on some provisions relating to the dependency of the air, sea, and land ports and the competencies of their directors

The General People’s Committee

Upon review of:

  • Law No. (1) of 1375 FDP on the work system of People’s Congresses and People’s Committees and the executive regulation thereof;
  • The Law of the Financial System of the State and the amendments thereof, and the budget, accounts, and warehouse regulation thereof;
  • Law No. (81) of 1970 AD on ports;
  • Customs Law No. (67) of 1972 AD and the amendments, regulations, and decrees issued pursuant thereto;
  • Law No. (10) of 1992 AD on security and police;
  • Law No. (6) of 1987 AD on the entry and residence of foreigners in Libya and their exit therefrom, and the executive regulation and amendments thereof;
  • Law No. (6) of 1373 FDP on civil aviation;
  • General People’s Committee Decree No. (35) of 1371 FDP on establishing the Civil Aviation Authority;
  • General People’s Committee Decree No. (260) of 1373 FDP on adopting provisions on certain airports;
  • General People’s Committee Decree No. (14) of 1374 FDP on adopting some provisions on ports;
  • General People’s Committee Decree No. (955) of 1375 FDP on adopting some provisions on land ports;
  • General People’s Committee Decree No. (314) of 1376 FDP on establishing the Passports, Nationality, and Foreigner Affairs Authority;
  • Secretary of the General People’s Committee for Public Security Decree No. (165) of 1373 FDP (2004 AD) on organising entry and exit ports;
  • Secretary of the General People’s Committee for Public Security Decree No. (57) of 1373 FDP (2005 AD) on adopting a provision in Decree No. (131) of 1372 FDP (2004 AD) on the internal regulation of the administrative apparatus of the General People’s Committee for Public Security;
  • The minutes of the General People’s Committee fifth regular meeting of 1377 FDP;
  • The minutes of the meeting of the committee formed in execution of the decision of the General People’s Committee seventh regular meeting of 1377 FDP;

has decreed:

Article (1)

The dependency of all air, sea, and land ports shall be assigned to the General People’s Committee for Public Security.

Article (2)

By virtue of the provisions of this decree, the following competencies shall be assigned to the directors of port security:

  1. Administrative supervision of all public security apparatuses in the port without interference in the technical competencies of each entity.
  2. Inflict disciplinary penalties for employees of public security apparatuses in the port in accordance with the organising laws for trying the same.
  3. Take measures for the transport of members from the port in coordination with the entities that are subordinate thereto with a statement of the reasons and justifications for the transport.
  4. Take security measures to ensure the achievement of security control over the port without prejudice to the progress of administrative and technical works.
  5. Issue the necessary administrative instructions for all security apparatuses to ensure the performance of all duties vested therein in the required manner.
  6. Supervision of the implementation of security plans and programs drafted to preserve security and order within the borders of the port.
  7. Form a security room presided over by the director of security in the port, with the presidents of other public security apparatuses operating in the port as members, with the purpose of coordinating work, implementing the security plans entrusted to those apparatuses, and overseeing their implementation.
  8. Draft regulations for the movements of people and mechanisms inside the port and monitor adherence thereto.
  9. Draft procedures for entry and exit movement inside the port in accordance with the laws and agreements in force.
  10. Any other tasks assigned thereto in the field of ports in accordance with the legislation in force.

Article (3)

This decree shall enter into force from its date of issuance. Any provision contrary to the provisions thereof shall be repealed and the competent bodies shall implement it. It shall be published in the Procedural Register.
