Decree No. (49) of 1993 on establishing two courts and prosecutions of first instance

 

The Secretary of the General People’s Committee for Justice and Public Security

Decree No. (49) of 1993 AD

on Establishing Two Courts of First Instance and Two Plenary Prosecutions

 

Secretary of the General People’s Committee for Justice and Public Security,
Upon review of:

  • The Judicial System Law issued by Law No. (51) of 76 AD;
  • The General People’s Committee Decree No. (19) of 1993 AD on Organizing the Secretariat

of the General People’s Committee for Justice and Public Security;

  • The proposal of the Judicial Bodies Inspection Department; and
  • The submission of the Undersecretary of Judicial and Legal Affairs,

 

has decreed the following:

 

Article (1)

A court of first instance- to be cited as “Ajdabiya Court of First Instance” – shall be established and headquartered in Ajdabiya. Such court shall be assigned the same jurisdiction of the summary and remote courts listed below:

1. Ajdabiya Summary Court

2. Jalu Summary Court

3. Awjila Summary Court

4. Kufra Summary Court

5. Abolished

6. Abolished

 

Article (2)

A plenary prosecution- to be cited as “Ajdabiya Plenary Prosecution”- shall be established and headquartered in Ajdabiya. Such prosecution shall be assigned the same jurisdiction of Ajdabiya Court of First Instance. The summary and remote prosecutions listed below shall report to Ajdabiya Plenary Prosecution:

1. Ajdabiya Summary Prosecution

2. Jalu Summary Prosecution

3. Awjila Summary Prosecution

4. Kufra Summary Prosecution

5. Brega Summary Prosecution

6. Jikharra Summary Prosecution

 

Article (3)

A court of first instance- to be cited as “Jadu Court of First Instance”- shall be established and headquartered in Jadu. Such court shall be assigned the same jurisdiction of thesummary and remote courts listed below:

1. Jadu Summary Court

2. Riyayna Summary Court

3. Zintan Summary Court

4. Ruheibat Summary Court

5. Nalut Summary Court

6. Ghadames Summary Court

7. Rajban Remote Court

8. Al Harabah Remote Court

9. Kabaw Remote Court

10. Al Jawsh Remote Court

11. Badr Remote Court

12. Tiji Remote Court

13. Wazzin Remote Court

14. Sinawen Remote Court

15. Daraj Remote Court

 

Article (4)

A plenary prosecution- to be cited as “Jadu Plenary Prosecution”- shall be established and headquartered in Jadu. Such prosecution shall be assigned the same jurisdiction of Jadu Court of First Instance. The summary and remote prosecutions listed below shall report to Jadu Plenary Prosecution:

1. Jadu Summary Prosecution

2. Riyayna Summary Prosecution

3. Zintan Summary Prosecution

4. Ruheibat Summary Prosecution

5. Nalut Summary Prosecution

6. Ghadames Summary Prosecution

7. Rajban Remote Prosecution

8. Al Harabah Remote Prosecution

9. Kabaw Remote Prosecution

10. Al Jawsh Remote Prosecution

11. Badr Remote Prosecution

12. Tiji Remote Prosecution

Article (5)

This Decree shall enter into force as of the date publishing the same in the official gazette and shall be implemented by the competent bodies.
