Decree on the Formation of the Disciplinary Board for Financial Violation

Upon review of:

● Law No. (55) of 1976 AD on the Civil Service;

● The Secretary of the General People’s Committee Decree issued on 5 Muharram 96 FDP, corresponding to 9/9/1986 AD, on the Re-Formation of the Disciplinary Board for Financial Violations; and

● The People’s Follow-Up Authority’s Letter No. م د / 108 / 5030 dated 23 Rabi’ al-Thani 1398 FDP, corresponding to 3/12/1988 AD,

The Secretary of the General People’s Committee has decreed the following:

Article (1)

The Disciplinary Board for Financial Violation shall be formed as follows:

a) A magistrate, whose grade is not less than a counsellor in the Courts of Appeal, to be nominated as the “Chairperson” by the Management Committee of the General Authority for Judicial Affairs;

b) A representative of the People’s Follow-Up Authority, whose grade is not less than the eleventh, to be nominated as a “Member” by the Authority’s People’s Committee;

c) The Undersecretary of the Secretariat of Treasury, or any Secretariat employee whose grade is not less than the eleventh, to be nominated as a “Member”; and

d) A member of the General Directorate for Law or Public Prosecution, whose grade is not less than a second deputy prosecutor, to be nominated as a “Member” by the Management Committee of the General Authority for Judicial Affairs.

Article (2)

The Jurisdiction of the Disciplinary Board, formed pursuant to Article (1) of this Decree, shall include all municipal departments.

Article (3)

The Disciplinary Board shall convene in the city of Tripoli, and may convene in the place where the violation has occurred.

Article (4)

The Secretary of the General People’s Committee Decree on the Formation of the Disciplinary Board for Financial Violation, referenced above, shall be repealed.

Article (5)

This Decree shall enter into force as of the date of its issuance and shall be published in the official gazette.
