Decree No. (3) of 2016

on forming a special operations room for the leadership of military operations

in the area of the “Oil Crescent” (Ajdabiya and Sirte) against the Islamic State

The Commander-in-Chief of the Libyan Army

Upon review of:

• The Constitutional Declaration issued on 03/August/2011 and the amendments thereof;
• The Libyan Political Agreement of 17 December/2015;
• Military Penal Code No. (37) of 1974 and the amendments thereof;
• Law No. (40) of 1974 on military service and the amendments thereof;
• Law No. (43) of 1974 on military retirement and the amendments thereof;
• Law No. (35) of 1977 on reorganising the Libyan army;
• Code of Military Procedure No. (1) of 1999;
• The requirements of the public interest and the demands of the current period;

has decided:

Article (1)

A special operations room for the leadership of the military operations against what is known as the Islamic State shall be formed in the area located between Ajdabiya and Sirte. It shall be directly subordinate to the Commander-in-Chief of the Libyan Army.

Article (2)

All military or paramilitary formations shall be prohibited from executing any combat operations within the boundaries of this area unless they submit to the orders and instructions of the room formed by virtue of the provisions of this decree, with the exception of self-defense cases.

Article (3)

The leadership of the room shall be as follows:

Article (4)

This decree shall enter into force from its date of issuance. Any provision contrary thereto shall be repealed and the competent authorities shall implement it.
