Decree No. (323) of 1993 AD

on the Organization of the Libyan Centre

for Remote Sensing and Space Science (LCRSSS)

 

The General People’s Committee,
Upon review of:

  • The State Financial System Law, as amended;
  • Law No. (76) of 1975 AD on the Audit Bureau;
  • Law No. (55) of 1976 AD on the Civil Service, as amended;
  • Law No. (15) of 1981 AD on the Salary System of National workers

in the Socialist People’s Libyan Arab Jamahiriya;

  • Law No. (13) of 1990 on the People’s Committees;
  • Law No. (16) of 1992 AD on the Administrative Structure; and
  • The General People’s Committee Decree No. (27) of 1993 AD on Organizing the Secretariat

of the General People’s Committee for Education, Youth, Scientific Research and Vocational Training, and

  • Based on the submission of the Secretary of the General People’s Committee for Education, Youth, Scientific Research

and Vocational Training in his Letter No. (ت ل / 82) dated 15/03/1993 AD,

 

has decreed the following:

 

Article (1)

The Libyan Center for Remote Sensing and Space Science (LCRSSS) shall be organized and its functions and responsibilities shall be identified in accordance with the provisions of this Decree.

 

Article (2)

LCRSSS shall have an independent legal personality and financial liability and undertake the responsibilities thereof under the supervision of the Secretary of the General People’s Committee for Education, Youth, Scientific Research and Vocational Training.

 

Article (3)

LCRSSS headquarters and legal domicile shall be located in the city of (Tripoli) in the Great Jamahiriya. LCRSSS may establish branches or offices thereof in the Jamahiriya by a Decree of the Secretary of the General People’s Committee for Education, Youth, Scientific Research and Vocational Training.

 

Article (4)

LCRSSS aims to advance theoretical and applied research and studies in the scientific fields that fall within its responsibilities. To achieve this objective, LCRSSS shall: 

1. Propose objectives and prioritization policies for scientific research within its specializations, set up research programs and supervise their implementation in light of the general policy and scientific plan approved by the competent entity; 

2. Develop a scientific base specialized in the applications of remote sensing and other space sciences in the Great Jamahiriya; 

3. Execute the National Seismological Network (LNSN) to be established in the Great Jamahiriya, in accordance with the effective regulations governing the contract; 

4. Improve and develop the scientific capabilities of scientists and researchers, and attract international experts to contribute to the implementation of LCRSSS plan and programs; 

5. Develop research and scientific plans, follow up on the implementation thereof, and improve LCRSSS scientific and technical capabilities to keep abreast of scientific advances; 

6- Launch research and applied projects and conduct necessary studies in various fields; 

7. Collaborate with local and international research centers whose areas of specialization are in line with those of LCRSSS; 

8. Hold and call for local scientific seminars and conferences in coordination with the competent entities in order to stimulate the research movement and development of dedicated research capabilities; 

9. Spread a scientific culture and awareness through the publications issued and seminars held by LCRSSS; 

10. Contribute to solving the scientific problems that face various sectors specialized in scientific-related applications; and 

11. Offer scientific and technical advice in the areas related to the activity thereof.

 

Article (5)

The organizational structure of LCRSSS shall consist of several departments and offices, as set out in LCRSSS Bylaws, which shall further identify their functions and organize their relationships.

 

Article (6)

The management of LCRSSS shall be assumed by a management committee to be formed by a decree of the General People’s Committee, based on a proposal by the Secretary of the General People’s Committee for Education, Youth, Scientific Research and Vocational Training.

 

Article (7)

The Management Committee shall undertake the following mandates: 

a. Follow up the progress of research and studies related to LCRSSS activities; 

b. Propose research plans for LCRSSS within the framework of the State’s general policy and follow up the implementation thereof; 

c. Propose scientific, technical, administrative and financial bylaws for LCRSSS within the framework of the legislations in force; 

d. Prepare the draft annual budget and final account; 

e. Propose the establishment and merger of departments and divisions, as required by work needs; and 

f. Form scientific, technical and administrative committees to serve LCRSSS purposes. The resolutions of the Management Committee in relation to paragraphs “c, d and e” shall enter into force only after being approved by the General People’s Committee for Education, Youth, Scientific Research and Vocational Training.

 

Article (8)

The Secretary of the Management Committee shall supervise LCRSSS affairs and organize the work therein. In particular, the Secretary shall: 

a. Implement the resolutions of the Management Committee; 

b. Run LCRSSS and supervise the employees thereof, in accordance with the legislations in force; 

c. Implement the regulations organizing LCRSSS work; 

d. Communicate with research centers and specialized scientific and technical institutions and institutes inside and outside the Great Jamahiriya to benefit from their expertise within LCRSSS specialization; 

e. Prepare periodic and annual reports on work progress at LCRSSS and submit them to the Secretary of the General People’s Committee for Education, Youth, Scientific Research and Vocational Training; and 

f. Represent LCRSSS in its relations with third parties and before the judicial authorities.

 

Article (9)

LCRSSS Management Committee may engage experts in rare scientific and technical areas to perform certain functions related to LCRSSS activity, in accordance with the legislations in force.

 

Article (10)

The Financial resources of LCRSSS shall consist of: 

1. Revenues earned by LCRSSS in return for the services extended to others; 

2. Appropriations allocated thereto in the State budget; and 

3. Unconditional gifts and donations received by LCRSSS.

 

Article (11)

LCRSSS staff members shall be governed by the provisions of Law No. (55) of 1976 AD on the Civil Service and Law No. (15) of 1981 AD on the Salary System of National workers in the Socialist People’s Libyan Arab Jamahiriya.

 

Article (12)

The scientific discoveries and inventions that result from LCRSSS activity shall be the sole property of LCRSSS. LCRSSS may register such discoveries and inventions and earn economic benefits therefrom. LCRSSS may obtain, from third parties, the rights related to the discoveries or inventions within the specialization of LCRSSS in exchange for financial terms.

 

Article (13)

LCRSSS shall have an independent budget. 

The financial year of LCRSSS shall commence with the beginning of the State’s financial year and shall end upon the end of the same. However, the first financial year shall begin as of the date of enforcement of this Decree and shall end at the end of the next financial year.

 

Article (14)

LCRSSS may open a bank account with a bank operating in the Great Socialist People’s Libyan Arab Jamahiriya to deposit its funds therein.

 

Article (15)

The General People’s Committee for People’s Monitoring and Follow-up shall undertake the examination and audit of LCRSSS accounts, pursuant to the provisions of the aforesaid Law No. (79) of 1975 AD.

 

Article (16)

The bylaws of the LCRSSS shall be issued by a Decree of the Secretary of the General People’s Committee for Education, Youth, Scientific Research and Vocational Training, without prejudice to the provisions of this Decree.

 

Article (17)

This Decree shall enter into force as of the date of its issuance and shall be published in the official gazette.
