Resolution No. (47) of 2013

adopting special provisions concerning

the security of the city of Benghazi and its suburbs

Upon review of:

  • The interim Constitutional Declaration issued on 3 August 2011 and the amendments thereof;
  • The rules of procedure of the General National Congress;
  • The law of the financial system of the State and the budget, accounting, and inventory regulations, and the amendments thereof;
  • Law No. (10) of 1992 on police and security;
  • Law No. (7) of 2012 on establishing the Libyan Intelligence Service and the amendments thereof;
  • Law No. (11) of 2012 on determining the powers of leadership levels in the Libyan Army;
  • The conclusions of the eighty-sixth ordinary session of the General National Congress held on Tuesday 07/05/2013;

The following law was issued:

Article (1)

A security room shall be established in the city of Benghazi under the name “Joint Security Room” (JSR) with the composition stated in Annex No. (1) of Security Plan No. 1/2013 for securing Benghazi and its suburbs. The JSR shall maintain and stabilize security in Benghazi in cooperation with the concerned security services, and shall coordinate their efforts upon the entry into force of this law. In particular, the JSC shall:

  1. Perform the assignments and tasks issued by the Ministries of Defence and Interior and take all necessary and immediate procedures to face any act against the city.
  2. Apprehend wanted persons as assigned by the Public Prosecution.
  3. Clear the city of any brigades or forces that do not fall under the control of the Ministries of Defence and Interior.
  4. Purge the city of bad and negative phenomena such as arms trafficking, alcohol, drugs and others.
  5. Assist police departments in the performance of their duties and competences.
  6. Protect public and private properties and remove violating kiosks and buildings.
  7. Impound vehicles without license plates and immediately remove tinted windows

Article (2)

The JSR shall be led by an officer from the Libyan Army General Staff, with the membership of two officers from the Ministry of Interior (MOI) and the General Intelligence Service, a number of members from the armour branch and preventive security, and a sufficient number of soldiers and police officers based on the proposal of the JSR chief. The nomination of the JSR chief and members shall be determined by a joint decision by the Ministers of Interior and Defence.

Article (3)

The leadership of the General Staff and the MOI shall provide the necessary equipment, weapons, ammunition and services for the JSR, in addition to all the requirements for the proper completion of the mission.

Article (4)

The JSR shall have a support team under its control, to be established and equipped by the JSR chief and following his direct instructions.

Article (5)

All concerned military and civilian parties, particularly those headquartered in the city, shall assist the JSR in the performance of its duties in the best possible manner and shall abide by its instructions when the security situation requires so.

Article (6)

The martyrs and injured of the joint force created by virtue of this resolution shall receive in the implementation and on the occasion thereof the treatment reserved to the martyrs and injured in the line of duty in accordance with the legislation in force.

Article (7)

All medical guarantees and facilities shall be granted to JSR members in case of on-duty injury.

Article (8)

The Prosecutor General shall assign a sufficient number of Public Prosecution members to investigate all confiscated items and reported crimes, and shall take the necessary judicial procedures for the implementation of this resolution. The Ministry of Justice shall be tasked with taking the necessary procedures to accomplish the mission of the Public Prosecution members in performance of their duties.

Article (9)

This resolution shall enter into force from its date of issuance, repealing any contrary provision, and shall be implemented by all concerned parties, each within their mandate.
