of 2012 AD

on creating an office for the Prime Minister in Benghazi

The Prime Minister,

Upon review of:

  • The Constitutional Declaration;
  • Law No. (12) of 2010 AD on the Labour Relations Law and the implementing regulations thereof;
  • National Transitional Council Decree No. (184) of 2011 AD on approving the transitional government;
  • Cabinet Decree No. (74) of 2012 AD approving the organisational structure and administrative unit of the Prime Minister’s Office;

has decreed:

Article (1)

An office affiliated to the Prime Minister shall be created and its premises shall be in the city of Benghazi.

Article (2)

The Office shall be authorised to perform the following competencies:

  1. Monitor the performance of government bodies within the sphere of the Office’s work in Benghazi and the surrounding cities.
  2. Monitor and implement Cabinet decrees within its competence and work to remedy difficulties and obstacles though the competent bodies.
  3. Coordinate with the local councils and administrative units affiliated to the ministries to provide the best services to the citizens in the area.
  4. Refer matters that require a decision from the Cabinet or Prime Minister and propose the necessary action with regard thereto.
  5. Hold meetings with the bodies holding competence to implement projects to confirm proper implementation thereof and propose the necessary action with regard thereto.
  6. Adopt the administrative and financial procedures that ensure proper performance thereof within the limits of its competencies, in accordance with the Office’s approved budget.

Article (3)

The Office shall have a budget entered within the financial allocations for the Prime Minister’s Office, to be disbursed to the Office in accordance with the financial systems in place.

Article (4)

The Office shall have a director, named under a decree from the Prime Minister. It shall also have a number of employees, whether through transfer, appointment, secondment, or contracting, according to the actual needs of the Office.

Article (5)

This Decree shall enter into force on the date of its issue and shall be implemented by the competent bodies.
