receive and present the correspondence and minutes of the meetings of the People’s Committees of Basic People’s Congresses and Specialized General People’s Committee and prepare the correspondence for communicating the resolutions and instructions issued thereto; 

(b) Receive any incoming issues and matters required to present the same to the General People’s Committee and the Secretariat thereof and organize documents, information, papers, and statements related thereto; 

c. Undertake the management affairs of other bodies and entities reporting to the General People’s Committee; 

d. Make preparations for the meetings of the General People’s Committee or the Secretariat thereof and other expanded meetings, prepare meeting agendas, communicate meeting times and venues, record meeting proceedings, prepare meeting minutes, and number, keep and communicate the decisions and instructions thereof. 

e. Make preparations for the meetings of the committees formed by a decree of the General People’s Committee or the Secretariat thereof, record and maintain their minutes, provide any data or information deemed necessary by such committees and receive their reports in order to be presented; and 

f. Follow up and periodically report on the decrees and instructions issued by the General People’s Committee or the Secretariat thereof.

 

Article (9)

The Follow-Up Office shall have the following mandates: 

a. Follow up the implementation of the resolutions of the Basic People’s Congresses drafted in the General People’s Congress, in cooperation with the various People’s Committees and other competent entities, determine their implementation position by the concerned entities and develop the necessary reports in this regard; 

b. In coordination with the competent entities in this regard, follow up the implementation of estimation plans and annual budgets and submit periodic reports thereon; 

c. In cooperation with the competent entities, follow up the work of the joint economic committees, submit reports thereon, and prepare the matters to be presented to the General People’s Committee or the Secretariat thereof; 

d. In coordination with the competent entities, follow up the activities of international economic bodies and develop periodic reports on them, together with any proposals it deems appropriate; 

e. Follow up the progress of import and export activities in coordination with the competent entities in this regard; 

f. In coordination with the competent entities, collect data on production and service projects in the various phases thereof; 

g. Cooperate and coordinate with the specialists of the General People’s Committee for People’s Monitoring and Follow-up and the competent administrative bodies to ensure that the observations received regarding production and service projects are taken into account; 

h. Examine and review specifications and follow up the implementation of strategic or inter-sectoral projects; 

i. Follow up the implementation of ratified bilateral, regional and international agreements; 

j. Follow up the implementation of the decrees and instructions issued by the General People’s Committee in all matters related to relations or integration with sister and other countries; and 

h) Follow up local and international media, prepare a summary of its most important content.

 

Article (10)

The Administrative and Financial Affairs Office shall be mandated with: 

a. Undertaking the functional affairs of members of the General People’s Committees; 

b. Undertake all matters related to personnel affairs and arrange the functional organizational structure in accordance with the legislation in force, and propose periodic programs and scenarios for training in a manner that enhances employee performance; 

c. Prepare correspondence in relation to foreign missions for various purposes; 

d. Prepare the Body’s budget, take all financial actions to implement the budget, cover its requirements, and provide the stores with the necessary items within the limits of approved appropriations and in accordance with the systems and procedures provided for in the relevant financial laws and legislations in force; 

e. Receive the Body’s guests, organize their appointments and meetings and finalize their procedures. 

f. Undertake inquiry functions and receive and guide the Body’s visitors; 

g. Arrange shifts and protect the Body’s assets and the safety of the employees thereof; 

h. Organize the social, cultural, sports and intellectual activities of the Body’s employees, develop necessary programs to enhance the relationship among employees, and identify their problems and help in addressing the same; 

i. Carry out services works and supervise photocopying and scanning; 

j. Regulate the movement of the Body’s vehicles and monitor their use and maintenance; and 

k. Carry out and organize archiving while ensuring that files, documents and correspondences are safely recorded, circulated and archived and can easily be referenced thereto.

 

Article (11)

The Computer and Documentation Unit shall have the following mandates: 

a. Collect and document the information and statistics that serve the purposes of the Body; 

b. Provide computer devices, introduce a unified system for keeping, retrieving and updating data, statistics and information using cutting edge scientific methods and offer necessary services to computer devices; 

c. Carry out printing work, and introduce and develop text-processing systems for printing and provide relevant training; and 

d. Perform translation work.

 

Article (12)

The Body shall have a financial auditor to examine, audit and verify disbursement transactions before being conducted and ensure the sound implementation of relevant applicable financial legislations and regulations in their regard. Furthermore, The Body shall audit custody accounts and stores to ensure compliance with the legislations regulating the same.

 

Article (13)

The General Military Coordinator shall undertake military coordination affairs for those enrolled in national service, armed people alternate and local defense. He shall also supervise and follow up the work of military coordinators in the People’s Committees of Basic People’s Congresses, Specialized General People Committees and other entities. The General Military Coordinator shall act as a point of contact between the bodies specialized in armed people and military coordinators. He shall be assisted by a number of employees to perform his duties.

 

Article (14)

The Legal Affairs Office, Secretary Office and Financial Auditor shall directly report to the Secretary of the General People’s Committee, while the other organizational divisions identified in this Decree shall report to the Undersecretary.

 

Article (15)

The Secretary of the General People’s Committee shall have the powers related to the appointment, transfer, delegation and secondment of the employees of the Body and other entities, which the General People’s Committee is responsible for deciding on their personnel affairs.

 

Article (16)

The Body may engage experts and specialists as it deems fit, according to the controls set forth by the Secretary of the General People’s Committee.

 

Article (17)

The bylaws of the Body shall be issued by a Decree of the Secretary of the General People’s Committee, without prejudice to the provisions of this Decree.

 

Article (18)

The General People’s Committee Decree No. (174) of 1993 AD on the Reorganization of the Secretariat of the General People’s Committee, as amended, as well as any other provision to contrary of the provisions of this Decree, shall be repealed.

 

Article (19)

This Decree shall enter into force as of the date of its issuance and shall be published in the official gazette.
