Law No. (9) of 1988 AD Amending Certain Provisions of the National Service Law

 

The General People’s Congress,

In implementation of the resolutions passed by the Basic People’s Congresses in their Third ordinary meeting in 1397 FDP, corresponding to 1988 AD, which were drafted by the General Forum of Basic People’s Congresses, and Professional Syndicates, Unions and Associations (the General People’s Congress) in its fourteenth ordinary meeting held during the period from 14 to 21 Rajab 1397 FDP, corresponding to 2-9 March 1988 AD, and

● Upon review of the provisions of Law No. (9) of 1987 AD on the National Service,

 

The General People’s Committee has formulated the following Law:

 

Article (1)

Articles 1, 4, 7 and 9 of Law No. (9) of 1987 AD on the National Service shall be amended as follows:

Article (1):

National service shall be required of all citizens who have reached eighteen years of age and are not over thirty-five years of age, provided that they are medically fit.

Medically unfit citizens shall perform the national service in production or service fields, under the same conditions set out in the National Service Law.

Performance of this service may be requested of those over the age of thirty-five in cases of war, mobilization, emergency, or active movements, pursuant to a decree by the Commander-in-Chief.

Those called for national service shall be distributed to the branches of the main armed forces (army, air force, navy, air defence forces) or any other military forces or divisions to be established, in accordance with the rules issued pursuant to a decree by the Commander-in-Chief.

As an exception to the provisions of this article, female citizens shall have the option to perform the national service either in the military or service and production fields under the same conditions set out in the National Service Law.

Article (4):

The following persons shall be exempted from national service:

a. Graduates of colleges, institutes, and schools designed to graduate officers, noncommissioned officers, and soldiers for service in the armed forces or police as well as students of such colleges, institutes, and schools, provided that they complete their studies and graduate. If they do not complete their studies, the period they spent studying shall be counted towards the period of national service;

b. Anyone who spent a period not less than the national service period in military service in the armed forces. If less, they shall be enlisted for the remaining period; and

c. Housewives. In application of this law, ‘housewives’ shall mean married, divorced or widowed women in whose custody children are placed.

Pursuant to a decree by the Commander-in-Chief of the Armed Forces, certain persons may be excepted from the performance of national service for reasons related to public interest.

Article (7):

All or certain persons who have performed national service shall be called, by a decree of the Commander-in-Chief of the Armed Forces, to undertake a military training each year. To the possible extent, an appropriate timing and location shall be selected, so as not to disrupt their normal business.

Such call up shall not apply to housewives who have already performed national service before marriage.

Article (9):

No citizen between eighteen and thirty-five years of age may be hired, remain in their position or job, be granted a license to practice an independent profession or registered in

the list of those practicing such profession, obtain other licenses or certificates, or complete

any administrative transaction, unless they present one of the certificates or forms set out in Article (6)(i) of this Law.

 

Article (2)

This Law shall be published in the official gazette and shall enter into force as of the date of its issuance.
