Resolution No. (17) of 2012

on approving the principle of institutional reform

and political and administrative isolation

The General National Congress

Upon review of:

  • The interim Constitutional Declaration issued on 3 August 2011 and the amendments thereof;
  • Law No. (17) of 2012 on the rules of national reconciliation and transitional justice;
  • The United Nations’s lofty standards for human rights and transitional justice, and the UN’s recommendations for transforming public institutions that contributed to human rights violations into institutions that support peace, protect human rights, and reinforce respect for the rule of law by removing public officials and civil servants who were personally responsible for such violations;
  • For the sake of the public interest and institutional reform;
  • The internal regulation of the General National Congress;
  • The results of the General National Congress session held on 25/12/2013;

issued the following resolution:

Article (1)

The General National Council (GNC) acknowledges the principle of the need to reform the institutions of the State of Libya that are directly responsible for human rights violations, and the persons directly responsible for the corruption of political, economic, social, and administrative life in Libya since 01/09/1969 up to the declaration of liberation on 30 October 2011, through their removal and prevention from exercising political rights or holding sovereign functions in the State in accordance with due legal rules and the non-discrimination principle.

Article (2)

A committee composed of GNC members shall submit a draft law on isolation within a maximum period of fourteen days from the date of issuance of this resolution. For the purpose of such draft law, the committee shall communicate with civil society organisations, experts, consultants and other interested parties and specialists to collect their suggestions within seven days at most from the date of issuance of this resolution.

Article (3)

The provisions of this law shall enter into force from its date of issuance and shall be implemented by all parties, each within their mandate. This law shall be published in the Official Gazette.
