Amending Decree No. (17) of 1993 AD

On the Establishment of the General Corporation

The General People’s Committee,
Upon review of:

  • Law No. (76) of 1972 AD on publications;
  • Law No. (120) of 1972 AD on the establishment of the General Press Corporation;
  • Law No. (60) of 1974 AD on the General Company for Publication, Distribution and Advertising;
  • Law No. (69) of 1975 AD on the Audit Bureau;
  • Law No. (55) of 1976 AD on the Civil Service;
  • Law No. (15) of 1981 AD on the Salary System of National Workers in the Socialist People’s Libyan Arab Jamahiriya;
  • Law No. (13) of 1990 on the People’s Committees;
  • The General People’s Congress Resolution No. (2) of 1992 AD on the Organization of Secretariats;
  • The General People’s Congress Resolution No. (4) of 1992 AD on the Reorganization of Secretariats;
  • The General People’s Committee Decree No.(26) of 1993 AD on the Organization of the Secretariat of Media, Culture and Public Mobilization; and
  • The General People’s Committee Decree No. (17) of 1993 AD on Establishing the General Press Corporation, and
  • Based on the proposal of the Secretary of the People’s Committee for Media, Culture and Public Mobilization in his Memorandum No. (3) of 1993 AD dated 04/04/1993 AD,

 

 

has decreed the following:

Article (1)

The General People’s Committee Decree No. (17) of 1993 AD on Establishing the General Press Corporation shall be amended as follows:

By virtue of this Decree, a public corporation to be cited as the “General Press Corporation” shall be established with an independent legal personality and financial liability and supervised by the Secretary of the General People’s Committee for Media, Culture and Public Mobilization.  

 

 

Article (1) 

By virtue of this Decree, a public corporation to be cited as the “General Press Corporation” shall be established with an independent legal personality and financial liability and supervised by the Secretary of the General People’s Committee for Media, Culture and Public Mobilization. 

Article (2)

  For the purpose of realizing its objectives, the Corporation may adopt all necessary approaches and take all the actions that would lead to the realization of such objectives, within the scope of the responsibilities assigned thereto. In particular, the Corporation may: 

  1. Issue and own political, economic, cultural and social newspapers and magazines; 
  2. Establish specialized centers and printing, advertising and distribution agencies in the area of press and publications; and 
  3. Cooperate with entities with matching purposes inside and outside the State. 

The decisions of the Corporation with regard to the above three items shall enter into force only after approval by the Secretary of the General People’s Committee for Media, Culture and Public Mobilization. 

Article (3) 

The capital of the Corporation shall consist of the following: 

  1. Capitals, net asset value and rights of the newspapers and magazines owned by the Corporation; and 
  2. Funds allocated by the State to the Corporation. 

Article (4)

Pending the formation of the People’s Committee of Corporation in accordance with Law No. (13) of 1990 AD on the People’s Committees referenced above, the Corporation shall be managed by a management committee with the authorities and responsibilities vested in the Board of Directors under Law No. 120 of 1972 AD on the Press Corporation. The Committee’s Secretary shall exercise the authorities of the General Director and Chairman of the Board of Directors. 

Article (5) 

The Management Committee shall consist of a secretary to be appointed by a decree of the General People’s Committee, based on a proposal by the Secretary of the General People’s Committee for Media, Culture and Public Mobilization, and the following members:

– Secretary of the Writers Association;

– Secretary of the Journalists Syndicate; 

 

– Secretary of the Faculty of Arts and Media; and   

– Editorial secretaries of the newspapers and magazines issued by the Corporation. 

Subject to a decision by the Secretary of the General People’s Committee for Information, Culture and Public Mobilization, qualified members with an interest in journalism and media may be added to the Committee, provided that they do not constitute more than one third of the total membership stipulated in the previous paragraph. 

Article (6) 

The periodic and semi-periodic newspapers, magazines and publications identified by the virtue of a decision issued by the Secretary of the General People’s Committee for Media, Culture and Public Mobilization shall be the property of the Corporation established hereby, together with the funds and rights of such publications and the financial appropriations assigned thereto in the State’s budget. The Corporation shall bear the obligations associated with such publications only within the limits of their assets and rights owned by the Corporation on the enforcement date of this Decree. 

 

Article (7) 

The staff of the newspapers, magazines and publications owned by the Corporation, shall be hereby transferred to the Corporation, with their same original positions. 

 

Article (8) 

Pursuant to a Decree of the Secretary of the General People’s Committee for Media, Culture and Public Mobilization, a committee shall be formed to make an inventory of and evaluate the assets and rights of the newspapers, magazines and publications owned by the Corporation. 

 

Article (2)

Any provision that is contrary to the provisions of this Decree shall be repealed. 

 

Article (3) 

This Decree shall enter into force as of the date of its issuance and shall be published in the official gazette
