on forming a special security force

Upon review of:

  • The interim Constitutional Declaration issued on 3 August 2011 and the amendments thereof;
  • Law No. (40) of 1974 on service in the Armed Forces;
  • Law No. (43) of 1974 on the retirement of soldiers;
  • Law No. (5) of 1978 amending certain provisions of military laws;
  • Law No. (1) of 2012 on approving certain provisions pertaining to the powers of command levels in the Libyan Army;
  • General National Congress Resolution No. (8) of 2012;
  • The results of the General National Congress session held on 16/10/2012;

the following resolution was issued:

Article (1)

A special security force shall be formed to secure and protect the headquarters and members of the General National Congress (GNC) under the control of the committee established by the aforementioned GNC Resolution No. (8) of 2012.

Article (2)

The security force referred to in the foregoing article shall be provided with all the necessary capacities to conduct raids, disperse gatherings, break up clashes, and provide sufficient protection for GNC members and employees to perform their duties.

Article (3)

The security force shall be subject to the administrative and financial oversight of the GNC Office. It shall be headed by the GNC President and it shall take orders directly from him. The security force shall also exercise its competences in accordance with the instructions issued in this regard.

Article (4)

Any GNC member shall have the right to submit in writing to the GNC Presidency Office a request for personal protection.

Article (5)

Officers and privates of the security force shall be subject to the legislation in force concerning the rules of discipline, salary, bonus, promotion, leave, and other matters related to the performance of duties.

Article (6)

The financial remunerations of security force officers and privates as well as the organisation of its work mechanisms and rules, and all matters related to the performance of its entrusted duties, shall be determined by a decision issued by the GNC president.

Article (7)

The provisions of this resolution shall enter into effect from its date of issuance. It shall have the force of law and it shall be implemented by the concerned entities, each within its mandate.
