On Amending Law No. (38) of 2012

Establishing Some Provisions Concerning the Transitional Phase

Upon review of:

The Victory Declaration of the 17 February Revolution on 22 February 2011;

The decision forming the National Transitional Council (NTC) and determining its powers;

The bylaws of the NTC and its internal regulation;

The Constitutional Declaration issued on 3 August 2011 and its amendments;

Law No. (37) of 1974 on issuing the Military Penal Code;

Law No. (38) of 2012 of some measures related to the transitional phase;

issued the following law:

Article (1)

The text of Article (1) of the above-mentioned Law No. (38) of 2012 shall be amended as follows:

The Ministers of the Interior and Defence or their deputies, each within his mandate, shall take the necessary measures to handle the seniors officials from the former regime who have been arrested or detained by revolutionaries during military operations during the 17 February Revolution or on the occasion thereof as of the date that this law enters into force, by referring them to the competent prosecution office if sufficient evidence exists that they committed acts that are deemed criminal under the law, or otherwise release them no later than 30/8/2012.

Article (2)

This law shall enter into force from the date of its issuance, and it shall be published in the Official Gazette.
