on declaring closed military zones and adopting some provisions on borders

The General National Congress

Upon review of:

  • The Interim Constitutional Declaration issued on 3 August 2011, and the amendments thereof;
  • General National Congress Resolution No. (62) of 2013 on approving the amendment of the General National Congress rules of procedure;
  • Law No. (11) of 2012 adopting some provisions concerning the powers of command levels in the Libyan Army;
  • Resolution No. (16) of 2012 on declaring closed military zones and adopting some provisions on borders;
  • The conclusions of the General National Congress in its ordinary session held on 30 July 2013;

issued the following resolution :

Article (1)

Article (1) of the aforementioned General National Congress Resolution No. (16) of 2012 shall be amended as follows:

Southern Libya shall be divided into three closed military zones governed by all relevant extraordinary legislation as detailed below:

  1. The military zone of Sebha, which shall include the following districts:

– Sebha.

– Murzuk.

– Ubari.

– Ghat.

– Al-Shati’.

  1. The military zone of Kufra.
  2. The military zone of Ghadames.

The administrative military borders of such zones and districts shall be determined by a decision issued by the Minister of Defence based on the proposal of the Chief of Staff of the Libyan Army.

Article (2)

A new article shall be added to the aforementioned Resolution No. (16) of 2012 under Article (1) bis. The text thereof shall be as follows:

Subject to the competences of civil institutions and entities in the State, the aforementioned military zones and districts shall be entrusted with the following duties.

  1. 1. Duties of military zones

– Secure and protect the zone against any internal or external attacks.

– Control all military units within the zone.

– Protect vital targets and facilities located inside the zone.

– Divide the military zone into border districts based on area and geography.

– Coordinate the cooperation between other security services inside the zone.

– Follow up on and oversee the training of military units inside the zone.

– Set up emergency plans for emergencies and external threats.

– Execute all orders and instructions issued by higher levels.

– Coordinate with various armed forces (air force- naval forces- air defence – border guard) regarding the security and protection of the zone.

  1. 2. Duties of military districts

– Secure and protect the district borders against any attack.

– Oversee the training of their affiliated units.

– Protect vital targets and institutions located inside the district.

– Execute all instructions and orders issued by the zone commander.

– Coordinate with other forces regarding the security of the border district.

Article (3)

The Chief of the General Staff shall appoint a military commander for each zone. The military commander shall be granted all the law enforcement powers and competences vested in the executive authorities, specifically the powers to arrest all wanted persons in these zones and to deport persons who have infiltrated the borders to their countries of origin. In this regard, the military commander may seek the assistance of any person as he deems necessary.

Article (4)

Article (4) of the aforementioned Resolution No. (16) of 2012 shall be repealed.

Article (5)

The provisions of this resolution shall enter into force from its date of issuance. This resolution shall be implemented by all entities, each within their mandate, and it shall be published in the Official Gazette.
